HomeMy WebLinkAboutItem 07 1 City of Lakeville Planning Department Memorandum To: Planning Commission From: Frank Dempsey, AICP, Associate Planner Date: January 27, 2017 Subject: Packet Material for the February 2, 2017 Planning Commission Meeting Agenda Item: Kenwood Trail Business Park preliminary and final plat BACKGROUND The City of Lakeville has initiated the redevelopment of 6.49 acres of property northeast of Kenwood Trail (CSAH 50), east of Ipava Avenue, west of Icenic Trail and south of the Viking Square townhomes. The proposed plat includes property acquisitions, consolidations, and street construction initiated as part of the Kenwood Trail reconstruction project scheduled for 2017 and 2018. The redevelopment plan will include the construction of a new public street between the Viking Square townhomes and the commercial area adjacent to Kenwood Trail. The preliminary plat includes two lots and seven outlots. The final plat consists of one lot and six outlots. Properties in this area directly impacted by the CSAH 50 improvement project include six commercial properties and five residential properties adjacent to Kenwood Trail. The preliminary and final plat plans have been submitted to the Engineering Division, the Parks and Recreation Department, the Parks, Recreation and Natural Resources Committee, and the Dakota County Plat Commission. The following exhibits are attached for your information: EXHIBITS 2 A. Location and Zoning Map B. Aerial Photo Map C. Preliminary Plat (2 Pages) D. Final Plat PRELIMINARY AND FINAL PLAT a. Comprehensive Plan. The subject property is located in Planning District No. 5, Central Area/Heritage Commons of the 2008 Comprehensive Plan. Planning District No. 5 guides the subject properties for commercial and office/residential transition uses. b. Zoning. The subject properties are zoned C-3, General Commercial District and O-R, Office Residential Transition District. Surrounding Land Uses and Zoning: north – Viking Square (RM-1 District), Lake Marion Elementary School (RS-2 District) and Ames Arena (P/OS District south – Kenwood Trail CSAH 50) east – Icenic Trail and commercial uses (C-3 District) west –Kenwood Trail (CSAH 50) and Ipava Avenue c. Existing Site Conditions. The 6.49 acre area of the preliminary plat includes a mixture of platted and metes and bounds described residential and commercial properties. Some property on the west area of the project was platted in 1909 as part of Antlers Park. The properties also consist of numerous mature trees. Several buildings were removed from the area in September 2016 in preparation for the Kenwood Trail road improvement project. Not all of the commercial uses in the vicinity of the project are included in this preliminary and final plat. Businesses directly or indirectly involved in the project include: • Lakeville Dental office • Dr. Emond office (building removed) • White Funeral Home (parking lot to be impacted) • McDonald Eye Care (building and parking lot to be removed and reconstructed) • Farm Show Magazine (building removed) • Kindernook Pre School (building removed) d. Lots/Blocks/Outlots. The preliminary plat consists of two lots and six outlots. The lots in the preliminary and final plats exceed the 20,000 square foot minimum lot area and 100 foot wide lot width requirements for the C-3 and O-R Districts. The final plat consists of one lot and seven outlots. The lot and outlot count differs between the preliminary plat because Lot 1, Block 2 will be 3 preliminary only at this time and final platted as an outlot. The only final platted lot proposed will be Lot 1, Block 1 which will be the lot proposed for McDonald Eye Care. Lots and outlots will be developed or utilized for the following: Outlot A – Kenwood Trail right-of-way and Lakeville North High School freestanding sign Outlot B – Kenwood Trail (CSAH 50) right of way dedication Outlot C – City owned combination of non-conforming parcels Outlot D – Stormwater management basin Outlot E – Replacement parking for Lakeville Dental Outlot F – Replacement parking for White Funeral Home Outlot G –Commercial lot for future development e. Access/Streets. The preliminary and final plat of Kenwood Trail Business Park abuts Kenwood Trail (CSAH 50), Ipava Avenue, Icenic Trail and includes the construction of a new public street. Kenwood Trail (CSAH 50) – Kenwood Trail is a minor expander roadway as designated in the City’s Transportation Plan. The proposed final plat includes dedication of between 29 and 71 feet of property adjacent to Kenwood Trail to meet the right-of-way requirements for the proposed Kenwood Trail improvements scheduled for construction in 2017 construction. An eight foot wide trail will be constructed adjacent to Kenwood Trail along the length of the proposed improvement project including adjacent to the proposed Kenwood Trail Business Park plat. Ipava Avenue – Ipava Avenue is a major collector street as designated in the City’s Transportation Plan. Sixty feet will of half right-of-way will be dedicated for Ipava Avenue adjacent to the Kenwood Trail Business Park plat. Icenic Trail – Icenic Trail is a minor collector street as designated in the City’s Transportation Plan. A 60 foot right-of-way was platted for Icenic Trail with the Viking Square plat. No additional right-of-way is required for Icenic Trail. Innovation Way – Innovation Way will be a local street to be constructed to provide access to adjacent businesses along Kenwood Trail that will lose direct access to Kenwood Trail as part of the improvement project. Innovation Way will provide access to McDonald Eye Care and White Funeral Home which will have their current accesses to Kenwood Trail removed. Innovation Way will also provide access to the new commercial lot (Lot 1) as shown on the preliminary plat. Innovation Way will be constructed within a 50 foot wide right-of-way with a 24 foot wide street. On-street parking will not be allowed on Innovation Way. This will require City Council approval of a no parking resolution. 