HERITAGE COMMONS 5TH ADDITION
FINAL PLAT EXTENSION
Proposed Action
Staff recommends adoption of the following motion: Move to approve a 100 day extension for
the Heritage Commons 5th Addition final plat.
Overview
Due to the pending expiration of the Heritage Commons 5th Addition final plat, the
applicant requests a 100 day extension to the final plat the City Council approved on
December 19, 2016 as allowed by the Subdivision Ordinance. The Heritage Commons 5th
Addition final plat consists of three outlots and requires recording the final plat by March
29, 2017 or the final plat will expire unless it is extended by the City Council. The
developer expects to have the documents submitted in the next few days but is requesting
additional time to complete the required documentation. The 100 day extension will give
the developer until July 7, 2017 to record the final plat.

Hi Frank –
I think we will have everything to you by the middle of next week so that this could be on the
agenda for the March 20 meeting. However, out of an abundance of caution, I think it makes sense
to extend the 100 day period. Please let this email serve as our request to extend the period an
additional 100 days.

Hi Brian,
I should have mentioned to you when we spoke about the pending 100 day expiration for the
developer to record the final plat mylars with Dakota County. The expiration date is March 29 th
which means I will have to place it on the March 20 th City Council agenda. If your client agrees, I
can accept an email request from you to extend an additional 100 days. I would prefer the full
100 day interval, if you agree.
