PLANNING COMMISSION WORK SESSION MINUTES
July 24, 2017
Chair Swenson called the work session to order at 6:10 p.m.
Members Present: Chair Jason Swenson, Brooks Lillehei, Karl Drotning, Jason Kelvie
Members Absent: Vice Chair Pat Kaluza, Scott Einck, Paul Reuvers
Staff Present: Planning Director Daryl Morey, Associate Planner Frank Dempsey, and

Peter Kenow Variance Discussion
Mr. Kenow presented his request. He stated he considers the sports court to be a patio and
that the setback should be five feet from the side and rear lot lines, not 10 feet. In addition, he
used the rear setback of the existing detached shed that was constructed in 2002 as a basis for
locating the sports court with respect to the rear property line.
The Planning Commission did not agree with Mr. Kenow’s argument that the sports court should
be considered a patio. They also did not agree with Mr. Kenow’s argument that the need
expressed by Planning Department staff for him to contact a surveyor to verify the setbacks for
the sports court before it was installed was an option, not a requirement.
The Planning Commission concurred that the request does not meet all the variance criteria
required by Section 11-6-5 of the Zoning Ordinance. They informed Mr. Kenow that the City
Council takes final action on variance requests. Mr. Morey informed Mr. Kenow of the variance
application fee ($500) and the requirement that a survey be submitted with the variance
application.

Mr. Schweich presented his request.
The Planning Commission expressed support for a variance for lot area and/or lot width if Mr.
Schweich chooses to re-plat his five parcels into two lots, each with a house on it, provided the
construction of any house additions or new accessory buildings meet setback requirements, the
lots meet the 25% maximum impervious surface area requirement, and the number of existing
non-conformities is reduced to the extent possible. The Planning Commission reiterated that
the Zoning Ordinance requires reducing the number of non-conformities with a planning action,
such as a plat, variance, or conditional use permit.
