OVERVIEW Gulnar, LLC representatives have submitted an application for the final plat of one lot and one block to be known as First Park Lakeville 4th Addition. Gulnar, LLC (a/k/a Globus Transport) is a trucking and transport company now located in Savage, MN. In conjunction with the proposed final plat, the vacation of a public drainage and utility easement is also being requested. The easement to be vacated will be replaced by a new easement with the final plat of First Park Lakeville 4th Addition. The preliminary plat of First Park Lakeville, consisting of 10 industrial lots, was approved in 2008. The Planning Commission held a public hearing in consideration of the easement vacation at their August 17, 2017 meeting. There was no public comment at the public hearing. The Planning Commission recommended unanimous approval of the easement vacation subject to two stipulations. The First Park Lakeville preliminary and final plat was approved in 2008. The preliminary plat consisted of 10 lots and seven outlots and the final plat consisted of one lot and six outlots. The subject property, Outlot E, First Park Lakeville, totals 4.75 acres, was preliminary graded in 2008 and includes modest topography that drains from west to east over the site. The First Park Lakeville preliminary and final plat totaled 140 acres and abuts 215th Street (CSAH 70) to the north, Dodd Bouelvard (CSAH 9) to the west, Dick’s Sanitation and Metropolitan Airports Commission property to the east and Eureka Township to the south. Easement Vacation. A 50 foot wide public drainage and utility easement runs parallel to the south boundary of the subject property that was platted with the First Park Lakeville final plat in 2008. This easement must be vacated upon final plat of Outlot E and reestablished with the final plat of First Park Lakeville 4th Addition. All utility companies with a potential interest in the easement vacation have been notified. No utility companies have responded with opposition. Zoning. The zoning of the property is I-1, Light Industrial District which allows industrial land uses such as that proposed by Globus Transport. The proposed use of the property as a trucking and warehouse facility is a permitted use in the I-1 District. Lot Area. The proposed Lot 1, Block 1, First Park Lakeville 4th Addition totals 4.75 acres which meets the minimum 30,000 square feet for a lot in the I-1 District. Lot Width. The proposed Lot 1, Block 1, First Park Lakeville 4th Addition includes a lot width of 519 feet which meets the minimum 100 foot lot width in the I-1 District. Outlots. There are no outlots proposed with the First Park Lakeville 4th Addition final plat. Access. Lot 1, Block 1, First Park Lakeville will be accessed from Humboldt Road. 3 Streets & Right-of-Way. All streets adjacent to First Park Lakeville 4th Addition are constructed and no further right-of-way dedication is required. Park Dedication and Trails. The City’s Parks, Trails and Open Space Plan does not identify any park land or trail development in the vicinity of the First Park Lakeville 4th Addition final plat. The developer must pay a cash fee in lieu of park land with the final plat. The park dedication fee is $4,558 per acre for a total park dedication cash fee of $21,650.50. Tree Preservation. There are no significant trees in the First Park Lakeville 4th Addition final plat area. Wetlands. There are no wetlands identified in the First Park Lakeville 4th Addition final plat. Grading, Drainage and Erosion Control. The final plat plans include grading, drainage and erosion control plans. Grading, drainage and erosion control is discussed in more detail in the August 4, 2017 engineering memo. Building. The building is proposed to be 48,000 square feet in area and 30 feet in height. The building will be constructed of pre-cast concrete exposed aggregate wall panels. The proposed exterior materials meet zoning ordinance requirements. Setbacks. Setback requirements for an industrial lot in the I-1 District are noted below: Yard Front Side Interior Rear Setbacks 40 feet 10 feet 30 feet The proposed office/warehouse building meets the I-1 District setback requirements. Loading Docks. The building proposes 14 loading docks and three drive-through doors on the south side of the building. Parking. The 48,000 square foot building will include approximately 3,000 square feet of office space and 45,000 square feet of warehouse space. Total required parking spaces for the building will be 55. The developer is proposing to defer 28 of the 56 proposed parking spaces as allowed by the Zoning Ordinance. The parking aisles, spaces and dimensions meet Zoning Ordinance requirements. The parking deferment will be reviewed and approved administratively. 