Home My WebLink AboutItem 06.f Date: Item No. RESOLUTION CERTIFYING SPECIAL CHARGES TO THE COUNTY AUDITOR-TREASURER Proposed Action Staff recommends adoption of the following motion: Move to approve Resolution Certifying Special Charges to the County Auditor-Treasurer. Overview On May 3, 2017, the City went before the District Court to request approval of expenses incurred in enforcing the City’s order for removal of hazardous buildings pursuant to Minn. Stat 463.21 & 463.22 on properties located at 11311 178th Street West and 6649 167th Street. The District Court ordered that the City’s legal costs of removal and correction of the hazardous conditions in the amount of $9,350.62 and $9,764.14, respectively, were approved and directed the City that if the property owners did not pay the total balance of these charges by October 1, 2017, the City could pursue certifying the amount of the expenses to the Dakota County Auditor for entry on the tax rolls of the county as a special charge against the property. As of the date of this council report the City has not received any payments related to either of these properties. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lakeville: Assessment No. 1362 in the amount of $19,114.76 relating to the certification of unpaid legal charges is hereby approved. The proposed assessment (Exhibit A), a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute a special assessment against the lands named therein. The owner of any property so assessed may, at any time prior to certification of the assessment to the County Auditor, pay to the City Treasurer the whole of the assessment on such property. A copy of this resolution, together with the assessment roll, is to be forwarded to the Dakota County Treasurer/Auditor for collection with other taxes.
