HomeMy WebLinkAboutItem 06.k• • ☐☒ Project #52390 Lakeville PE Parcel # 1 v1, 6.1.16 PERMANENT ROADWAY, DRAINAGE & UTILITY EASEMENT THIS EASEMENT AGREEMENT is made this ______ day of _________________, 20____, by and between the Metropolitan Council, a public corporation and political subdivision of the State of Minnesota (“Grantor”) and the _________________________ (“Grantee”) hereinafter collectively referred to as the “Parties”. NOW THEREFORE, for valuable consideration, the Parties agree as follows: 1. Grant of Easements. Grantor, the owner of the property depicted and described on the attached Exhibit A, (the “Property”) in consideration of One Dollar and other good and valuable consideration to it in hand paid, the receipt of which is hereby acknowledged, does hereby grant, bargain, sell and convey to Grantee, its permittees, successors and assigns, the following described easements: Permanent Roadway, Drainage & Utility Easement A permanent roadway, drainage & utility easement as depicted and legally described on the attached Exhibit A (the “Permanent Roadway, Drainage & Utility Easement”) over, under and across the Property for, without limitation, the installation, construction, repair, replacement, maintenance, use, and operation of a roadway, drainage facilities, utilities and other related improvements. The permanent easement includes the rights of ingress and egress over and across the Property by Grantee and its agents, employees, permittees contractors, and the public, for the use of the permanent easement area as may be necessary in the exercise of the rights and privileges herein granted. The above-described easement further includes the right to cut, trim, or remove from the easement area any trees, shrubs, undergrowth or other vegetation as in the Grantee’s judgment unreasonably interferes with the use of the easement area by Grantee, its permittee’s, successors and assigns, provided that Grantee shall take all reasonable precautions to prevent any damage to the Grantor’s property. Grantee shall not interfere with the use of Grantor’s property. Subsequent to the date of the permanent easement, Grantor, its heirs, successors and assigns, will not erect, construct, or create any building, improvement, obstruction, perpendicular utility crossing, or structure of any kind, either above or below the surface of the easement area or plant any trees, or stockpile construction debris or construction equipment, or change the grade thereof of the easement area without the express written consent of the Grantee. Grantor covenants that it is the lawful owner and is in lawful possession of the above described real estate and has lawful right and authority to convey and grant the easements described herein. 3. The provisions and conditions of this easement shall be binding upon and inure to the benefit of the parties hereto and their successors and assigns, and shall constitute a covenant running with the land.
