CELEBRATION CHURCH PUD AMENDMENT
Proposed Action
Staff recommends adoption of the following motion: Move to approve the Celebration Church
PUD amendment and Site Improvement Performance Agreement (SIPA).
Overview
Celebration Church representatives have submitted an application for a planned unit
development (PUD) amendment to allow the construction of a two level, 18,443 square foot
addition on the south side of the existing church building located at 16655 Kenyon Avenue. The
proposed addition will include space for classrooms, a banquet hall, and relocated space for the
day care/pre-school currently located in the existing building.
The Planning Commission held a public hearing at its March 2, 2017 meeting. The Planning
Commission recommended unanimous approval of the PUD Amendment subject to nine
stipulations. There was no public comment at the public hearing.
Primary Issue to Consider
How does the Site Improvement Performance Agreement (SIPA) language differ from the
stipulations recommended by the Planning Commission? Representatives of Celebration Church
recommended some minor changes to Stipulations 4 and 9, which are reflected in the SIPA, to
clarify all proposed building improvements as shown on the plans as well as clarification as to how
on-site parking will be managed while reserving the City’s right to require additional on-site
parking if there is a demonstrated need.

March 2, 2017
Chair Swenson called the meeting to order at 6:00 p.m. in the Council Chambers at City
Hall. The pledge of allegiance to the flag was given.

3. Approval of the Meeting Minutes

tonight’s meeting:

5. Celebration Church
Chair Swenson opened the public hearing to consider the application of Celebration
Church for an amendment to the Celebration Church Planned Unit Development
(PUD) to allow an addition onto the south side of the existing church building,
located at 16655 Kenyon Avenue.

Pastor Derrick Ross from Celebration Church presented an overview of the project.
He indicated that he is continuing the building plan Lowell Lundstrom started over
ten years ago.
Associate Planner Frank Dempsey presented the planning report. Mr. Dempsey
stated that Celebration Church representatives have submitted an application for a
PUD amendment to allow the construction of a two level addition on the south side
of the existing church building. The proposed addition will include first floor space
for classrooms, relocated space for the day care/pre-school that is now located in
the existing building, and a banquet hall and stage on the upper level with seating for
450 people. Mr. Dempsey indicated that the proposed building addition requires an
amendment to the Celebration Church PUD approved in 2001 when the main
assembly hall and parking lot was constructed.
Mr. Dempsey stated that the proposed building addition will be attached to the
existing building with a 20 foot wide outdoor walkway. An indoor hallway connection
will provide interior access to the new addition.
The majority of the subject property lies within the Shoreland Overlay District of Lee
Lake. Mr. Dempsey explained that the Celebration Church Second Addition PUD
allowed up to 42% impervious surface. The new construction will increase the
impervious surface area to approximately 36%.
Mr. Dempsey reviewed building setbacks, elevations, exterior building materials, and
building height, which all meet the requirements of the Zoning Ordinance. The
parking lot reconstruction will include the removal of 12 parking spaces, which still
leaves the church with enough parking spaces to meet the minimum requirement of
434 parking spaces.
If both the banquet and the church area were being used at the same time, 100
more parking spaces would be required. With that in mind, staff is recommending
that banquet hall events and religious assembly in the main sanctuary hall not be
held at the same time.
A new private sidewalk will be constructed adjacent to the parking lot on the south
side of the building addition and near the new loading area and playground. All
landscaping materials meet the size and species requirements of the Zoning
Ordinance.
Mr. Dempsey stated that an accessory building is proposed along the wall of the
existing church building. A small accessory building currently located on the west
side of the parking lot will be removed.
A roof top mechanical screening plan has been prepared to address the screening of
the equipment from Kenyon Avenue. Mr. Dempsey indicated that a 42 inch tall
parapet wall will be extended above the roof line as an architectural means of
addressing the screening requirement of the Zoning Ordinance.

