DICK’S SANITATION PUD AMENDMENT
Proposed Action
Staff recommends adoption of the following motion: Move to approve the Dick’s Sanitation
PUD amendment and Site Improvement Performance Agreement.
Overview
DMAC Real Estate Management Company, LLC (Dick’s Sanitation) representatives have
submitted an application for a planned unit development (PUD) amendment to allow the
construction of two building additions, two new buildings and various site improvements on
their property located at 8984 – 215th Street. The proposed new buildings and building
additions will accommodate additional offices, storage buildings and a wash bay on the 10 acre
property.
The Planning Commission held a public hearing at its April 6, 2017 meeting. The Planning
Commission recommended unanimous approval of the PUD Amendment subject to seven
stipulations. There was no public comment at the public hearing. A Site Improvement
Performance Agreement (SIPA) is required in conjunction with the PUD amendment and prior
to issuance of a building permit for any of the proposed additions or new buildings.
Primary Issue to Consider
When will construction commence on the proposed site improvements? Representatives of
Dick’s Sanitation indicate that the construction project will be phased over a period time with
construction of the office building addition is the first phase and is planned to commence later this
year. Landscaping and fence installation is likely to occur earlier this year.

April 6, 2017
Chair Swenson called the meeting to order at 6:00 p.m. in the Council Chambers at City
Hall. The pledge of allegiance to the flag was given.

3. Approval of the Meeting Minutes
The March 16, 2017 Planning Commission meeting minutes were approved as
presented.
The March 16, 2017 Planning Commission work session minutes were approved as
presented.
4. Announcements
Mr. Morey reminded the Planning Commission members of the joint work session
with the City Council, regarding the 2018 Comprehensive Plan Update, following
tonight’s meeting at 7:00.
Mr. Morey also invited the Planning Commission to attend the State of the City
presentation at 8:00 a.m. on Wednesday, April 12th in the Council Chambers.
5. Dick’s Sanitation
Chair Swenson opened the public hearing to consider the application of DMAC Real
Estate Management Company, LLC for an amendment to the Dick’s Sanitation
Planned Unit Development (PUD) to allow additions to existing principal buildings
and the construction of new buildings on property located at 8984 – 215th Street.
Brett Anderson from Dick’s Sanitation and Jim Connelly from APPRO Development
presented an overview of the project. Dick and Mary Clemmer, owners of Dick’s
Sanitation, were also in attendance. This PUD amendment includes current
improvement plans along with long range improvement plans. Mr. Anderson
thanked City staff for their efforts to help their business continue to grow.

Associate Planner Frank Dempsey presented the planning report. Mr. Dempsey
stated that the site improvements include an addition to the office building, an
addition to the existing truck shop, construction of a three-sided storage building and
a wash bay building with a possible future addition, and construction of a third
driveway access to Humboldt Road. The developer also wants to install fencing and
landscaping to screen the outdoor storage area, with additional landscaping to be
installed along Humboldt Road adjacent to the truck shop in accordance with the
existing PUD. The proposed improvements require an amendment to the PUD
approved in 2001 and amended in 2004, 2006, and 2010.
Mr. Dempsey described in detail the square footage of the additions and reviewed
the previous improvements to the property since 1974 when Dick’s Sanitation first
occupied the site, which are listed in the March 31, 2017 planning report.
Mr. Dempsey reviewed the proposed building addition for conformance with Zoning
Ordinance performance standards, including parking/drive aisle setbacks, exterior
building materials and building height, and site access and circulation. He indicated
that the proposed on-site parking consists of 138 spaces, including five handicap
accessibility spaces. One-hundred five (105) parking spaces are required by
ordinance.
Outdoor storage, connection of the office building addition and the new wash bay to
city sanitary sewer and water service, landscaping, mechanical equipment, and
lighting were also reviewed by Mr. Dempsey and are included in the March 31, 2017
planning report.
Mr. Dempsey stated that staff recommends approval of the Dick’s Sanitation PUD
amendment subject to the 7 stipulations listed in the March 31, 2017 planning report.
Chair Swenson opened the hearing to the public for comment.
There were no comments from the audience.
Motion was made by Kelvie, seconded by Einck to close the public hearing at
6:11 p.m.
Voice vote was taken on the motion. Ayes – unanimous
Chair Swenson asked for comments from the Planning Commission. Discussion
points included:
• Regarding the wash bay extension, Commission Kelvie asked if they would
be allowed to use that as an outdoor washing area. Mr. Dempsey indicated
that all washing of vehicles had to be inside the wash bay.
• Chair Swenson expressed appreciation for the efforts of Dick’s Sanitation to
prepare this long range improvement plan.
• Commissioner Lillehei asked about Stipulation 7 and when the outdoor
storage area would be paved. Mr. Anderson indicated that their intent is to

