Overview
Representatives of JAS Lakeville Properties, LLC and Schneiderman’s Furniture have submitted a final plat
application and plans for the development of 4.8 acre Outlot B, Celebration Second Addition located south
of Celebration Church and west of Kenyon Avenue. Schneiderman’s Furniture will construct a 112,000
square foot, two story retail store on the site. In conjunction with the final plat, underlying roadway,
trailway, drainage and utility easements will be vacated. New easements shown on the Schneidermans
Furniture final plat will replace the easements being vacated. The Schneidermans Furniture preliminary
plat was approved by the City Council on August 22, 2016. The final plat lot and site design is consistent
with the approved preliminary plat.
The underlying development contract and PUD agreement for Outlot B, Celebration Second Addition
and the related special assessment agreement, which has been paid in full, have been requested to be
released in conjunction with the approval of the Schneidermans Furniture final plat.

RESOLUTION APPROVING THE FINAL PLAT
OF SCHNEIDERMANS FURNITURE
WHEREAS, the owner of the property described as SCHEIDERMANS
FURNITURE has requested final plat approval; and
WHEREAS, the Schneidermans Furniture preliminary plat was reviewed by the
Planning Commission and the Parks, Recreation and Natural Resources Committee and
approved by the City Council; and
WHEREAS, the final plat is consistent with the preliminary plat approved by the City
Council on August 22, 2016; and
WHEREAS, the final plat is acceptable to the City.
NOW, THEREFORE, BE IT RESOLVED by the Lakeville City Council:
1. The SCHNEIDERMANS FURNITURE final plat is approved subject to the
developer’s execution of the development contract and security requirements.
2. The Mayor and City Clerk are hereby authorized to sign the development contract,
stormwater management agreement, and the final plat mylars.
3. The City Clerk is directed to file a certified copy of this resolution with the
Dakota County Recorder.

RESOLUTION VACATING PUBLIC ROADWAY, TRAILWAY, DRAINAGE AND
UTILITY EASEMENTS
WHEREAS, the City Council conducted a public hearing on October 17, 2016, preceded by
two (2) weeks published notice, to consider the vacation of public roadway, trailway, drainage
and utility easements Doc. No 1708967, 1780605, and 1674635 and as platted with Outlot B,
Celebration Second Addition; and
WHEREAS, the City Council has determined that it is in the public interest to vacate said
public roadway, trailway, drainage and utility easements.
NOW, THEREFORE, BE IT RESOLVED by the Lakeville City Council:
1. The following public roadway, trailway, drainage and utility easements are hereby vacated,
subject to the recording of the Schneidermans Furniture final plat:

Subject: Schneidermans Furniture Final Plat and Vacation of Easements
INTRODUCTION
Representatives of JAS Lakeville Properties, LLC and Schneiderman’s Furniture have submitted
applications for final plat and the vacation of public roadway, drainage and utility and trailway
easements within Outlot B, Celebration Second Addition. The final plat and vacation of easements
is associated with the approved preliminary plat of Schneidermans Furniture located south of
Celebration Church, north of Gander Mountain and west of Kenyon Avenue. The Schneidermans
Furniture preliminary plat was approved by the City Council on August 22, 2016. The final plat is
consistent with the approved preliminary plat.
The final plat plans have been reviewed by Engineering Division staff and Parks and Recreation
Department staff. The easement vacation public hearing notice and plans have been distributed
to all affected utility companies.

PLANNING ANALYSIS

Zoning. The property zoning is C-3, General Commercial District which allows commercial uses
such as furniture stores.
Existing Conditions. The subject property is platted as Outlot B, Celebration Second Addition.
Schneiderman’s Furniture recently purchased the property for the construction of their new
furniture store. Grading and tree removal recently commenced to prepare the site for
development of the proposed new building.
Easement Vacation/Document Release. There are four public easements recorded on the
subject property title that must be vacated prior to recording the Schneidermans Furniture final
plat. The easements include public roadway, drainage, utility and trailway easements. New
easements shown on the final plat will replace the easements being vacated.
The applicant also requests that the development contract for Outlot B, Celebration Second
Addition and a related assessment agreement be released. Staff has determined that the
development contract has been satisfied and the assessment has been paid in full. This action
requires City Council approval and is included on the agenda simultaneously with consideration
of the final plat.
Surrounding Land Uses and Zoning:
North – Celebration Church (PUD District/Underlying C-3 District)
South – Gander Mountain (C-3 District)
East – Kenyon Avenue and Interstate 35
West – Jackson Heights Second Addition (RS-3 District)
Lot Area. Commercial lots within the C-3 District are required to provide a minimum lot area of
20,000 square feet. The proposed lot area of 4.8 acres exceeds Zoning Ordinance requirements.
Lot Width. The minimum lot width for a commercial lot in the C-3 District is 100 feet. The
proposed lot is approximately 400 feet in width which exceeds the minimum lot width
requirement.
Outlots. There are no outlots proposed with the Schneidermans Furniture final plat.
Streets & Right-of-Way. Kenyon Avenue right-of-way was dedicated with Celebration Second
Addition. No additional road right-of-way is required to be dedicated with the Schneidermans
Furniture final plat.

