OVERVIEW Lakeville 222nd 2017, LLC representatives have submitted a final plat application and plans for Launch Park First Addition proposing one lot and one outlot totaling 45.92 acres. The property is located east of Cedar Avenue (CSAH 23) and Airlake Airport and north of the Lakeville- Eureka Township boundary and is zoned I-2, General Industrial District. The proposed Lot 1, Block 1 will be occupied by a 286,000 square foot warehouse office building. Menasha Packaging, a retail and merchandise packaging manufacturer located in Airlake Industrial Park since 1970, has committed to leasing 150,000 square feet for the expansion of their operations in Lakeville. The City Council approved the Launch Park First Addition preliminary plat of two lots on April 3, 2017. The lot, block, and street design of the Launch Park First Addition final plat are consistent with the approved preliminary plat. Existing Site Conditions. The site is currently undeveloped and was previously used for the production of row crops. Lots/Blocks. The final plat of Launch Park First Addition consists of one lot and one block and right-of-way for 222nd Street. The lot proposed with the final plat exceeds the minimum lot area and lot width requirements for the I-2, General Industrial District. The following is a tabulation of the lots as noted on the final plat plans. Outlot A will be retained by the developer for future development consistent with the preliminary plat. Streets. The final plat of Launch Park First Addition includes the partial construction of 222nd Street east of Cedar Avenue to the east boundary of Lot 1. 3 Cedar Avenue (CSAH 23) is a two-lane rural roadway that abuts the west side of the property and is classified as a high density minor arterial in the Transportation Plan. The existing east half right-of-way width of 60 feet is adequate to accommodate two lanes of traffic and the turn lanes required by Dakota County. Improvements to Cedar Avenue include the construction of right and left turn lanes and a bypass lane. 222nd Street abuts the north side of the property. 222nd Street is a local street. The first phase of 222nd Street will be 1,300 feet long requiring a temporary cul-de-sac and easement. The development of Lot 2 may extend the temporary cul-de-sac to 2,597 feet. Ultimately, a future street from the north will connect with 222nd Street to provide alternate public street access and effectively reduce the length of the cul-de-sac. 222nd Street is ultimately planned to extend to the east of the Lakeville corporate limits when that the property to the east develops. A total of 80 feet of right-of-way will be required to be dedicated with the final plat. Grading, Drainage, Erosion Control, and Utilities. City sanitary sewer and water is available to the site, which is within the current MUSA, and is located north of the final plat. All public utilities will be constructed by the developer to serve the proposed first phase development following final plat approval. Sewer and water will be available to serve Outlot A when it is final platted into a lot. The existing and planned future City sanitary sewer and water systems available to serve the area of the final plat are adequate to accommodate the build-out of future industrial building(s) within the final plat. Grading and utility plans have been submitted with the Launch Park First Addition final plat. Grading, drainage, erosion control, and utility review comments are addressed in the engineering report dated April 27, 2017. A copy of the engineering report is attached for your review. Engineering recommends approval of the Launch Park First Addition final plat. Parks and Trails. No public trails or sidewalks are being constructed with this plat. Park dedication cash fee of $107,568.80 is required with the final plat. Tree Preservation. There are no significant trees located within the area of the Launch Park First Addition final plat. Wetlands. Two wetlands have been identified on the parent parcel. A detailed review of the wetlands and related impacts are outlined in the Engineering Division report dated April 27, 2017. FAA Permit. Due to the site’s proximity to the Airlake Airport, the Federal Aviation Administration will require a permit (#7460) if any construction cranes are used during the construction of the buildings. Dakota County Plat Commission. The Dakota County Plat Commission reviewed the final plat at their February 21, 2017 meeting under the provisions of the Dakota County Contiguous Plat Ordinance for access and County Road right-of-way needs and considered the final plat acceptable to Dakota County’s right-of-way needs. 4 RECOMMENDATION Planning Department staff recommends approval of the Launch Park final plat subject to the stipulations listed below: 1. Implementation of the recommendations listed in the April 27, 2017 engineering report. 2. Lot 1, Block 1, Launch Park shall be developed in compliance with the plans as approved by the City Council and Zoning Ordinance requirements. 