Mr. Dempsey stated that staff recommends approval of the PUD amendment subject
to the 9 stipulations listed in the February 24, 2017 planning report.
Chair Swenson opened the hearing to the public for comment.
There were no comments from the audience.
Motion was made by Drotning, seconded by Lillehei to close the public
hearing at 6:10 p.m.
Voice vote was taken on the motion. Ayes – unanimous
Chair Swenson asked for comments from the Planning Commission. Discussion
points included:
• Chair Swenson confirmed that a building permit is required prior to
constructing the proposed accessory building to be sure that the exterior
building materials match the exterior of the church.
• Referring to Stipulation 4, Commissioner Lillehei stated that as long as the
church has enough parking he would not be opposed to concurrent events in
the banquet/assembly hall and main sanctuary. Mr. Dempsey indicated that
the stipulation is being recommended by staff to insure that the church does
not utilize on-street parking to meet their parking demand.
• After a brief discussion, the Planning Commission agreed that the following
changes be made to Stipulations 4 and 9 of the February 24, 2017 planning
report:
4. Events or other assembly in the banquet/assembly hall shall not be
scheduled during times when religious assembly or other events
are being held in the main sanctuary hall in order to ensure
adequate off-street parking.
9. The Minnesota Department of Health child care license shall be
approved by the State of Minnesota prior to occupancy of the
building addition for the day care use.
Pastor Derrick Ross confirmed that he could still use the proposed additional
classrooms for other uses, just not day care until they acquired the day care license.
Motion was made by Drotning, seconded by Lillehei to recommend to City
Council approval of the Celebration Church Planned Unit Development amendment
to allow an addition onto the south side of the existing church building, located at
16655 Kenyon Avenue, subject to the following stipulations, as amended:
1. The recommendations listed in the February 22, 2017 engineering report.
2. The site and building addition shall be developed in accordance with the plans
approved by the City Council.
3. The head-to-head parking stalls in the parking lot west of the building shall be
restriped to meet the minimum stall depth requirement of 20 feet.

4. Events or other assembly in the banquet/assembly hall shall not be scheduled
during times when religious assembly or other events are being held in the main
sanctuary hall in order to ensure adequate off-street parking.
5. Landscaping shall be installed consistent with the approved landscape plan. A
$10,000 security shall be submitted with the building permit application to
guarantee installation of the approved landscaping and parking lot restriping.
6. The existing accessory building shall be removed from the property.
7. A building permit is required prior to commencing construction of the addition and
accessory building. Construction of the addition and accessory building is
subject to the approval of the Building Official and Fire Marshal.
8. A sign permit is required prior to the installation or modifications of any signs.
9. The Minnesota Department of Health child care license shall be approved by the
State of Minnesota prior to occupancy of the building addition for the day care
use.

6. Caribou Coffee & Einstein Bros. Bagels
Chair Swenson opened the public hearing to consider the application of United
Properties Development, LLC for the following, located east of Kenwood Trail
(CSAH 50) and south of 175th Street: A. Conditional Use Permit to allow the
construction of Caribou Coffee & Einstein Bros. Bagels with a drive-through service
window; and B. Amendment to the Hoppe Marketplace PUD to allow a reduction in
the required number of parking spaces and a reduction in the required amount of
green space for a convenience restaurant use.
Keith Ulstad from United Properties presented an overview of their request. Mr.
Ulstad stated that they bought the Hoppe property adjacent to Argonne Village 12
years ago. It’s taken a few years longer to fully develop Hoppe Marketplace due to
the recession. He indicated that representatives from Westwood Engineering,
Reprise Architects and Caribou Coffee were in the audience to answer any
questions.
Associate Planner Kris Jenson presented the planning report. Ms. Jenson stated
that the request is for a CUP to allow the construction of a convenience restaurant
on Lot 2, Block 1, Hoppe Marketplace 3rd Addition, along with an amendment to the
Hoppe Marketplace PUD to allow a reduction in the required number of parking
spaces and a reduction in the required amount of green space for a convenience
restaurant on the subject property.
Ms. Jenson indicated that the applicant is proposing a Caribou Coffee & Einstein
Bros. Bagels restaurant with a drive-through. The proposed restaurant will have 41
seats indoors with an additional 20 seasonal seats on the patio. The applicant is
proposing hours of operation of 5:00 a.m. to 9:00 p.m.

INTRODUCTION
Celebration Church representatives have submitted an application for a planned unit
development (PUD) amendment to allow the construction of a two level, 18,443 square foot
addition on the south side of the existing church building located at 16655 Kenyon Avenue.
The proposed addition will include space for classrooms, a banquet hall, and relocated
space for the existing day care/pre-school now located in the existing building. The day
care use was approved by conditional use permit in 2006.
The subject property is zoned PUD, Planned Unit Development subject to the C-3, General
Commercial District uses and performance standards. Section 11-73-7.Q of the Zoning
Ordinance allows religious institution uses in the C-3 District. Section 11-73-7.H. allows day
care facilities in the C-3 District. The proposed building addition requires an amendment to
the Celebration Church PUD approved in 2001 at the time the main assembly hall and
parking lot was constructed.