pave everything from the wash bay building to the east. The storage area to
the south property line will be surfaced with a material to control dust. Mr.
Dempsey stated that the Zoning Ordinance does not require outdoor storage
areas to be paved, only surfaced with a material to control dust.
Motion was made by Kelvie, seconded by Drotning to recommend to City
Council approval of the Dick’s Sanitation PUD amendment to allow additions to
existing principal buildings and the construction of new buildings on property located
at 8984 – 215th Street, subject to the following stipulations:
1. The recommendations listed in the March 30, 2017 engineering report.
2. The site and building exteriors shall be developed in accordance with the plans
approved by the City Council.
3. Landscaping shall be installed consistent with the approved landscape plan. A
$6,000 security shall be submitted with the building permit application to
guarantee installation of the approved landscaping and parking lot restriping.
4. A building permit is required prior to commencing construction. Construction of
the new building and building additions are subject to the approval of the Building
Official and Fire Marshal.
5. A sign permit is required prior to the installation or modifications of any signs.
6. The developer shall submit the wash bay and office building addition plans to
MCES to obtain the SAC unit determination prior to issuance of the building
permits for those buildings.
7. The outdoor storage area is a gravel surface which must be paved or surfaced
with a material to control dust and erosion from the site to comply with Zoning
Ordinance requirements.

INTRODUCTION
DMAC Real Estate Management Company, LLC representatives have submitted an application
for a planned unit development (PUD) amendment to allow the construction of building
additions and new building construction and other associated site improvements on the Dick’s
Sanitation property located at 8984 – 215th Street. The project includes an addition to the office
building, an addition to the existing truck shop, a three-sided storage building and a wash bay
building with a possible future addition. Improvements will also include fencing and
landscaping to screen the outdoor storage yard and additional landscaping along Humboldt
Road adjacent to the truck shop in accordance with the existing PUD.
The subject property is zoned PUD, Planned Unit Development subject to the I-1, Limited
Industrial District uses and performance standards. The proposed improvements require an
amendment to the PUD approved in 2001 and amended in 2004, 2006 and 2010.

APPLICATION ANALYSIS
Dick’s Sanitation proposes the following improvements to the site to be included in the PUD
Amendment:
• 5,940 square foot two story addition to the east side of the existing office building
• 972 square foot parts storage room addition to the north side of the existing truck shop
building
• 5,340 square foot three sided storage shelter to house residential trash and recycling
containers
• 3,000 square foot wash bay with a 3,000 square foot addition to the wash bay in the
future
• Third driveway access to Humboldt Road
• Screening fence and landscape screening and overstory tree planting along the west
property line and chain link security fencing
• Allow a five foot driveway/parking lot setback adjacent to Humboldt Road west of the
existing truck shop
Background
Dick’s Sanitation has occupied this site since 1974 and has operated in Lakeville since 1966. The
property now includes approximately 10 acres.
• 1974 – The first office building was constructed near the northwest property line. This
building is now occupied by an auto body repair shop.
• 1975 – Dakota County completes acquisition of additional right-of-way along the north
property line between Cedar Avenue (CSAH 23) and I-35.
• 1990 – Administrative subdivision approved to increase the lot size
• 1991 – Conditional use permit approved to allow construction of a 2,800 square foot office
building addition onto the office building constructed in 1974.
• 1995 – Conditional use permit amendment approved to allow construction of a 1,008
square foot garage and future garage addition
• 2001 – Approval of the Airlake Development Fifth Addition preliminary and final plat and
rezoning to PUD approved to allow construction of a new office building, allowing more
than one principal building on the property. The Fifth Addition also included the
dedication of right-of-way by Dick’s Sanitation for future Humboldt Road.

