HomeMy WebLinkAboutHRA Item 03Lakes Date: November 7, 2016 Item No. APPROVAL OF A LIMITED WARRANTY DEED FOR THE CONVEYANCE OF THE ALTERNATIVE LEARNING CENTER PROPERTY TO ISD194 Proposed Action Staff recommends adoption of the following motion: Move to approve a Limited Warranty Deed to convey property located at 20950 Howland Avenue to ISD 194 Overview The above property located next to the Lakeville Area Art Center was acquired from All Saints Church in conjunction with the redevelopment of the former All Saints Catholic Church into the Art Center. The HRA entered into a lease purchase agreement with ISD 194 to provide the necessary financing for the acquisition and renovation of the former All Saints grade school building. The lease purchase financing required that the HRA retain ownership of the property for the 15 year duration of the financing. The last payment under the lease purchase agreement, which was financed by the Lease Finance Group, was made by ISD 194 at the end of 2015. The Lease Agreement between the HRA and ISD 194 provided an option to ISD 194 to purchase the property for $1 at the end of the agreement. ISD 194 is requesting to exercise this option. The City Attorney has prepared the attached Limited Warranty Deed to convey ownership of the property to ISD 194. Staff recommends approval of the Limited Warranty Deed to convey this property to ISD 194. A Parking/Access Easement and Maintenance Agreement between the City and ISD 194 will remain in place for the parking lot fronting Holyoke Avenue that serves both the Alternative Learning Center and the Art Center.
