DEVELOPMENT CONTRACT AMENDMENT
Proposed Action
Staff recommends adoption of the following motion: Move to approve an amendment to the Lee Lake
Subdivision development contract.
Overview
Guardian Development of Wyoming, LLC representatives are requesting approval of an amendment to
the Lee Lake Subdivision development contract. The Lee Lake Subdivision final plat of three lots and one
outlot for the construction of a 120-unit apartment building, a 62,400-square foot enclosed self-storage
facility, and a future multiple tenant commercial building on property located east of Lee Lake, west of I-
35 and south of 162nd Street (CSAH 46) was approved by the City Council on July 17, 2017.
The amendment modifies the wording of one of the special provisions requirements of the development
contract concerning the removal of the billboard on the subject property. The approved development
contract requires removal of the billboard prior to the issuance of any building permits. The developer
has a lease with Lamar Advertising Company through February 28, 2018. Lamar has agreed to remove the
billboard by February 28, 2018 as stated in their September 8, 2017 letter. The developer would like to
start construction on the apartment building in the next couple of weeks so they have requested that
removal of the billboard be required prior to the issuance of a temporary or full certificate of occupancy
instead.
