AWARD CONTRACT TO FITZGERALD EXCAVATING & TRUCKING
FOR 205TH STREET CHANNEL STABILIZATION IMPROVEMENTS
Proposed Action
Staff recommends adoption of the following motion: Move to award contract to Fitzgerald
Excavating & Trucking Incorporated for 205th Street Channel Stabilization Improvements.
Overview
On December 19, 2016, the Lakeville City Council approved plans and specifications for City
Project 16-15.
On Tuesday, January 10, 2017 at 10:00 a.m. the City received five bids for City Project 16-15.
The bids ranged from a low bid of $197,860 submitted by Fitzgerald Excavating & Trucking
Incorporated to a high bid of $276,665. The Engineer’s Estimate of the construction cost was
$227,690. City, Vermillion River Watershed Joint Powers Organization and Wenck Associates
staff reviewed the bids and recommend approval.
Primary Issues to Consider
• The City’s funding source is the Utility Fund – Environmental Resources. The
Vermillion River Watershed Joint Powers Organization will reimburse the City up to
$100,000 for construction costs.
• Construction is anticipated to begin in February, 2017 and be completed by August, 2017.

RESOLUTION AWARDING CONTRACT FOR
205TH STREET CHANNEL STABILIZATION IMPROVEMENTS
WHEREAS, the City of Lakeville received sealed bids on Tuesday, January 10, 2017 at 10:00 a.m.
for 205th Street Channel Stabilization Improvements, City Project 16-15; and
WHEREAS, the lowest responsible bid was from Fitzgerald Excavating & Trucking
Incorporated.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Lakeville,
Minnesota:
Hereby awards the contract to the lowest responsible bidder that meets all the bid requirements,
Fitzgerald Excavating & Trucking Incorporated, with a bid in the amount of $197,860. The
construction is proposed to be completed as specified in the contract documents.
ADOPTED by the Lakeville City Council this 6th day of February, 2017.

RE: 205th Street Channel Reconstruction Project

Dear Mr. Cafferty:
I reviewed the five bids received for this project following the bid opening on Tuesday, January
10, 2016, at 10:00AM, at the City of Lakeville City Hall. The low bidder is Fitzgerald Excavating
& Trucking Inc. at $197,860.00. The Engineer’s estimate for this project is $227,690.00.
There are no math errors in the bid, and the unit prices are within an acceptable range.
Wenck does not have experience working with Fitzgerald Excavating & Trucking Inc. so we
checked with one of the listed references that we work directly with, the City of Woodbury
engineer. The City of Woodbury has worked with the contractor and continues to work with
them on pond maintenance/clean out projects. The City of Woodbury did not express concern
about the Contractor’s ability to complete the work as we described and commented that they
know the Contractor does work on streams for the MN DNR. The contractor did list MN DNR
contacts and projects as three additional references. Based on the feedback, Wenck does not
have any reason to believe Contractor is not capable of completing this project as designed and
specified. We recommend that the City of Lakeville award Fitzgerald Excavating & Trucking Inc.
the 205th Street Channel Reconstruction Project, City Project No. 16-15.

AGREEMENT
THIS AGREEMENT, made this 6th day of February, 2017 by and between the City of Lakeville, hereinafter
called “Owner” and [ ], doing business as a Minnesota corporation, hereinafter called “Contractor.”
WITNESSETH: That for and in consideration of the payments and agreements hereinafter mentioned:
1. The Contractor will commence and complete the construction of: 205th Street Channel Restoration
Project, City of Lakeville Improvement Project No. 16-15.
2. The Contractor will furnish all of the material, supplies, tools, equipment, labor and other services
necessary for the construction and completion of the project described herein.
3. The Contractor will complete the work required by the Contract Documents within the specified
completion dates unless the period for completion is extended by the Contract Documents.
4. The Contractor agrees to perform all of the work described in the Contract Documents for the sum of

7. This Agreement shall be binding upon all parties hereto and their respective heirs, executors,
administrators, successors and assigns.
IN WITNESS WHEREOF, the parties hereto have executed, or caused to be executed by their duly authorized
officials, this Agreement in duplicate, each of which shall be deemed an original on the date first above written.