• 2004 – PUD amendment, rezoning and preliminary and final plat of Clemmer First
Addition to allow construction of an addition to the storage building for additional curb-
side recycling containers and to allow a one acre expansion to the east.
• 2006 – PUD Amendment to allow a major auto repair business to operate within the
initial (1974) office building.
• 2010 – PUD Amendment, rezoning and preliminary and final plat of Clemmer Second
Addition to allow expanded property for additional outdoor storage area.
The construction of Humboldt Road in 2016 included the relocation of the Dick’s Sanitation
driveway from 215th Street to Humboldt Road. Traffic entering the site must now travel via Dodd
Boulevard to Humboldt Road.
Surrounding Land Uses and Zoning
North – 215th Street (CSAH 70), industrial uses (I-2), single family homes (RS-3)
South – Metropolitan Airports Commission (MAC) property (I-2), industrial building (I-1)
East – Recycle Minnesota (also owned and operated by DMAC Real Estate Management
Company) (I-1)
West – Humboldt Road and Fed Ex Freight property (I-1)
The proposed building addition was reviewed for conformance with Zoning Ordinance
performance standards as follows:
Building and Parking/Drive Aisle Setbacks. The proposed buildings and building additions
meet the setback requirements of the I-1, Limited Industrial District as follows:
Front Yard – 40 feet
Side Yards – 10 feet; 30 feet abutting a public street
Rear Yards – 30 feet
Parking/Drive Aisle – 15 feet. The (PUD amendment proposes a 5 foot setback along
Humboldt Road, west of the truck maintenance building).
Building Elevations and Exterior Building Materials. The Zoning Ordinance requires that
industrial buildings provide a masonry material on at least 50% of any building wall facing
public right-of-way. The project includes new construction or additions of the following
buildings:
Office Building – The office building addition will be constructed of precast concrete wall
panels with exposed aggregate finish to match the existing office building exterior. The
upper portion of the wall will be constructed of insulated metal wall panel with an artificial
stucco type finish. The materials meet Zoning Ordinance requirements.
Wash Bay Building – The wash bay building will be constructed of precast concrete
foundation wall with insulated metal wall panel and artificial stucco type finish from the
foundation wall to the roof. The materials meet Zoning Ordinance requirements.

