HomeMy WebLinkAboutItem 06.q Date: Item No. RESOLUTION ACCEPTING PETITION AND ODERING PREPARATION OF FEASIBILTY REPORT FOR 222nd STREET IMPROVEMENT PROJECT Proposed Action Staff recommends adoption of the following motion: Move to approve a resolution accepting petition and ordering preparation of an engineering feasibility report for 222nd Street Improvement Project. Overview At its April 3rd, 2017 meeting, the City Council approved a preliminary plat named Launch Park First Addition. The Developer, on behalf of the property owner, submitted a petition requesting the City construct the required public improvements associated with Launch Park First Addition. The petition also states that the Developer and property owner agree to pay 100% of the costs associated with constructing the public improvements through an assessment. Proposed financing for the 222nd Street Improvement Project, City Project 17-07, would be through bonds issued under Minnesota Statutes, Chapter 429, for local improvements. The Developer and property owner would be assessed for 100% of the project cost. An engineering feasibility report is required under Minnesota Statutes, Chapter 429 prior to adopting a resolution ordering the improvement. Primary Issues to Consider • The proposed public improvements provide street and utility access for a 99-acre industrial-zoned parcel, located east of Cedar Avenue and north and west of City limits. The extension of public sanitary sewer and water distribution systems allow the property to develop. Supporting Information • None. Financial Impact: $ Budgeted: Y☐ N☐ Source: Related Documents: (CIP, ERP, etc.): Envision Lakeville Community Values: Diversified Economic Development Report Completed by: Zach Johnson, City Engineer April 17, 2017 N/A N/A CITY OF LAKEVILLE RESOLUTION NO. 17-__ RESOLUTION ACCEPTING PETITION AND ODERING PREPARATION OF FEASIBILTY REPORT FOR 222nd STREET IMPROVEMENT PROJECT WHEREAS, on April 3rd, 2017, the City Council approved a preliminary plat named Launch Park First Addition; and WHEREAS, Launch Properties, LLC (Developer), on behalf of Hat Trick Investments, LLC (property owner) petitioned the City to construct and finance the required public improvements (222nd Street Improvements) associated with Launch Park First Addition through assessments; and WHEREAS, an engineering feasibility report is required under Minnesota Statutes, Chapter 429 for this proposed local improvement. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Lakeville, that: 1. A certain petition requesting the 222nd Street Improvement Project, City Project No. 17- 07, filed with the City April 14, 2017 is hereby declared to be signed by the required percentage of owners of property affected thereby. This declaration is made in conformity to Minn. Stat. Section 429.035. 2. City staff is hereby authorized to prepare an engineering feasibility report for 222nd Street Improvements, City Project 17-07 advising the City Council in a preliminary way as to whether the proposed improvement is necessary, cost-effective, and feasible; whether it should be best made as proposed or in connection with some other improvement; the estimated cost of the improvement as recommended; and a description of the methodology used to calculate individual assessments for the affected parcel(s) ADOPTED by the Lakeville City Council this 17th day of April, 2017 ______________________________ Douglas P.
