The Kenwood Trail Business Park preliminary plat includes two lots and seven outlots. The final plat consists of one lot and six outlots. Kenwood Trail Business Park includes the construction of Icenic Way, a new public street that will provide access for businesses along Kenwood Trail that will lose their driveway access upon construction of the road improvements. A public drainage and utility easement was identified on the property that was most recently occupied by Dr. Emond’s office north of Kenwood Trail and west of Icenic Trail. The purpose of the public hearing is to vacate the drainage and utility easement in conjunction with approval of the Kenwood Trail Business Park preliminary and final plat. EXHIBITS A. Aerial Photo Map B. Easement to be vacated on Lot 1, Block 2, Viking Square 2 PLANNING ANALYSIS The Viking Square final plat was approved in 1980 and included the standard boundary drainage and utility easement required for platted lots at that time. By vacating the drainage and utility easement, it will ensure clear title for the property, portions of which will be platted as road right-of-way, a stormwater management basin outlot, and an outlot that is planned to be conveyed to the Lakeville Dental property to the south. A new 10 foot wide drainage and utility easement will be platted over Outlot D and temporary drainage and utility easements will be established over Outlots E, F and G to remain in place until those outlots are platted. All utility companies with a potential interest in the vacation of the easement were notified. No objections to the vacation have been received. RECOMMENDATION Planning Department staff recommends approval of the drainage and utility easement vacation as presented subject to the following stipulation: 1. The easement vacation shall be subject to approval of the Kenwood Trail Business Park preliminary and final plat. Dakota County Surveyor’s Office Western Service Center 14955 Galaxie Avenue Apple Valley, MN 55124 952.891 -7087 Fax 952.891 -7127 www.co.dakota.mn.us February 7, 2017 City of Lakeville 20195 Holyoke Ave. Lakeville, MN 55044 Re: KENWOOD TRAIL BUSINESS PARK The Dakota County Plat Commission met on February 6, 2017, to consider the preliminary and final plat of the above referenced plat. The plat is adjacent to County State Aid Highway (CSAH) 50, and is therefore subject to the Dakota County Contiguous Plat Ordinance. The plat was revised and includes a redevelopment project along the proposed 50-19 highway project County & City). The right-of-way needs are 75 feet of half right of way for a 4-lane divided roadway along CSAH 50. The right-of-way along CSAH 50 is shown as Outlots to be deeded to the County. Restricted access is shown along all of CSAH 50 except for access openings at Ipava Avenue and Innovation Way. A quit claim deed to Dakota County for restricted access is required with the recording of the plat mylars. The Plat Commission has approved the preliminary and final plat and will recommend approval to the County Board of Commissioners. Traffic volumes on CSAH 50 are 13,800 ADT and are anticipated to be 19,000 ADT by the year 2030. These traffic volumes indicate that current Minnesota noise standards for residential units could be exceeded for the proposed plat. Residential developments along County highways commonly result in noise complaints. In order for noise levels from the highway to meet acceptable levels for adjacent residential units, substantial building setbacks, buffer areas, and other noise mitigation elements should be incorporated into this development. No work shall commence in the County right of way until a permit is obtained from the County Transportation Department and no permit will be issued until the plat has been filed with the County Recorder’s Office. The Plat Commission does not review or approve the actual engineering design of proposed accesses or other improvements to be made in the right of way. Nothing herein is intended to restrict or limit Dakota County’s rights with regards to Dakota County rights of way or property. The Plat Commission highly recommends early contact with the Transportation Department to discuss the permitting process which reviews the design and may require construction of highway improvements, including, but not limited to, turn lanes, drainage features, limitations on intersecting street widths, medians, etc. Please contact Gordon McConnell regarding permitting questions at (952) 891-7115 or Todd Tollefson regarding Plat Commission or Plat Ordinance questions at (952) 891-7070. Sincerely, Todd B. Tollefson Secretary, Plat Commission c: 1 City of Lakeville Planning Department Memorandum To: Planning Commission From: Frank Dempsey, AICP, Associate Planner Date: January 27, 2017 Subject: Packet Material for the February 2, 2017 Planning Commission Meeting Agenda Item: Kenwood Trail Business Park preliminary and final plat BACKGROUND The City of Lakeville has initiated the redevelopment of 6.49 acres of property northeast of Kenwood Trail (CSAH 50), east of Ipava Avenue, west of Icenic Trail and south of the Viking Square townhomes. Kenwood Trail (CSAH 50) – Kenwood Trail is a minor expander roadway as designated in the City’s Transportation Plan. The proposed final plat includes dedication of between 29 and 71 feet of property adjacent to Kenwood Trail to meet the right-of-way requirements for the proposed Kenwood Trail improvements scheduled for construction in 2017 construction. An eight foot wide trail will be constructed adjacent to Kenwood Trail along the length of the proposed improvement project including adjacent to the proposed Kenwood Trail Business Park plat. Kenwood Trail adjacent to the site is a three-lane undivided urban roadway. The current Dakota County Plat Review Needs Map designates Kenwood Trail as a four-lane divided urban roadway over its entire length adjacent to the plat with a half right-of-way requirement of 75 feet. The Kenwood Trail Corridor Study identified the need for reduced right-of-way adjacent to the Kenwood Trail Business Park plat in order to minimize effects to adjacent commercial properties and buildings. Reduced right-of-way needs adjacent to the Kenwood Trail Business Park plat were determined to be 102 feet and 108 feet. Twenty-nine to seventy-one feet of right-of-way is being dedicated for Kenwood Trail with the Kenwood Trail Business Park plat to meet these requirements. Kenwood Trail right-of-way will be platted as outlots and deeded to Dakota County. The preliminary and final plat will be reviewed for approval by the Dakota County Plat Commission at its February 6, 2017 meeting. Kenwood Trail will be expanded and reconstructed into a four lane divided highway as part of City Project No. 14-10. Construction adjacent to the Kenwood Trail Business Park development will take place in 2017.