Storage Building – The 3-sided storage building will be attached to the wash bay building
and will be constructed with a precast concrete panel with an artificial stucco finish and a
prefinished insulted metal wall above with an artificial stucco type finish to the roof. The
materials meet Zoning Ordinance requirements. The wash bay building and storage
building will act as a visual screen between the storage yard and Humboldt Road.
Parts Addition to Truck Maintenance Building – The parts storage addition will be
constructed of materials similar to the other proposed buildings which include precast
concrete foundation wall and insulated metal wall panel with artificial stucco surface.
Building Height. The office building addition height is 25 feet. The other three buildings are
single story. The maximum allowed height in the I-1 District is four stories or 45 feet. The
building height of all buildings meets Zoning Ordinance requirements.
Access and Circulation. The site is currently accessed from two driveways from Humboldt
Road. A new, third driveway access will be constructed near the south end of the property to
access the wash bay building. Circulation is also available through the Recycle Minnesota
property to the east.
Parking. Proposed on-site parking consists of 138 spaces, including five handicap accessible
spaces. One-hundred-five (105) parking spaces are required with the proposed building
additions and new building, as follows:
Existing Office/Truck Maintenance Building
Office: 1,320 sf –10%/200 = 6 spaces
Truck Repair: 5,920 sf – 10%/800 + 8 = 15 spaces
Sub Total = 21 spaces
Existing Storage Garage/Office Building
Office – 1,008 – 10% / 200 = 5 spaces
Storage - 24,528 sf – 10%/1,000 = 22 spaces
Sub Total = 27 spaces
Existing Main Office Building
Office – 5,413 sf – 10% / 200 = 24 spaces
Office (new) – 5,940 sf – 10% / 200 = 27 spaces
Sub Total = 51 spaces
Wash Bay Building/Storage
3,000 sf – 10% / 1,000 = 3 spaces
Total number of required spaces = 105
Total number of spaces proposed = 138

Outdoor Storage. Outdoor storage is an allowed use in the I-1 District. Dick’s Sanitation has
been using part of their property for outdoor storage of large and small commercial containers
and residential garbage and recycling containers. The plan proposes the construction of a
5,340 square foot, three-sided (open to the east) building to store residential garbage and
recycling containers to keep them out of the elements. Some larger commercial containers
will continue to be stored outdoors on the south side of the property. The Zoning Ordinance
requires that the storage yard be surfaced to control dust and erosion. The outdoor storage
area is a gravel surface which must be paved or surfaced with a material to control dust and
erosion from the site to comply with Zoning Ordinance requirements.
Grading/Drainage/Utilities. The office building addition and the new wash bay will require
connection to city sanitary sewer and water service. A sanitary sewer unit determination by
MCES is required. Additional sewer (SAC) and water access (WAC) fees will payable at the
time of building permit approval. The developer should submit the wash bay and office
building addition plans to MCES as soon as possible to obtain the SAC unit determination
prior to issuance of the building permits.
Landscaping. A mix of deciduous and evergreen trees and shrubs are proposed on the
property along Humboldt Road and along the office building foundation. Nine, eight foot tall
evergreens are proposed along with the screening fence along south side of the property
adjacent to Humboldt Road. Eleven overstory trees are proposed along Humboldt Road west
of the truck maintenance building and the auto repair building. All materials shall meet the
size and species requirements of the Zoning Ordinance.
Signs. No changes to the building or freestanding signage is proposed with this PUD
Amendment. Dick’s Sanitation is subject to the I-1 District requirements of the Zoning
Ordinance. A sign permit is required prior to the installation of any signs.
Mechanical Equipment. All roof-top or ground mounted mechanical equipment shall be
screened in accordance with Zoning Ordinance requirements.
Lighting. Any exterior lighting shall be downcast in design, shall not glare onto adjoining
properties and shall meet Zoning Ordinance requirements. Plans and an electrical permit
shall be submitted prior to the installation of any exterior lighting.
Airlake Airport. The airport is considered a reliever airport under the management of the
Metropolitan Airports Commission (MAC). The majority of the airport property is located in
Eureka Township with two buildings and a small portion of the west end of the runway in the
City. The airport’s flight Safety Zones are managed by MAC. The Dick’s Sanitation property and
proposed office building is located within the State Department of Transportation Model Safety
Zone B but is well outside the current Runway Protection Zone.
Due to the site’s proximity to Airlake Airport, the Federal Aviation Administration may
require an FAA permit (#7460) if any construction cranes are used during the construction of
the buildings. The developer is advised to coordinate any required permit with the FAA.

RECOMMENDATION
Planning Department staff recommends approval of the Dick’s Santiation planned unit
development amendment subject to the following stipulations:
1. The recommendations listed in the March 30, 2017 engineering report.
2. The site shall and building exteriors shall be developed in accordance with the plans
approved by the City Council.
3. Landscaping shall be installed consistent with the approved landscape plan. A $6,000
security shall be submitted with the building permit application to guarantee
installation of the approved landscaping and parking lot restriping.

