PETREE AS AN AUTHORIZED AGENT TO SEEK REIMBURSEMENTS FROM THE PETROLEUM TANK RELEASE CLEANUP FUND Proposed Action Staff recommends adoption of the following motion: Move to designate Christopher J. Petree as an authorized agent to seek reimbursements from the Petroleum Tank Release Cleanup Fund. Overview The Minnesota Legislature established the Petroleum Tank Release Cleanup Fund (Petrofund) to reimburse eligible applicants for reasonable and necessary costs they incur in responding to a petroleum tank leak. As a result of the demolition of the Scheffler property at 202nd Street and Dodd Boulevard, a leak from an inground petroleum tank was discovered that required remediation by the City. Action to remediate the tank leak has been taken and reimbursement for eligible costs are being sought. In accordance with Minnesota Rule 2890.4400, Subp. 4C. the application must be signed by “a principal executive officer or ranking elected official, or by a duly authorized representative or agent of the principal executive officer if the representative or agent is responsible for the overall operation of the facility that is the subject of the application.” In this case, Mr. Petree, as Public Works Director, has been responsible for actions associated with the demolition of properties throughout the City, including the Scheffler property, meeting the requirements of the rule. Staff recommends approval. Primary Issues to Consider • Why is this designation necessary? The Minnesota Department of Commerce requires proof of authority to sign the application before proceeding with the process to determine reimbursement. Supporting Information • None. PETREE AS AN AUTHORIZED AGENT TO SEEK REIMBURSEMENTS FROM THE PETROLEUM TANK RELEASE CLEANUP FUND WHEREAS, a petroleum tank leak was discovered during demolition of the Scheffler property at 202nd Street and Dodd Boulevard that required remediation by the City and was eligible for reimbursement from the Petroleum Tank Release Cleanup Fund, and WHEREAS, Christopher J. Petree, as Public Works Director, has been responsible for the demolition of properties throughout the City, including the Scheffler property, NOW, THEREFORE, BE IT RESOLVED that Christopher J. Petree is duly designated as an authorized agent in accordance with Minnesota Rule 2890.4400, Subp. 4C. to sign for and seek reimbursement of eligible costs for the remediation.
