Re: CHOKECHERRY HILL 6TH ADDITION
The Dakota County Plat Commission met on November 14, 2016, to consider the preliminary plat of the
above referenced plat. The plat is adjacent to County State Aid Highway (CSAH) 50, and is therefore subject
to the Dakota County Contiguous Plat Ordinance.
The plat includes three residential lots from Outlot C, CHOKECHERRY HILL 2ND ADDITION and a remnant
parcel from the recent County Road project along CSAH 9. Restricted access should be shown along all of
CSAH 9. A quit claim deed for restricted access to Dakota County is required at the time of recording the plat
mylars.
The Plat Commission has approved the preliminary and final plat and will recommend approval to the County
Board of Commissioners.
Traffic volumes on CSAH 50 are 9,600 ADT and are anticipated to be 15,000 ADT by the year 2030. These
traffic volumes indicate that current Minnesota noise standards for residential units could be exceeded for
the proposed plat. Residential developments along County highways commonly result in noise complaints.
In order for noise levels from the highway to meet acceptable levels for adjacent residential units, substantial
building setbacks, buffer areas, and other noise mitigation elements should be incorporated into this
development.
No work shall commence in the County right of way until a permit is obtained from the County
Transportation Department and no permit will be issued until the plat has been filed with the County
Recorder’s Office. The Plat Commission does not review or approve the actual engineering design of
proposed accesses or other improvements to be made in the right of way. Nothing herein is intended to
restrict or limit Dakota County’s rights with regards to Dakota County rights of way or property. The Plat
Commission highly recommends early contact with the Transportation Department to discuss the permitting
process which reviews the design and may require construction of highway improvements, including, but not
limited to, turn lanes, drainage features, limitations on intersecting street widths, medians, etc. Please

Shamrock Development, Inc. has submitted a preliminary and final plat named Chokecherry
Hill 6th Addition. The proposed subdivision is located east of and adjacent to Dodd Boulevard
(CSAH 9), west of and adjacent to Iden Way, and north of 190th Street. The parcel parcels
consist of one metes and bounds parcel (PID No. 220170056014) and Outlot C, Chokecherry
Hill 2nd Addition zoned RS-3, Single Family Residential.
The preliminary and final plat consists of three (3) single family lots, within one (1) block on
1.04 acres.

The Chokecherry Hill 6th Addition site is undeveloped vacant land. Two trees are located on
the site.
Buildings and site improvements on the parent parcels were removed in June, 2016 with City
Project No. 13-09. The city has received verification that the septic system was properly
abandoned but does not have a record that the well has been abandoned. The Developer
shall certify that the well was abandoned with the removals. A $2,000.00 security is required
with the final plat to certify that the removal was completed per all applicable codes and
regulations.

The parent parcels contain existing public easements. The following public easements shall
be vacated with the final plat:
• 10-foot wide drainage and utility easement in favor of City of Lakeville per
Chokecherry Hill 2nd Addition final plat.
• 30-foot wide drainage and utility easement in favor of City of Lakeville per
Chokecherry Hill 2nd Addition final plat.
• 30-foot wide drainage and utility easement in favor of City of Lakeville per
Chokecherry Hill 2nd Addition final plat.

Dodd Boulevard
Chokecherry Hill 6th Addition is located east of and adjacent to Dodd Boulevard, a minor
arterial County roadway as identified in the City’s Transportation Plan. Dodd Boulevard
adjacent to the site was reconstructed in 2016 with City Project No 13-09 to a four-lane
divided urban roadway with 10-foot wide bituminous trails along both sides of the road. No
right-of-way dedication is required with the final plat for Dodd Boulevard. The preliminary
and final plats were reviewed and recommended for approval by the Dakota County Plat
Commission at their November 14, 2016 meeting.
The cash fee for the future upgrade of Dodd Boulevard has not been collected on the parent
parcels, and will not be required with the final plat as Dodd Boulevard is constructed to its
ultimate design.
Iden Way
Chokecherry Hill 6th Addition is located west of and adjacent to Iden Way, a local roadway.
Iden Way was constructed with the Chokecherry Hill 2nd Addition improvements as a 32-foot
wide roadway with a sidewalk along the west side of the street. No roadway improvements
are required with Chokecherry Hill 6th Addition.

Construction traffic access and egress for grading shall be from a single rock construction
entrance off of Iden Way. The Developer shall post a $10,000 security with the final plat to
ensure that the Iden Way roadway and sidewalk is not damaged during the site grading and
development improvements.