Long Range Plans
The site will continue to serve as our corporate office and fleet maintenance facility for our waste
collection business. The improvements will accommodate our continued growth and allows the
operation to run more efficiently centralized to our processes that occur during our normal operating
day.
• The open sided / wash bay building will serve two important points. First it allow for more
efficiency by keeping the residential containers clean and free from water/ice, this allows us
provide clean containers to our residential customers. Secondly this building will provide
screening from Humboldt Ave of our storage yard that houses a variety of items that include:
commercial dumpsters that are waiting for repairs, compactors, balers along with a variety of
miscellaneous items. The truck and container wash bay attached to the residential container
storage building will serve and allow our containers to be centralized to where we store the
containers as they await delivery to new customers. Storing all containers inside a building
wouldn’t be reasonable or necessary. The screening that the open sided building along with
the fencing provides adequate screening from our stored containers and misc items.
• The truck wash portion of this expansion is simply to allow for an expansion of our metal
fabrication space within our maintenance / service repair building. There won’t be any truck
stacking on Humboldt because our entrance will be from the east and any stacking that could
occur will be with in our property. Virtually all truck washing that occurs are single trucks so
no stacking occurs. The driveway onto Humboldt is solely for exiting the wash bay.

BACKGROUND
Appro Development, on behalf of DMAC Real Estate Management Company LLC / Dick’s
Sanitation, has submitted a PUD Amendment Application , a site plan, and a grading,
drainage, and utility plan for Lot 1, Block 1, Clemmer 2nd Addition (Parcel ID 22-17826-01-010).
The property is located south of and adjacent to 215th Street (CSAH 70) and east of and
adjacent to Humboldt Road. The subject parcel is zoned PUD, Planned Unit Development
District.
Proposed improvements to the parcel include the construction of a new wash bay building
and three sided covered storage area; an expansion of the existing main office; and an
expansion of the existing truck shop. Access to the site will be from two existing driveways
on Humboldt Road and from a new driveway to Humboldt Road at the new wash bay
building. Site improvements will also include striping of additional parking spaces on existing
pavement to replace parking removed for the proposed main office expansion.

Dick’s Sanitation is located on developed land with three existing buildings, paved and gravel
parking and outdoor storage and a row of trees along 215th Street. Two paved driveway
entrances provide the property direct access to Humboldt Road. Paved cross-access
driveways allow access to the parcel to the east. An existing overhead transmission line is
located along 215th Street adjacent to the property.

The subject parcel contains several existing easements. The following easements are located
on the property and shall remain:
• Public drainage and utility easements according to the Clemmer 2nd Addition plat
• 40-foot wide permanent roadway, drainage, and utility easement according to Doc.

The Dick’s Sanitation site plan improvements include a proposed 5,940 square foot office
building expansion, a 972 square foot truck shop addition, and construction of a 3,000 square
foot wash bay and 5,340 square foot three-sided covered storage area. The site plan was
reviewed and is consistent with the City’s ordinance requirements. The proposed site plan
identifies a bituminous parking lot containing 138 stalls including 5 handicap stalls. An
outdoor storage yard area with a bituminous and gravel surface will remain on much of the
parcel. A fence and gates will be added along Humboldt Avenue.

215th Street (CSAH 70)
The subject parcel is located south of and adjacent to 215th Street, a principle arterial County
highway, as identified in the City’s Transportation Plan. A 150-foot to 170-foot right-of-way for
215th Street was previously dedicated. No additional right-of-way will need to be dedicated at
this time.
215th Street is currently a two-lane undivided rural roadway. No work on 215th Street is
planned with the Dick’s Sanitation site plan improvements.