4 f. Park Dedication/Trails. Lot 1, Block 1 has previously paid park dedication. Park dedication for outlots proposed for development will be paid at the time the outlots are final platted for development. g. Grading, Drainage, Erosion Control and Utilities. Grading, drainage, erosion control, and utility issues are addressed in the Engineering Division review memo prepared by Matt Decur, Development Engineer and Mac Cafferty, Environmental Resources Manager, dated January 24, 2017. The Engineering Division recommends approval of the Kenwood Trail Business Park preliminary and final plat. h. Wetlands. There are no wetlands located in the Kenwood Trail Business Park preliminary and final plat. i. Tree Preservation/Landscaping. The proposed preliminary and final plat of Kenwood Trail Business Park will include the removal of significant trees for the Kenwood Trail improvement project and Innovation Way construction. Individual site development within future lots will include tree preservation and landscaping at that time. A landscape screening buffer will be installed by the City between Innovation Way and the adjacent Viking Square townhomes following construction of Innovation Way. j. Public Easements. The surveyor identified a platted drainage and utility easement associated with the Viking Square plat on the property previously occupied by Dr. Emond’s office off of Icenic Trail. The City Council will consider the easement vacation simultaneously with their consideration of the preliminary and final plat. k. Signs. All existing signs impacted by the road improvement project will be relocated. Relocated signs will require approval of a sign permit. l. Dakota County Plat Commission. The Plat Commission will review the preliminary and final plat at their February 6, 2017 meeting. The Plat Commission’s comments will be forwarded to the City Council at the time of preliminary and final plat consideration. The Plat Commission’s preliminary review of the plat sketch indicated their support for the proposed right-of-way dedication and access restrictions. RECOMMENDATION Planning Department staff recommends approval of the preliminary and final plat of Kenwood Trail Business Park subject to the following stipulations: 5 1. The property shall be developed in accordance with the recommendations outlined in the engineering report dated January 24, 2017. 2. The site shall be developed according to the preliminary and final plat plans approved by the City Council. The proposed subdivision is located north of and adjacent to Kenwood Trail (CSAH 50), east of and adjacent to Ipava Avenue, and west of and adjacent to Icenic Trail. The parcels consist of Lot 1, Block 2, Viking Square zoned C-3 General Commercial District, and several metes and bounds parcels zoned O-R, Office/Residential Transitional District. The preliminary plat consists of two (2) lots within two (2) blocks and six (6) outlots on 6.49 acres. The final plat consists of one (1) lot within one (1) block and seven (7) outlots on 6.49 acres. One business/residence is located on one of the parent parcels. Trees are scattered throughout the site. Buildings and site improvements on most parent parcels were removed in September 2016 in preparation for City Project No. 14-10. Remaining buildings and improvements on parent parcels will be removed in 2017 as part of City Project No. 14-10. EEAASSEEMMEENNTTSS The parent parcels contain existing public easements. The following public easements shall be vacated following a public hearing by the City Council in consideration with the final plat: • 5-foot and 10-foot wide drainage and utility easements in favor of City of Lakeville per Viking Square final plat SSTTRREEEETT AANNDD SSUUBBDDIIVVIISSIIOONN LLAAYYOOUUTT Kenwood Trail (CSAH 50) Kenwood Trail Business Park is north of and adjacent to Kenwood Trail, a minor expander County highway, as identified in the City’s Transportation Plan. Kenwood Trail adjacent to the site is a three-lane undivided urban roadway. The current Dakota County Plat Review Needs Map designates Kenwood Trail as a four-lane divided urban roadway over its entire length adjacent to the plat with a half right-of-way requirement of 75 feet. The Kenwood Trail Corridor Study identified the need for reduced right-of-way adjacent to the Kenwood Trail Business Park plat in order to minimize effects to adjacent commercial properties and buildings. Reduced right-of-way needs adjacent to the Kenwood Trail Business Park plat were determined to be 102 feet and 108 feet. Twenty-nine to seventy-one feet of right-of-way is being dedicated for Kenwood Trail with the Kenwood Trail Business Park plat to meet these requirements. Kenwood Trail