3. A financial security in the amount of $138,413.90 shall be submitted to guarantee installation and completion of the approved landscaping for Lot 1, Block 1 and for the storm water and infiltration basins and drainage ways at the time of final plat approval. All landscaped areas within and adjacent to the building and parking lot shall be irrigated. Trees and shrubs shall not be planted in road right-of-way. 4. A “No Truck Exit” sign shall be installed at the southwest corner of the building to prevent trucks from driving northbound along the west side of the building. 5. A temporary turn-around easement shall be dedicated over the temporary cul-de-sac on 222nd Street. 6. The developer shall contact the Federal Aviation Administration (FAA) and submit any required applications at least 45 days prior to commencing building construction to determine if a permit is required for any crane of similar construction equipment on the property. This is the first phase of the Launch Park First Addition preliminary plat that was approved by the City Council on April 3, 2017. The Developer has submitted a site plan for a proposed manufacturing, warehouse and office building and parking lot to be constructed on Lot 1, Block 1. The proposed development is located south of land owned by Airlake Development Inc., west of the Lakeville corporate limits, north of the Lakeville corporate limits, east of, and adjacent to, Cedar Avenue (CSAH 23). The site is zoned I-2, General Industrial District. The final plat consists of one lot within one block and one outlot on 44.56 acres. The Developer is dedicating 0.91 acres as Cedar Avenue (CSAH 23) right-of-way, and 4.73 acres as 222nd Street right-of-way. LLAAUUNNCCHH PPAARRKK FFIIRRSSTT AADDDDIITTIIOONN FFIINNAALL PPLLAATT AAPPRRIILL 55,, 22001177 PPAAGGEE 22 OOFF 99 SSIITTEE CCOONNDDIITTIIOONNSS The Launch Park First Addition site is undeveloped cultivated agricultural land. The land generally slopes from the southwest to northeast. The site is located east of the existing Airlake Airport. Wetlands have been identified on the site. SSTTRREEEETT AANNDD SSUUBBDDIIVVIISSIIOONN LLAAYYOOUUTT Cedar Avenue (CSAH 23) Launch Park First Addition is located east of, and adjacent to, Cedar Avenue. Cedar Avenue is a low density minor arterial County roadway as identified in the City’s Transportation Plan. It is currently constructed as a two-lane, rural section roadway. The preliminary and final plat were reviewed and recommended for approval by the Dakota County Plat Commission at its February 21, 2017 meeting. The Developer has dedicated 60-feet of east half right-of-way with the final plat, as shown on the final plat to satisfy the County’s right-of-way requirements. Restricted access is shown along all of Cedar Avenue, except one access opening for 222nd Street, consistent with Dakota County’s Access Spacing Guidelines. Development of Lot 1, Block 1, Launch Park First Addition requires the future street upgrade fee to be collected for the frontage of Cedar Avenue. The future street upgrade fee for Cedar Avenue shall be submitted with the final plat and is calculated as follows: 665.76 f.f. x $160.00/f.f = $106,521.60 Lot 1, Block 1, Cedar Avenue Front Footage Commercial Urban Section Fee Total The Developer is required to coordinate with Dakota County to determine the extent of improvements that will be required along Cedar Avenue. The plan for any County road improvements must be approved by Dakota County, and a permit for the work within the right-of-way must be obtained from the County. 222nd Street Launch Park First Addition includes the construction of 222nd Street, a local industrial roadway. 222nd Street will be constructed as a rural section roadway to promote infiltration and stormwater treatment. The street will be constructed as a 40-foot wide paved section with two-foot gravel shoulders within an 80-foot right-of-way. Dedicated right and left turn lanes will be constructed along Cedar Avenue at the 222nd Street intersection. The construction of 222nd Street and dedicated right and left turn lanes along Cedar Avenue will be constructed with the public improvement project. A temporary cul-de-sac on 222nd Street is planned within a temporary easement on Lots 1 and 2, Block 1, Launch Park First Addition. A temporary turnaround easement and a fee of $2,000 for future removal of the temporary cul-de-sac is required with the final plat. The Developer will be required to construct and extend 222nd Street to the east plat boundary of Outlot A, Launch Park First Addition, at the time it is platted into lots and blocks. LLAAUUNNCCHH PPAARRKK FFIIRRSSTT AADDDDIITTIIOONN FFIINNAALL PPLLAATT AAPPRRIILL 55,, 22001177 PPAAGGEE 33 OOFF 99 SITE PLAN REVIEW A site plan was submitted for Lot 1, Block 1, Launch Park First Addition. The site plan features a 286,000 square foot warehouse with office space and parking lot. Parking for 343 automobiles, including 12 designated handicapped spaces, and 31 proof of parking spaces, has been provided in a paved parking lot. Three access drives from 222nd Street serve this lot. Automobile parking spaces are 20’ deep and 9’ wide. Trailer parking spaces are 50’ deep and 12’ wide. A final site plan must be submitted and reviewed prior to the issuance of a Building Permit for Lot 1, Block 1, Launch Park First Addition. SSPPEECCIIAALL AASSSSEESSSSMMEENNTT AAGGRREEEEMMEENNTT ((CCIITTYY PPRROOJJEECCTT 1177--0077)) At its