Humboldt Road
The subject parcel is located east of and adjacent to Humboldt Road, a minor collector, as
identified in the City’s Transportation Plan. A 40-foot right-of-way for Humboldt Road was
previously dedicated adjacent to the north 509 feet of the parcel. A 40-foot roadway
easement was dedicated in lieu of right-of-way over the remainder of Humboldt Road
adjacent to Dick’s Sanitation. No additional right-of-way will need to be dedicated at this
time.
Humboldt Road is currently a two-lane undivided rural roadway. Existing bituminous parking
lot within the right of way and parking setback area will be removed with the project and
replaced with turf. A culvert will be installed adjacent to the street for the new driveway
connection to Dick’s Sanitation. A $5,000 escrow will be collected with the building permit to
ensure proper installation of the culvert and driveway, including relocation of a streetlight.
No other work on the street is planned with the Dick’s Sanitation site plan improvements.

Construction traffic access and egress for site grading, utility and building construction shall
be restricted to the existing driveway entrances onto Humboldt Road.

The parent parcel is located within SC-10160 and SC-10295 of the South Creek sanitary sewer
district as identified in the City’s Comprehensive Sanitary Sewer Plan. Trunk sanitary sewer
was previously constructed through the site within public drainage and utility easements.
Services from this sanitary sewer main serve the existing office and shop buildings. Proposed
additions to the office and truck shop will be plumbed through the existing buildings.
The proposed wash bay building will require a new service from the existing sanitary sewer
main located on the property. A connection to the sanitary sewer must be indicated on the
building permit plans and must meet City specifications and standards. A $2,000 security will
be collected with the building permit to ensure proper connection to the public sanitary
sewer main.

Trunk watermain was previously constructed through the site within public drainage and
utility easements. Services from this watermain serve the existing office and shop buildings.

The Dick’s Sanitation site plan is located within subdistrict SC-4A and SC-18 of the South
Creek drainage district as identified in the City’s Water Resources Management Plan.
The northerly portion of the parcel drains north and west. Runoff is collected in the roadside
ditch along 215th Street and flows north across 215th Street, eventually to South Creek. The
remainder of the parcel drains south to an existing drainage swale and stormwater
management basin.
The proposed site plan maintains existing drainage patterns. A culvert will be added to the
new driveway entrance onto Humboldt Road to maintain drainage.
The proposed building will be placed on fill material. The grading specifications shall indicate
that all embankments meet FHA/HUD 79G specifications.
A Certificate of Occupancy shall not be issued until a certified as-built grading plan and as-
built building pad survey have been submitted and approved by the City Engineer.
SSTTOORRMM SSEEWWEERR
No public storm sewer is proposed to be constructed in conjunction with the site plan
improvements.
WWEETTLLAANNDDSS
There are no wetlands identified on site.
TTRREEEE PPRREESSEERRVVAATTIIOONN
A row of evergreen trees are located on a landscaping berm that buffers the site from 215th
Street. There is no work planned near the trees, and all of the trees within the parcel will
remain.
Eleven new deciduous trees are proposed along the west property line adjacent to Humboldt
Road to screen the existing shop buildings. A $6,000 escrow will be collected with the
building permit to ensure planting of the trees.

An erosion control plan must be submitted and reviewed with the building permit. The
developer/owner is responsible for obtaining a MPCA Construction Permit for the site as well
as developing a SWPPP for the site prior to construction. The permit requires that all erosion
and sediment BMPS be clearly outlined in a site’s SWPPP. Changes made throughout
construction should be documented in the SWPPP.
The outdoor storage area shall be surfaced with a material to control dust and erosion as
required by the Zoning Ordinance.
Additional erosion control measures may be required during construction as deemed
necessary by City staff or the Dakota County Soil and Water District. Any additional measures
required shall be installed and maintained by the developer.

The Applicant shall provide a cash security for the Applicant-installed improvements relating
to the site plan. The Security will be required prior to issuance of the building permit.
