APPROVE A THIRD AMENDMENT TO JOINT POWERS AGREEMENT WITH
VERMILLION RIVER WATERSHED JOINT POWERS ORGANIZATION FOR WATER
QUALITY IMPROVEMENTS ALONG HAMBURG AVENUE
Proposed Action
Staff recommends adoption of the following motion: Approve an amendment to Joint Powers
Agreement (JPA) with Vermillion River Watershed Joint Powers Organization (VRWJPO) for water
quality improvements along Hamburg Avenue, in conjunction with City Project 15-17.
Passage of this motion will extend the City and VRWJPO JPA agreement term to December 31,
2016.
Overview
The original JPA and Cost Sharing Contracts for the project provided $109,791.50 in VRWJPO and
$50,000 in DCSWCD funding, with the City’s engineering services providing the City’s cost
contribution to the project. The first Amendment to the JPA was executed September 24, 2015
and provided for VRWJPO contributions up to $140,000 to complete the project. The second
amendment to the JPA was executed on February 26, 2016 and extended the JPA term with
VRWJPO to August 31, 2016 to allow for final restoration of the project area.
This third amendment is necessary to extend the terms of the JPA agreement to December 31,
2016 as the contractor was delayed due to wet weather conditions earlier this year. The project
has been completed and was final accepted by the City Council in September, and extending the
terms of the JPA to December 31, 2016 will allow the VRWJPO to reimburse the City for this work.