SITE ANALYSIS
The proposed building addition will be attached to the southwest corner of the existing
building with a 20 foot wide outdoor walkway between the existing building and
proposed addition. An indoor hallway connection will provide interior access to the new
addition. The project includes 9,268 square feet of classroom space and infant to
kindergarten day care. The upper level will be a 9,175 square foot banquet hall and stage
with seating for 450 persons. Two separate outdoor play areas are proposed on the west
side of the church building.
The existing Celebration Church is approximately 50,000 square feet in area and includes
office space and a sanctuary with 700 to 1,086 seats. The conditional use permit approved
in 2006 allowed day care for up to 80 children. Additional license capacity may be added
provided that on-site parking is shown to be adequate and subject to approval of a PUD
Amendment.
Surrounding Land Uses and Zoning
North – Former Jackson Landscape property (PUD)
South – Schneiderman’s Furniture store under construction (C-3)
East – Kenyon Avenue and Interstate 35
West – Single family homes (RS-3)
The proposed building addition was reviewed for conformance with Zoning Ordinance
performance standards as follows:
Shoreland Overlay District. The majority of the property lies within the Shoreland
Overlay District of Lee Lake. The Celebration Second Addition planned unit development
approved in 2001 allowed up to 42% of the property within the Shoreland Overlay District
to be impervious surface. The parking lot was constructed with a slightly different
configuration and fewer parking spaces and less impervious surface area than the original
approved site plan resulting in an impervious surface area of 34.1%. The new construction
will increase the impervious surface area to approximately 36%, which is below the 42%
impervious surface area approved in 2001.
Building Setbacks. The existing building meets the setback requirements of the C-3,
General Commercial District as follows:
Front Yard – 30 feet
Side Yards – 20 feet
Rear Yards – 30 feet
The proposed building addition will have the following setbacks:

Front Yard (Kenyon Avenue) – 300 feet
Side Yard (south) –240 feet
Rear Yard (west) – 280 feet
Building Elevations and Exterior Building Materials. The building addition will be
constructed of similar integral colored tan concrete block to that of the existing church
building that was constructed in compliance with Zoning Ordinance requirements in 2002.
Section 11-17-9.F.10.g of the Zoning Ordinance allows building additions less than 50% of
the floor area of the existing building to use the same or similar materials as the existing
building.
The south wall of the new addition will equal approximately 15.5% of the exterior wall area
of the entire church building. Using the same exterior building materials as the existing
church for the proposed addition is in harmony with the existing church building and
other commercial structures in the area.
Building Height. The building addition height is 32 feet, measured as the mean height
between the highest and lowest walls. The maximum allowed height in the C-3 District is
three stories or 35 feet.
Floor Plan. The floor plan for the building addition includes day care/classrooms on the
lower level and a 450 seat banquet/assembly hall on the upper level.
Access and Circulation. The property access from and to Kenyon Avenue will remain
unaffected by the proposed building addition and use. The site is accessed via two
driveways to and from Kenyon Avenue.
Parking. The proposed site work will include demolishing and reconstructing part of the
parking area on the south and west sides of the building to provide loading/unloading
area near the entrance door on the south side of the building. The parking lot
reconstruction will include the removal of 12 parking spaces. The church’s 1,086 seat main
assembly hall approved in 2006 requires 434 parking spaces at a ratio of one space for
each 2.5 seats in the main assembly area. The existing parking lot provides 512 parking
spaces which exceeds the minimum required number of parking spaces.
A review of the site plan identified a non-conforming stall space design in the middle row
head-to-head parking spaces in the south parking lot. The existing stalls are 18 feet deep.
A minimum stall depth of 20 feet is required by the Zoning Ordinance. Both of the two
adjacent drive aisles are approximately three feet wider than required by the Zoning
Ordinance, leaving adequate space to re-stripe the middle spaces to comply with the
minimum stall depth requirements.
Staff recommends that events or other assembly in the banquet/assembly hall not be
scheduled during times when religious assembly or other events are held in the main
sanctuary in order to ensure adequate off-street parking.
Sidewalks. An eight foot wide concrete public sidewalk is located on the west side of
Kenyon Avenue. A private sidewalk is located along the east side of the building and from
the west office exit to the west parking lot. New private sidewalk will be constructed
adjacent to the parking lot on the south side of the building addition and near the new
loading area and playground.

