HomeMy WebLinkAboutItem 03 HRA Date: February 20, 2018 Item No. ACCEPT THE ACQUISITION OF DAKOTA COUNTY RIGHT-OF-WAY PARCELS AND AUTHORIZE CONVEYANCE OF PARCEL OWNERSHIP TO CITY OF LAKEVILLE Proposed Action Staff recommends adoption of the following motion: Move to approve a resolution accepting the acquisition of right-of-way parcels from Dakota County and authorizing the conveyance of parcel ownership to the City of Lakeville. Overview The City of Lakeville partnered with the Minnesota Department of Transportation, Dakota County and the City of Burnsville on construction of the Interstate 35 and County State Aid Highway (CSAH 46) interchange in the mid-1990s. The County acquired right-of-way per separate joint powers agreements (JPA) with the partnering agencies (County Project No. 46-05). To align the parcels with the appropriate roadway authorities, the County is conveying the excess right-of-parcels to the respective partnering agencies. Per the terms of the JPA, the parcels are to be conveyed to the Lakeville Housing and Redevelopment Authority (HRA). A portion of the parcels conveyed by the County to the HRA is proposed to be included in development of City Property (Eugene Fredrickson Addition). To facilitate the acquisition of land from the County and the development of City property, and to align the remaining parcels with the local roadway authority, City staff recommends the HRA convey the property to the City of Lakeville. Primary Issues to Consider • The City of Lakeville is responsible for the ownership and maintenance costs of the acquired parcels. Supporting Information • Resolution Financial Impact: None Budgeted: Y☐ N☒ Source: Related Documents: Dakota County Road Right of Way Map Nos. 146 and 147 Envision Lakeville Community Values: Design that Connects the Community Report Completed by: Zach Johnson, City Engineer 196134v1 1 HOUSING AND REDEVELOPMENT AUTHORITY IN AND FOR THE CITY OF LAKEVILLE, DAKOTA COUNTY, STATE OF MINNESOTA RESOLUTION NO. 18- RESOLUTION APPROVING THE ACQUISITION OF PROPERTY FROM DAKOTA COUNTY AND CONVEYANCE OF PROPERTY TO THE CITY OF LAKEVILLE WHEREAS, Dakota County (“County”) is the fee owner of property legally described on the attached Exhibit “A” (“Property”) that it acquired in connection with its co-petition with the Housing and Redevelopment Authority in and for the City of Lakeville (“HRA”), for acquisition of right-of-way for County Project No. 46-05; and WHEREAS, the County has determined that the Property is no longer needed for right-of- way purposes and agreed to vacate its right of way and convey it to the HRA by a quit claim deed; WHEREAS, the City has entered into a Purchase Agreement with The Driessen Group (“Purchase Agreement”) for conveyance of parcels abutting the Property (“City Property”) and desires to include a portion of the Property in the Purchase Agreement to allow for development of the City Property and Property (collectively, the “Development Property”); WHEREAS, the Purchase Agreement contemplates that following the sale of the Development Property to The Driessen Group, the City will then lease the liquor store located at 16179 Kenrick Avenue; and WHEREAS, to facilitate the conveyance by the City and development of the Development Property, the HRA proposes to convey the Property to the City. NOW, THEREFORE, BE IT RESOLVED by the Housing and Redevelopment Authority in and for the City of Lakeville, Minnesota as follows: 1. The acquisition of the Property from the County by quit claim deed is approved; 2. The conveyance of the Property to the City by quit claim deed is also approved; 3.
