REVISED FINAL PLAT
Proposed Action
Staff recommends adoption of the following motion: Move to approve: 1) a resolution approving the Spirit
of Brandtjen Farm Commercial 4th Addition revised final plat
Overview
Steakburgers Minnesota, Inc. representatives are requesting approval of a revised final plat for Spirit of
Brandtjen Farm Commercial (SBFC) 4th Addition. The parent parcel Outlot A, Spirit of Brandtjen Farm
Commercial 1st Addition, which was approved in 2014 for the Hy-Vee grocery store. Hy-Vee owns the
parent parcel outlot and is selling portions of the outlot to the developers of the SBFC 3rd Addition and
SBFC 4th Addition plats. Hy-Vee will retain the remainder of the parent parcel, which will be further
subdivided and sold to developers of commercial projects at a future date. The original plat of SBFC 4th
Addition included the remaining portion of the parent parcel as an outlot. This required Hy-Vee to sign a
fee owner consent to the SBFC 4th Addition development contract. After City Council approval of the
original SBFC 4th Addition final plat at their July 17th meeting, Hy-Vee informed City staff that they did not
want to be a signatory to the development contract. As an alternative, Hy-Vee representatives have
submitted an administrative subdivision application to split Outlot A, SBFC 1st Addition into three parcels:
one parcel each for the SBFC 3rd Addition and SBFC 4th Addition final plats and one parcel that they will
retain for future platting and development.

RESOLUTION APPROVING THE FINAL PLAT OF
SPIRIT OF BRANDTJEN FARM COMMERCIAL 4TH ADDITION
WHEREAS, the owner of the plat described as Spirit of Brandtjen Farm
Commercial 4th Addition has requested approval of a revised final plat; and
WHEREAS, the revised final plat meets Subdivision Ordinance requirements and
is consistent with the Spirit of Brandtjen Farm Master Planned Unit Development Stage
Plan Agreement dated October 17, 2005.
NOW, THEREFORE, BE IT RESOLVED by the Lakeville City Council:
1. The revised final plat of Spirit of Brandtjen Farm Commercial 4th Addition is
hereby approved subject to the revised development contract and security
requirements.
2. The Mayor and City Clerk are hereby directed to sign the final plat mylars and
the revised development contract.
3. The City Clerk is directed to file a certified copy of this resolution with the
Dakota County Recorder.