Landscaping. A mix of deciduous and evergreen trees and shrubs are proposed along the
foundation of the building addition and the south building entrance. All materials meet
the size and species requirements of the Zoning Ordinance.
Accessory Building. A 720 square foot accessory building is proposed to be constructed
along wall of the existing church building. The new accessory building will be 12 feet in
height and constructed of the same masonry block exterior as the church building with an
asphalt shingled roof. A small accessory building currently located on the west side of the
parking lot. The Zoning Ordinance allows one accessory building per property. The
existing accessory building shall be removed from the property.
Signs. No changes to the building or freestanding signage is proposed with this PUD
Amendment. The church is subject to the C-3 District requirements of the Zoning
Ordinance. A sign permit is required prior to the installation of any signs.
Mechanical Equipment. All mechanical equipment for the building addition is proposed
to be located on the roof. A roof top mechanic screening plan has been prepared to
address screening of the equipment from Kenyon Avenue. A 42 inch tall parapet wall will
be extended above the roof line as an architectural means of addressing the screening
requirement of the Zoning Ordinance.
Lighting. Any exterior lighting shall be downcast in design, shall not glare onto adjoining
properties and shall meet Zoning Ordinance requirements. Plans and an electrical permit
shall be submitted prior to the installation of any exterior lighting.
RECOMMENDATION
Planning Department staff recommends approval of the Celebration Church planned unit
development amendment subject to the following stipulations:
1. The recommendations listed in the February 22, 2017 engineering report.
2. The site shall and building addition shall be developed in accordance with the plans
approved by the City Council.
3. The head-to-head parking stalls in the parking lot west of the building shall be
restriped to meet the minimum stall depth requirement of 20 feet.
4. Events or other assembly in the banquet/assembly hall shall not be scheduled
during times when religious assembly or other events are being held in the main

The proposed building addition to Celebration Church consists of two parts; the upper level
Banquet Hall and a lower level children’s area.
The upper level Banquet Halls main purpose is to be used as a new dining facility and large
meeting hall for the church, it seats 450. It will also be used for wedding receptions and similar
functions. This upper level Banquet Hall also has the ability to be broken up into classrooms to
be used by the church for additional Sunday school classroom space.
The lower level children’s area has several uses. On Sundays it will function as Sunday school
classrooms, but during the week five of the rooms will be used for childcare. The church
currently has a functioning childcare, Celebration Academy, and it will move to this new lower
level addition. The new child care facility for Celebration Academy is scheduled to house 72
children in daycare.

BACKGROUND
Celebration Church has submitted an application for an amendment to the Planned Unit
Development approved in 2001 to add a two story addition to the existing church building on
Lot 1, Block 1, Celebration 2nd Addition. The property is located west of and adjacent to
Kenyon Avenue, south of 162nd Street (CSAH 46). The parcel is zoned PUD, Planned Unit
Development.

occupied by Celebration Church. The property generally drains from south to north and from
east to west. Existing utility services connect the building to utilities within Kenyon Avenue.
Street lights are located along Kenyon Avenue adjacent to site, and there is private interior
lighting within the parking lot.

2nd Addition. These easements will remain and will not be impacted with the proposed site

Celebration Church proposes to construct a two story, 18,443 square foot addition, a 744
square foot accessory building and make modifications to the surrounding parking lots. The
addition will connect to existing church building and will contain daycare classrooms and a
banquet hall. Private storm sewer will be extended around the proposed building addition.
Private sidewalk on the site will be extended to connect the proposed addition to the
surrounding parking lot. Existing full access driveways on Kenyon Avenue will remain.