April 17, 2017 meeting, the City Council approved a resolution accepting a petition from the Developer requesting the City construct the required public improvements associated with Launch Park First Addition and be assessed for the entire cost of the project. At its same meeting, the Council approved a resolution approving a feasibility report, ordering improvements and declaring intent to bond for the 222nd Street and Utility Improvement Project, City Project 17-07. The project would include the construction of 222nd Street, watermain, sanitary sewer, storm sewer, and turn lane improvements along Cedar Avenue. The City intends to receive bids and award a contract for construction in June, 2017. The Developer shall submit a security with the final plat guaranteeing completion of the public improvements, together with costs for construction of improvements, surveying, design, inspection, as-builts, legal fees, engineering administration. If the Developer enters into an assessment agreement with the City for the construction of City Project No. 17-07 and waives the right to appeal the assessment, the City shall release the Developer from its obligation to construct the public improvements associated with Launch Park First Addition and release the security guaranteeing their completion. CCOONNSSTTRRUUCCTTIIOONN AACCCCEESSSS There shall be two construction traffic accesses and egresses from Cedar Avenue, one for public grading, utility and street construction, and the other for private grading and utility construction from Cedar Avenue. The Developer is required to coordinate accesses to Cedar Avenue with the City and Dakota County. PPAARRKKSS,, TTRRAAIILLSS AANNDD SSIIDDEEWWAALLKKSS No future park or trail needs within this development are indicated in the City’s Parks, Trails, and Open Space Plan. The Park Dedication Fee has not been collected on the parent parcels and will be satisfied through a cash contribution with the final plat. The Park Dedication fee for industrial areas is $4,558 per acre. UUTTIILLIITTIIEESS SSAANNIITTAARRYY SSEEWWEERR Launch Park First Addition is located south of the sub-district SC-10100 of the South Creek sanitary sewer district, as identified in the City’s Comprehensive Sewer Plan. The parent parcel was annexed into the City after the development of the Comprehensive Sewer Plan. The parcels can be served by sewer within sub-district SC-10100. The wastewater from the proposed site will be conveyed by privately-owned and City-owned sanitary sewer facilities to the Elko/New Market interceptor and then to the Empire Wastewater Treatment Plant. The existing MCES-owned downstream facilities are adequate to convey the wastewater generated by the proposed development. The Developer proposes to extend public sanitary sewer from the MCES interceptor to the site along the east property boundary and the proposed 222nd Street. This work will be completed with the City Project 17-07. Private sanitary sewer will extend from public main within 222nd Street to serve Lot 1, Block 1. The Sanitary Sewer Availability Charge has not been collected on the parent parcel and shall be paid for Lot 1, Block 1 with the Building Permit Application. The Sanitary Sewer Availability Charge will be calculated at the rate in effect at the time of approval of the Building Permit Application, as determined by the City’s Building Official. WWAATTEERRMMAAIINN Development of Launch Park First Addition includes the extension of public watermain. As identified in the City’s Water Plan, a 12-inch watermain will be extended to the site from an existing stub along Cedar Avenue north of the site, which will be completed with City Project 17-07. The watermain will be looped along the proposed 222nd Street and around the proposed building to a proposed stub along Cedar Avenue. Watermain to the north of, and along proposed 222nd Street, shall be City-owned. The remainder of the watermain will be privately-owned and maintained. LLAAUUNNCCHH PPAARRKK FFIIRRSSTT AADDDDIITTIIOONN FFIINNAALL PPLLAATT AAPPRRIILL 55,, 22001177 PPAAGGEE 55 OOFF 99 The Developer is responsible for obtaining any easements required to extend the public watermain south along Cedar Avenue to 222nd Street. Final locations and sizes of all sanitary sewer and watermain facilities will be reviewed by City staff with the final construction plans. DDRRAAIINNAAGGEE AANNDD GGRRAADDIINNGG Launch Park First Addition is located within subdistrict SC-1B, of the South Creek District of the City’s Comprehensive Water Resources Management Plan. The land use on the site is currently agriculture, and soils are classified as hydrologic soil group (HSG) A. Drainage on the existing site generally flows from the southwest to the northeast and eventually to an existing creek. The proposed drainage plan splits the site into several drainage areas, and provides pre- treatment and infiltration for each area. Areas within Lot 1, Block 1, Launch Park First Addition, drain to interior privately-owned and maintained stormwater and infiltration basins which outlet via a stormwater ditch to an existing creek northeast of the site. The Developer shall sign a private maintenance agreement for the stormwater management basins prior to