Park Dedication. The property is subject to the payment of a park dedication cash fee of $7,693
per acre. The 4.88 acre lot x $7,693 per acre equals a park dedication fee of $37,541.84 to be paid
at the time of final plat approval.
Tree Preservation. The tree preservation plan was approved with the preliminary plat.
Wetlands. There are no wetlands located within the Schneidermans Furniture final plat area.
Grading, Drainage and Erosion Control. The final plat includes grading, drainage and erosion
control plans have been reviewed by Engineering Division staff. Grading, drainage and erosion
control is discussed in more detail in the October 3, 2016 engineering memo prepared by Matt
Decur, Project Engineer and Mac Cafferty, Environmental Resources Manager.
RECOMMENDATION
The Schneidermans Furniture final plat is consistent with the approved preliminary plat and
complies with the requirements of the Zoning and Subdivision Ordinances. The proposed
vacation of public easements and the release the Celebration Second Addition development
contract and assessment agreement is recommended for approval. Planning Department staff
recommends approval subject to the following conditions:
1. Compliance with the stipulations listed in the October 3, 2016 engineering report
2. The site development and building exterior shall be developed in compliance with the plans
approved by the City Council.
3. Landscaping shall be installed according to the landscape plan approved by the City Council. A
$38,000 financial security shall be submitted the final plat to guarantee installation of the
landscaping.
4. All signs shall comply with Zoning Ordinance requirement. A sign permit must be issued by the
City prior to the installation of any signs.
5. A parking deferment application shall be submitted prior to issuance of a building permit.

6. Parking lot and building exterior lighting shall be down-cast cut-off type fixtures only. Tilt-up
light fixtures or fixtures that glare onto adjacent properties are not permitted. A lighting and
photometric plan shall be submitted with the building permit application.
7. All exterior building materials shall be integral colored and shall not be painted.

Kenyon Avenue
Schneidermans Furniture is west of and adjacent to Kenyon Avenue, a major collector roadway as
identified in the City’s Comprehensive Transportation Plan. Currently, Kenyon Avenue is
constructed as a 44-foot wide three-lane urban roadway with a shared center left turn lane. An 8-
foot wide sidewalk is located along the west side of Kenyon Avenue.
Kenyon Avenue adjacent to the parent parcel was reconstructed in 2001 to a three lane
roadway with City Project No. 00-21/Dakota County Project No. 05-35. Right of way was
dedicated with the Celebration 2nd Addition plat over the roadway, drainage, and utility
easement being vacated with Schneidermans Furniture.

The proposed development consists of a 112,000 square foot commercial building and
parking lot.
Access to the site will be from proposed driveways onto Kenyon Avenue. The parking lot will
provide capacity for 119 vehicles, including five accessible stalls. Parking is being deferred on
63 stalls. The construction of deferred parking will require the construction of retaining walls
and grading within the stormwater management basin.
The landscaping plan provides for several types of trees and shrubs in landscaped areas
around the building and parking lot. A landscaping buffer is being provided to the west of
the building, adjacent to neighboring residential properties. Landscaping areas around the
main building will be sodded and irrigated.

Construction traffic access and egress for grading, utility and site construction shall be from
Kenyon Avenue at the location of the proposed south driveway.

The Parks, Trails and Open Space Plan identifies a multi-purpose trail on the west side of
Kenyon Avenue. An 8-foot wide concrete sidewalk was constructed adjacent to
Schneidermans Furniture in 2000 with City Project No. 00-21.
There are no other public sidewalks or trails proposed with the Schneidermans Furniture
improvements. Pedestrian curb ramps will be added to the existing sidewalk along Kenyon
Avenue at the location of new driveways.
The Park Dedication requirement has not been collected on the parent parcels and will be
satisfied through a cash contribution that shall be paid with the final plat. The Park Dedication
Fee will be based on the rate in effect at the time of final plat approval, calculated as follows:
4.88 acres x $7,693.00/acre = $37,541.84

Schneidermans Furniture is located within subdistrict OL-54000 of the Orchard Lake sanitary
sewer district as identified in the City’s Comprehensive Sanitary Sewer Plan. Wastewater will
be conveyed through subdistrict OL-51200 via existing trunk sanitary sewer to the MCES
Farmington Interceptor and continue to the Empire Wastewater Treatment Facility. The
downstream facilities have sufficient capacity to serve the proposed development.
Development of Schneidermans Furniture includes the extension of public sanitary sewer. 8-
inch sanitary sewer will be extended to the Schneidermans Furniture north property line from
an existing stub located within an easement on the Celebration Church property. Private
sanitary sewer will be extended from the new sanitary sewer main to provide service to the
development.
The Sanitary Sewer Availability Charge has not been collected on the parent parcel and shall
be paid with the final plat. The fee will be based on the current rate in effect at the time of
final plat approval and will be paid with the building permit based on SAC Units determined
by the MCES.

