PLANNING COMMISSION WORK SESSION MINUTES
March 16, 2017
Chair Swenson called the work session to order at 6:30 p.m.
Members Present: Chair Jason Swenson, Vice Chair Brooks Lillehei, Karl Drotning, Paul
Reuvers, Jason Kelvie, Pat Kaluza, Elizabeth Bakewicz
Members Absent: Scott Einck
Staff Present: Associate Planner Frank Dempsey and Associate Planner Kris Jenson
Others Present: Jason Schneiderman, Schneiderman Furniture; Craig Larson, Opus; Jim
Hamilton, Hamilton Sign; and Sandi Raines, 12245 – 175th St.
Schneiderman’s Furniture Sign Variance
Kris Jenson presented information regarding the variance request that has been submitted for
an electronic message center sign at the new Schneiderman’s Furniture location on Kenyon
Avenue. Jason Schneiderman introduced his associates from Opus and Hamilton Sign and
presented his reasons for requesting the sign variance. Chair Swenson summarized why the
Planning Commission was being asked for their input on the request.
Planning Commission discussion points:
The Planning Commission noted that the request does not meet all of the review criteria for
variances included in the Zoning Ordinance, especially the criteria which states that the plight of
the landowner is due to circumstances unique to the property not created by the landowner. The
discussion also centered on the current seven (7) second rate of change for dynamic display
signs and the potential for distraction to drivers on I-35, particularly southbound traffic which
backs up at the Kenwood Trail (CSAH 50) exit.
The Planning Commission concluded that they could not support the variance as requested.
The Planning Commission did state that it may be more appropriate for the applicant to request
an amendment to the Zoning Ordinance that addresses larger dynamic display signs within the
Freeway Corridor District.
The Planning Commission thanked Mr. Schneiderman for his attendance at the work session
and congratulated him on the new store.
Raines Variance, 12245 – 175th Street
Sandi Raines was present to discuss her proposed variance to allow a portion of her existing
covered porch to encroach into the Orchard Lake Ordinary High Water Level setback of 50 feet.
The deck was constructed following approval of a conditional use permit in 2015. The deck
pergola and posts were constructed at the same time as the deck but were not included with

building permit submittal or the City’s zoning approval. Staff also identified additional
impervious surface parking strips that had been installed on the property as shown on the
survey.
The Planning Commission heard Ms. Raines comments and concluded that they could not
support the variance based on the Zoning Ordinance criteria and the lack of “practical
difficulties” associated with the request.
Ms. Raines requested to keep the parking strips. Staff and the Planning Commission agreed
that one strip of paving brick could remain, as a walkway, provided the total impervious surface
area of the property did not exceed 36.1% as allowed by the conditional use permit approved in
2015.
The work session was adjourned at 7:50 p.m.