The Park Dedication requirement has not been collected on the parent parcels and will be
satisfied through a cash contribution that shall be paid with the final plat. The Park Dedication
Fee will be based on the rate in effect at the time of final plat approval, calculated as follows:

Chokecherry Hill 6th Addition is located within subdistrict ML-70190 of the Marion Lake
sanitary sewer district, as identified in the City’s Comprehensive Sewer Plan. Wastewater will
be conveyed to the MCES Farmington Interceptor and continue to the Empire Wastewater
Facility.
Development of Chokecherry Hill 6th Addition does not include the extension of public
sanitary sewer. Three individual sanitary sewer services were installed with the Chokecherry
Hill 2nd Addition improvements to provide sewer service to the parent parcels. The utilities
installed with Chokecherry Hill 2nd Addition have been accepted by the City and approved for
service connection.
The Sanitary Sewer Availability Charge has not been collected on the parent parcels and shall
be paid with the final plat. The fee will be based on the current rate in effect at the time of
final plat approval, calculated as follows:
3 units x $327.00 = $981.00

Chokecherry Hill 6th Addition is located within subdistrict SC-68 of the South Creek
stormwater district as identified in the City’s Water Resources Management Plan.
Development of Chokecherry Hill 6th Addition does not include the construction of public
stormwater management basins. Stormwater runoff generated from the development will be
conveyed via existing storm sewer to the stormwater management basin located in Outlot B,
Chokecherry Hill 2nd Addition. The basin was designed and constructed to provide water
quality treatment and rate control from the runoff generated from the parent parcels in the
developed condition.
The final grading plan shall identify all fill lots in which the building footings will be placed on
fill material. The grading specifications shall also indicate that all embankments meet
FHA/HUD 79G specifications. The Developer shall certify to the City that all lots with footings
placed on fill material are appropriately constructed. Building permits will not be issued until
a soils report and an as-built certified grading plan have been submitted and approved by
City staff.
Chokecherry Hill 6th Addition contains more than one acre of site disturbance. A National
Pollution Discharge Elimination System General Stormwater Permit for construction activity is
required from the Minnesota Pollution Control Agency for areas exceeding one acre being
disturbed by grading. A copy of the Notice of Stormwater Permit Coverage must be
submitted to the City upon receipt from the MPCA.

Development of Chokecherry Hill 6th Addition does not include the construction of public
storm sewer.
Draintile construction is required in areas of non-granular soils within Chokecherry Hill 6th
Addition for lots. Any additional draintile construction, including perimeter draintile required
for building footings, which is deemed necessary during construction shall be the Developer’s
responsibility to install and finance.
The Storm Sewer Area Charge has not been collected on the parent parcels, and must be paid
in cash with the final plat. The Storm Sewer Area Charge is calculated as follows:

Dodd Boulevard is a minor arterial County roadway, as identified in the City’s Transportation
Plan. A buffer yard containing earth berms and/or plantings of a sufficient density to provide
a visual screen and a reasonable buffer a minimum of ten feet in height shall be provided

adjacent to Dodd Boulevard. A certified as-built grading plan of the buffer yard berm must be
submitted and approved by City staff prior to the installation of any buffer yard plantings.
FEMA FLOODPLAIN ANALYSIS
Chokecherry Hill 6th Addition is shown on the Flood Insurance Rate Map (FIRM) as Zone X by
the Federal Emergency Management Agency (FEMA). Based on this designation, there are no
areas in the plat located within a Special Flood Hazard Area (SFHA), as determined by FEMA.
WWEETTLLAANNDDSS
The wetland delineation for the project area was completed by Arrowhead Environmental
Consulting. No wetlands were identified within the project boundary in wetland delineation
report dated October 22, 2013.
TTRREEEE PPRREESSEERRVVAATTIIOONN
The tree preservation plan identifies eight trees. The plan proposes to remove six trees. The
remaining two trees will be incorporated into the buffer yard landscape plan.
EERROOSSIIOONN CCOONNTTRROOLL
The Developer is responsible for obtaining a MPCA Construction Permit for the site as well as
developing a SWPPP for the site prior to construction. The permit requires that all erosion and
sediment BMPS be clearly outlined in a site’s SWPPP. Changes made throughout construction
should be documented in the SWPPP.
The erosion control plan was reviewed and includes the following:
• All 3:1 slopes and swales will be seeded and stabilized with fiber blanket.
• Bio-rolls will be installed within the swale.
• Silt fence will be installed to protect offsite areas from sediment transport.
• Streets must be cleared of debris at the end of each day.
Additional erosion control measures may be required during construction as deemed
necessary by City staff or the Dakota County Soil and Water District. Any additional measures
required shall be installed and maintained by the developer.
SECURITIES
The Developer shall provide a Letter of Credit as security for the Developer-installed
improvements relating to Chokecherry Hill 6th Addition.

The Developer shall post a security to ensure the final placement of iron monuments at
property corners with the final plat. The security is $100.00 per lot and outlot for a total of
$300.00. The City shall hold this security until the Developer’s Land Surveyor certifies that all
irons have been placed following site grading, street and utility construction.

A cash fee for one-year of streetlight operating expenses shall be paid at the time of final plat
approval and is calculated as follows:

Engineering Administration will be based on three percent (3.00%) of the estimated
construction cost, or $300.00.