Kenyon Avenue
The subject parcel is located west of and adjacent to Kenyon Avenue, a major collector roadway
as identified in the City’s Comprehensive Transportation Plan. Currently, Kenyon Avenue is
constructed as a 44-foot wide three-lane urban roadway with a shared center left turn lane
adjacent to the church site. An 8-foot wide sidewalk is located along the west side of Kenyon
Avenue south of Celebration Church’s north driveway. An 8-foot wide trail is located along the
east side of Kenyon Avenue north of Celebration Church’s south driveway.
Kenyon Avenue adjacent to the parent parcel was reconstructed in 2001 to a three lane
roadway with City Project No. 00-21/Dakota County Project No. 05-35. Right of way was
dedicated with the Celebration 2nd Addition plat.

Construction traffic access and egress for site grading, utility and building construction shall be
restricted to the existing entrances off of Kenyon Avenue.

The park dedication fee has been collected on the subject parcel with the Celebration plat.
There is no public trail or sidewalk construction as a part of this application.

The subject parcel is located within OL-51200 of the Orchard Lake sanitary sewer district as
identified in the City’s Comprehensive Sanitary Sewer Plan. Wastewater will be conveyed via
existing trunk sanitary sewer to the MCES Farmington Interceptor and continue to the Empire
Wastewater Treatment Facility. The downstream facilities have sufficient capacity to serve the
proposed building addition.
An existing public sanitary sewer extends through the site. A sanitary sewer service is
extended from this main to serve the existing building. Service for the building addition will be
from within the existing building.

The Sanitary Sewer Availability Charge was paid for the parent parcel.
WWAATTEERRMMAAIINN
Existing 16-inch public watermain extends through the subject parcel north of the existing
building. A 6-inch private watermain service is extended to the existing building. Service for
the building addition will be provided from within the existing building.
DDRRAAIINNAAGGEE AANNDD GGRRAADDIINNGG
The subject parcel is located within subdistrict CL-12 of the Crystal Lake Stormwater District,
as identified in the City’s Water Resources Management Plan.
The subject parcel was previously graded and improved with Celebration 2nd Addition. The site
drains to the north, eventually to Lee Lake. Parking lot and roof runoff is conveyed via a private
storm sewer system to public storm sewer, which outlets to an existing regional stormwater
basin.
The proposed site adds under an acre of impervious surface which is under the threshold of the
permitting requirements of the MPCA Construction General Permit with respect to the water
quality volume. The proposed stormwater management plan consists of two existing publicly
owned and maintained stormwater basins which drain through Farmington to the Vermillion
River.
The final grading plan must indicate any proposed borrow areas in which the building footings
will be placed on fill material. The grading specifications must indicate that all embankments
meet FHA/HUD 79G specifications. A final certificate of occupancy shall not be issued until an
as-built certified grading plan has been submitted and approved by the City Engineer.
The proposed site plan and improvements contain more than one acre of site disturbance. A
National Pollution Discharge Elimination System General Stormwater Permit for construction
activity is required from the Minnesota Pollution Control Agency.
SSTTOORRMM SSEEWWEERR
No public storm sewer is proposed to be constructed in conjunction with the site plan
improvements. A private storm sewer system will be installed to convey the discharge from the
roof of the new building to the existing private storm sewer within the site. Runoff eventually
drains to the public storm sewer within Kenyon Avenue and to a public stormwater basin north
of the site.
The Trunk Storm Sewer Area Charge has been collected on the subject parcel and will not be
required with the site plan improvements.

There are no wetlands on Lot 1, Block 1, Celebration 2nd Addition.

There are several trees on Lot 1, Block 1, Celebration 2nd Addition. Several trees will be
removed and replaced with construction of the building addition. Any other trees damaged or
removed due to utility or site construction must be replaced by the developer.
EERROOSSIIOONN CCOONNTTRROOLL
The Developer is responsible for obtaining a MPCA Construction Permit for the site as well as
developing and maintaining the SWPPP throughout construction phase. The permit requires
that all erosion and sediment BMPs be clearly outlined in a site’s SWPPP. Changes made
throughout construction should be documented in the SWPPP.
Additional erosion control measures may be required during construction as deemed
necessary by City staff or the Dakota County Soil and Water District. Any additional measures
required shall be installed and maintained by the Developer.
RREECCOOMMMMEENNDDAATTIIOONN
Engineering recommends approval of the site plan, sediment, erosion control, and restoration
plan for the Celebration Church building addition, subject to the requirements and stipulations
within this report.
1. The Applicant shall submit the final construction drawings in an electronic format. The
electronic format shall be in either .dwg (AutoCAD) or .dxf format.