Development of Schneidermans Furniture includes connection to existing 8” service stubs
within Kenyon Avenue. Private watermain will be extended within the development to
provide water service to the development. The City’s Comprehensive Water Plan does not
identify any trunk watermain improvements within the proposed plat.
Twelve inch trunk watermain in Kenyon Avenue was constructed with City Project 00-21. An
assessment agreement was completed for those improvements. Therefore, no Lateral
Watermain Access Charge is due on the Schneidermans Furniture development.

Final locations and sizes of all sanitary sewer and watermain facilities will be reviewed by City
staff with the final construction plans.

The existing private overhead service lines, located adjacent to the northwest corner of Lot 1,
Block 1 are not required by City Code to be buried and shall remain with the Schneidermans
Furniture development. All service lines installed for the Schneidermans Furniture
development shall be buried.

Schneidermans Furniture is located primarily within subdistricts CL-10, and CL-12 of the
Crystal Lake drainage district as identified in the City’s Water Resources Management Plan.
The City’s plan does not identify any trunk storm sewer improvements within the proposed
plat.
Development of Schneidermans Furniture includes the construction of private stormwater
management basins to collect and treat the stormwater runoff generated from the site. The
basins will provide water quality treatment and rate control of the stormwater runoff
generated from the Schneidermans Furniture development. The stormwater management
basins will be located within Lot 1, Block 1, Schneidermans Furniture and in City owned
Outlot A, Gander Mountain. The stormwater basin design is consistent with City
requirements. A Stormwater Maintenance Agreement is required with the final plat.
The final grading plan shall identify all fill areas in which the building footings will be placed
on fill material. The grading specifications shall also indicate that all embankments meet
FHA/HUD 79G specifications. The Developer shall certify to the City that areas with footings
placed on fill material are appropriately constructed. Building permits will not be issued until
a soils report and an as-built certified grading plan have been submitted and approved by
City staff.
Schneidermans Furniture contains more than one acre of site disturbance. A National
Pollution Discharge Elimination System General Stormwater Permit for construction activity is
required from the Minnesota Pollution Control Agency for areas exceeding one acre being
disturbed by grading. A copy of the Notice of Stormwater Permit Coverage must be
submitted to the City upon receipt from the MPCA.

Development of Schneidermans Furniture includes the construction of a private storm sewer
system. Storm sewer will be installed within the development to collect and convey
stormwater runoff generated from within the site to the private stormwater management
basins to be constructed on the site and on Outlot A, Gander Mountain.

construction plans.
FEMA FLOODPLAIN ANALYSIS
Schneidermans Furniture is shown on the Flood Insurance Rate Map (FIRM) dated 12/02/2011
as Zone X by the Federal Emergency Management Agency (FEMA). Based on this designation,
there are no areas in the plat located within a Special Flood Hazard Area (SFHA), as
determined by FEMA.

The tree preservation plan identifies 19 save trees along the west property line. Any save
trees that are removed will require a 2:1 replacement.

The developer is responsible for obtaining a MPCA Construction Permit for the site as well as
developing a SWPPP for the site prior to construction. The permit requires that all erosion and
sediment BMPS be clearly outlined in a site’s SWPPP. Changes made throughout construction
should be documented in the SWPPP. All areas within City outlot and the private stormwater
basins will be seeded with a native seed mix. It is the developer’s responsibility to ensure that
the areas establish with the correct native seed mix.
Additional erosion control measures may be required during construction as deemed
necessary by City staff or the Dakota County Soil and Water District. Any additional measures
required shall be installed and maintained by the developer.

The Developer shall post a security to ensure the final placement of iron monuments at
property corners with the final plat. The security is $100.00 per lot and outlot for a total of
$100.00. The City shall hold this security until the Developer’s Land Surveyor certifies that all
irons have been placed following site grading, street and utility construction.

A cash fee for one-year of streetlight operating expenses shall be paid at the time of final plat
approval and is calculated as follows:

A cash fee for the preparation of record construction drawings and for upgrading the City
base map shall be paid at the time of final plat approval and is calculated as follows:

The Developer shall submit the final plat and construction drawings in an electronic format.
The electronic format shall be in either .dwg (AutoCAD) or .dxf format.
The Developer shall also pay a cash fee for City Engineering Administration. The fee for City
Engineering Administration will be based on three percent (3.00%) of the estimated
construction cost, or $2,258.34.