City Council consideration of the final plat. The proposed basin located north of 222nd Street, is temporary stormwater treatment which must be revised to permanent stormwater management including pre-treatment with future development. A security of $10,000.00 is required for the removal of the basin to the north of 222nd street with the final plat. The design and installation of the stormwater facilities on Lot 1, Block 1, will be the responsibility of the Developer. Stormwater facilities constructed in the 222nd Street right-of- way will be constructed by the City but will be privately maintained. The proposed stormwater management design meets the City’s requirements for rate and quality control. The grading specifications shall indicate that all embankments meet FHA/HUD 79G specifications. The Developer shall certify to the City that footings placed on fill material are appropriately constructed. A building permit will not be issued until a soils report and an as- built certified building pad survey have been submitted and approved by City staff. A National Pollution Discharge Elimination System General Stormwater Permit for construction activity is required by the Minnesota Pollution Control Agency for areas exceeding one acre being disturbed by grading. A copy of the Notice of Stormwater Permit Coverage must be submitted to the City upon receipt from the MPCA. SSTTOORRMM SSEEWWEERR Development of Launch Park First Addition includes the construction of privately owned and maintained storm sewer systems, which will collect and convey stormwater runoff generated from within the development to the privately-owned and maintained stormwater management basins. LLAAUUNNCCHH PPAARRKK FFIIRRSSTT AADDDDIITTIIOONN FFIINNAALL PPLLAATT AAPPRRIILL 55,, 22001177 PPAAGGEE 66 OOFF 99 The Trunk Storm Sewer Area Charge has not been collected on the parent parcel and must be paid with the final plat. The Trunk Storm Sewer Area Charge for Lot 1, Block 1, and the 222nd Street right-of-way is calculated as follows: 1,028,016.00 s.f. x $0.250/s.f. = $257,004.00 Area of Lot 1, Block 1, and 222nd Street right-of-way, Launch Park First Addition Industrial Area Charge Total Trunk Storm Sewer Area Charge The Trunk Storm Sewer Area Charge for Outlot A will be collected at the time they are final platted into lots and blocks, at the rate in effect at the time of final plat approval. Final locations and sizes of all storm sewer facilities will be reviewed by City staff with the final construction plans. FFEEMMAA FFLLOOOODDPPLLAAIINN AANNAALLYYSSIISS Launch Park First Addition is shown on the Flood Insurance Rate Map (FIRM) as Zone X by the Federal Emergency Management Agency (FEMA). Based on this designation, there are no areas in the plat located within a Special Flood Hazard Area (SFHA), as determined by FEMA. WWEETTLLAANNDDSS The wetland delineation for the site was conducted on 10/05/16 by Kimley-Horn and Associates, Inc. A field investigation took place on 10/12/16. Two wetland areas were identified within the project boundaries. Based on the information provided in the report dated January 2017 and site visit, Wetland Ditch A (0.6 acres) and Wetland 1 (0.10 acres) both have been determined to be acceptable for use in implementing the Wetland Conservation Act. Only wetlands within the project boundary are part of this decision. No comments on the wetland delineation/no-loss were received during the comment period. The wetland delineation and No-loss was approved on April 5, 2017. It is the Developer’s responsibility to obtain proper wetland approvals from the U.S. Army Corps of Engineers. TTRREEEE PPRREESSEERRVVAATTIIOONN There are no trees within the site. EERROOSSIIOONN CCOONNTTRROOLL The Developer is responsible for obtaining a MPCA Construction Permit for the site as well as developing a SWPPP for the site prior to construction. The permit requires that all erosion and sediment BMPS be clearly outlined in a site’s SWPPP. Changes made throughout construction must be documented in the SWPPP. LLAAUUNNCCHH PPAARRKK FFIIRRSSTT AADDDDIITTIIOONN FFIINNAALL PPLLAATT AAPPRRIILL 55,, 22001177 PPAAGGEE 77 OOFF 99 A maintenance schedule for the first 2 years must be included in the plans prior to final plat approval for the pond and infiltration areas. This must include mowing 2 to 3 times, 30 days apart during the first year with the mower deck set about 6-8 inches off the ground. The second year, the pond areas must be mowed once before weeds set their seeds. This will reduce weed establishment, and help stimulate the desirable vegetation. This will cut down on maintenance in the long-term. The site drains to a DNR trout stream. Additional best management practices are required to protect the resource. Additional erosion control measures may be required during construction as deemed necessary by City staff or the Dakota County Soil and Water District. Any additional measures required shall be installed and maintained by the Developer. SECURITIES The Developer shall provide a Letter of Credit as security for the Developer-installed improvements relating to Launch Park First Addition. Construction costs are based upon estimates submitted by the Developer’s engineer on March 29, 2017.
