HomeMy WebLinkAboutItem 03 Date: Item No. SPIRIT OF BRANDTJEN FARM COMMERCIAL 1ST ADDITION SUPPLEMENT TO RESERVED AREA AGREEMENT Proposed Action Staff recommends adoption of the following motion: Move to approve a Supplement to Reserved Area Agreement for Outlot A, Spirit of Brandtjen Farm Commercial 1st Addition. Overview Planning Dept. staff was recently informed by the Dakota County Surveyor that the Reserved Area Agreement approved in 2014 in conjunction with the Spirit of Brandtjen Farm Commercial (SBFC) 1st Addition final plat (Hy-Vee) inadvertently omitted language for the portion of the Reserved Area adjacent to Pilot Knob Road (CSAH 31). The Dakota County Attorney has drafted a Supplement to Reserved Area Agreement that includes the omitted language and legal description. Hy-Vee representatives have signed the Supplement; the City and County need to sign the Supplement as well, which requires City Council approval. The Reserved Area is 25 feet wide and is located east of the existing right-of-way for Pilot Knob Road and south of the existing right-of-way for 160th Street (CSAH 46) for one-quarter mile in each direction from the intersection of those two roadways. It is designed to reserve the appropriate right-of-way footprint for a future compact urban interchange. Permanent structures such as buildings, parking lots and signs are not permitted in the Reserved Area, but landscaping, stormwater basins, and trails are permitted.
