HomeMy WebLinkAboutItem 06.n Date: Item No. ORDINANCE AMENDING TITLE 3, CHAPTER 8 OF THE CITY CODE CONCERNING MIXED MUNICIPAL SOLID WASTE AND RECYCLABLE MATERIAL COLLECTORS Proposed Action Staff recommends adoption of the following motion: Move to adopt ordinance amending Title 3, Chapter 8, of the Lakeville City Code concerning mixed municipal solid waste and recyclable material collectors. Overview For nearly three decades, the City of Lakeville has limited the number of licenses issued to trash haulers. Ordinance No. 362 adopted in December of 1988 limited the total number of licenses to nine. In 1999 the number of licenses was reduced to six. The ordinance was later amended to create two different classes of license, a residential-only (Class A) license and a commercial/multiple family (Class B) license. Currently, the limit on the number of Class A licenses is six, and there is no limit on the number of Class B licenses. Of the complaints staff receives, high among them is the concern from residents about the number of trash haulers that travel our city streets. There is also concern from staff regarding heavy truck impacts on residential streets from multiple haulers. In the past when a license has become available, previous Councils have taken that opportunity to reduce the overall number of available licenses to incrementally address these concerns. GarbageMan-Lakeville held a Class A license in 2017. The business was recently sold to Waste Management, which also has a Class A license. This scenario provides an opportunity to reduce the number of licensed residential haulers from six to five. Primary Issues to Consider • Two local residential haulers have expressed an interest in applying for the sixth Class A license. They are Nitti Sanitation/Lightning Disposal and Highland Sanitation. Section 3-8-7 of the Lakeville City Code is amended to provide as follows: B. Limitation on Licenses: 1. No more than five (5) class A licenses may be in force at any time, except that all persons licensed by the city on December 18, 2017, and continuously thereafter may be relicensed and licenses shall be allocated first to such persons. SECTION 2. This ordinance shall be effective immediately upon its passage and publication.