right-of-way will be platted as outlots and deeded to Dakota County. The preliminary and final plat will be reviewed for approval by the Dakota County Plat Commission at its February 6, 2017 meeting. Kenwood Trail will be expanded and reconstructed into a four lane divided highway as part of City Project No. 14-10. Construction adjacent to the Kenwood Trail Business Park development will take place in 2017. Ipava Avenue Kenwood Trail Business Park is located east of and adjacent to Ipava Avenue, a major collector as identified in the City’s Transportation Plan. Ipava Avenue adjacent to the site is a four-lane divided urban roadway. The necessary 60 foot wide half right-of-way is being dedicated with Kenwood Trail Business Park. Traffic signals and intersection improvements at Kenwood Trail and Ipava Avenue will be reconstructed with City Project No. 14-10. Icenic Trail KKEENNWWOOOODD TTRRAAIILL BBUUIISSIINNEESSSS PPAARRKK –– PPRREELLIIMMIINNAARRYY AANNDD FFIINNAALL PPLLAATT JJAANNUUAARRYY 2244,, 22001177 PPAAGGEE 33 OOFF 55 Kenwood Trail Business Park is located west of and adjacent to Icenic Trail, a minor collector roadway. Icenic Trail is constructed as a 46-foot wide urban commercial roadway within 60 feet of existing right-of-way. No right-of-way dedication or roadway improvements are required with Kenwood Trail Business Park. Innovation Way Innovation Way will be a local roadway constructed as part of City Project No. 14-10 to provide access to the adjacent commercial properties. Innovation Way will be constructed as a 24-foot wide urban roadway with an 8’ bituminous trail on the north side. 50 feet of right- of-way is dedicated for Innovation Way with the Kenwood Trail Business Park plat. CCOONNSSTTRRUUCCTTIIOONN AACCCCEESSSS Construction traffic access and egress for City Project No. 14-10 will be off of Kenwood Trail (CSAH 50). PPAARRKKSS,, TTRRAAIILLSS AANNDD SSIIDDEEWWAALLKKSS City Project No. 14-10 includes reconstruction of the existing bituminous trail on the south side of Kenwood Trail (CSAH 50) from 185th Street (CSAH 60) to Dodd Boulevard (CSAH 9). City Project No. 14-10 also includes construction of a new bituminous trail on the north side of Kenwood Trail from 185th Street to Innovation Way, and on the north side of Innovation Way from Kenwood Trail to Icenic Trail. The Park Dedication Fee for Lot 1, Block 1 has been collected, and therefore will not be due with the final plat. Park Dedication Fees will be collected when outlots are platted into lots and blocks. UUTTIILLIITTIIEESS SSAANNIITTAARRYY SSEEWWEERR Kenwood Trail Business Park is located within subdistrict ML-70000 of the Marion Lake sanitary sewer district, as identified in the City’s Comprehensive Sewer Plan. Wastewater will be conveyed to the MCES Farmington Interceptor and continue to the Empire Wastewater Facility. Development of Kenwood Trail Business Park does not include the extension of public sanitary sewer. Several individual sanitary sewer services within Kenwood Trail and Icenic Trail provide sewer service to the parent parcels. Services will be added or removed as necessary as part of City Project No. 14-10. The Sanitary Sewer Availability Charge has been collected on the parent parcels. Several individual water services within Kenwood Trail and Icenic Trail provide water service to the parent parcels. Services will be added or removed as necessary as part of City Project No. 14-10. DDRRAAIINNAAGGEE AANNDD GGRRAADDIINNGG Kenwood Trail Business Park is located within subdistrict SC-52 and SC-56 of the South Creek stormwater district as identified in the City’s Water Resources Management Plan. The Water Resources Management Plan does not indicate any trunk storm sewer or regional stormwater facilities within the Kenwood Trail Business Park plat. City Project No. 14-10 will include construction of a stormwater management basin and BMP within Outlots C and D, respectively. Private stormwater management measures will be constructed with the development of Lot 1 and in the future when Outlot G develops. SSTTOORRMM SSEEWWEERR Development of Kenwood Trail Business Park does not include the construction of public storm sewer. Storm sewer will be constructed in Kenwood Trail and Innovation Way with City Project No. 14-10. The Trunk Storm Sewer Area Charge for Lot 1, Block 1 has been collected, and therefore will not be due with the final plat. The Trunk Storm Sewer Area Charge will be collected when outlots in Kenwood Trail Business Park are platted into lots and blocks. FEMA FLOODPLAIN ANALYSIS Kenwood Trail Business Park is shown on the Flood Insurance Rate Map (FIRM) as Zone X by the Federal Emergency Management Agency (FEMA). Based on this designation, there are no areas in the plat located within a Special Flood Hazard Area (SFHA), as determined by FEMA. WWEETTLLAANNDDSS There are no wetlands within the Kenwood Trail Business Park plat. TTRREEEE PPRREESSEERRVVAATTIIOONN No trees will be removed as part of the Kenwood Trail Business Park plat. Construction of Innovation Way will be completed with City Project 14-10 and will require the removal of trees, however, a visual buffer will be provided for the residential area north of and adjacent to the plat. Tree Preservation Plans will be required at the time each lot or outlot in Kenwood Trail Business Park is developed or platted into lots and blocks.