4 RECOMMENDATION Planning Department staff will review and is authorized to approve the site plan and parking deferment applications administratively. The Planning Commission is charged with conducting the easement vacation public hearing and forwarding a recommendation to the City Council. The City Council will act on the final plat application and easement vacation at a future date. The First Park Lakeville 4th Addition easement vacation and final plat are consistent with the approved preliminary plat and comply with the requirements of the Zoning and Subdivision Ordinances. SITE PLAN REVIEW A site plan was submitted for Lot 1, Block 1, First Park Lakeville 4th Addition. The site plan features a 48,000 square foot warehouse with office space and parking lot. Parking for 28 automobiles, including 2 designated handicapped spaces, and 32 proof of parking spaces, has been provided in a paved parking lot. Two access drives from Humboldt Road will be constructed for access to the parking lot. The parking lot includes parking areas for 226 semi-trailers. A final site plan must be submitted and reviewed prior to the issuance of a Building Permit for Lot 1, Block 1, First Park Lakeville 4th Addition. The wastewater from the proposed site will be conveyed to the Elko/New Market interceptor and then to the Empire Wastewater Treatment Plant. The existing MCES-owned downstream facilities are adequate to convey the wastewater generated by the proposed development. The Elko/New Market interceptor is located within an existing drainage and utility easement along the south 30-feet of the parcel. The Developer proposes to extend an existing private sanitary sewer service that connects to the Elko/New Market interceptor to provide sewer service to the development. The Developer shall apply for a direct connection permit from the METC for the connection to the sanitary sewer and any casting adjustments necessary to the existing manholes located within the parent parcel. The private water service will be extended through the site to provide domestic and fire suppression service for the proposed building. DDRRAAIINNAAGGEE AANNDD GGRRAADDIINNGG First Park Lakeville 4th Addition is located within subdistrict SC-8A, of the South Creek District of the City’s Comprehensive Water Resources Management Plan. The First Park Lakeville stormwater management plan included the runoff generated from the proposed development of the parent parcel. The plan was designed to meet the water quality, water quantity, and on-site infiltration requirements of the City of Lakeville in 2008. Due to more accurate rainfall data, the Developer has updated the stormwater management model to ensure that the downstream stormwater management basins still have sufficient storage to treat the runoff generated from the development. The City has completed a review of the updated model and has determined that the existing system was constructed to treat the stormwater runoff generated from the site, and therefore no additional stormwater improvements are required by the Developer. The grading specifications shall indicate that all embankments meet FHA/HUD 79G specifications. The Developer shall certify to the City that footings placed on fill material are appropriately constructed. A footing and foundation inspection permit will not be issued until a soils report and an as-built certified building pad survey have been submitted and approved by City staff. A National Pollution Discharge Elimination System General Stormwater Permit for construction activity is required by the Minnesota Pollution Control Agency for areas exceeding one acre being disturbed by grading. A copy of the Notice of Stormwater Permit Coverage must be submitted to the City upon receipt from the MPCA. SSTTOORRMM SSEEWWEERR Development of First Park Lakeville 4th Addition includes the construction of privately owned and maintained storm sewer systems, which will collect and convey stormwater runoff generated from within the development to the existing stormwater management basin in Outlot D, First Park Lakeville. The Trunk Storm Sewer Area Charge has not been collected on the parent parcel and must be paid with the final plat. The Trunk Storm Sewer Area Charge is calculated as follows: 207,188.00 s.f. x $0.250/s.f. = $51,797.00 Area of Lot 1, Block 1 Industrial Area Charge Total Trunk Storm Sewer Area Charge Final locations and sizes of all storm sewer facilities will be reviewed by City staff with the final construction plans. Based on this designation, there are no areas in the plat located within a Special Flood Hazard Area (SFHA), as determined by FEMA. EERROOSSIIOONN CCOONNTTRROOLL The Developer is responsible for obtaining a MPCA Construction Permit for the site as well as developing a SWPPP for the site prior to construction. The permit requires that all erosion and sediment BMPS be clearly outlined in a site’s SWPPP. Changes made throughout construction must be documented in the SWPPP. Additional erosion control measures may be required during construction as deemed necessary by City staff. Any additional measures required shall be installed and maintained by the Developer. SECURITIES The Developer shall provide a Letter of Credit as security for the Developer-installed improvements relating to First Park Lakeville 4th Addition.
