LAKEVILLE CHRISTIAN CHURCH ENCROACHMENT AGREEMENT
Proposed Action
Staff recommends adoption of the following motion: Move to approve an encroachment
agreement with Lakeville Christian Church for construction and maintenance of a parking lot
and private stormwater basin (rain garden) on a public drainage and utility easement.
Overview
Lakeville Christian Church received approval from the City Council on February 21, 2017 for
the conversion of a single family home to a church use at 16701 Joplin Way. The site plan
includes the construction of a parking lot and stormwater basin within a large public drainage
and utility easement located in the rear yard of the lot. The encroachment agreement is a
requirement of the approved conditional use permit.
The signed encroachment agreement is attached.
Primary Issues to Consider
What happens if the City needs to utilize or otherwise access the public drainage and utility
easement? The agreement stipulates that the City has the right to terminate the encroachment
agreement if it is reasonably necessary for the City to use the easement for drainage and utility
purposes and/or the parking lot and/or rain garden is inconsistent with the City’s use of the
easement.
