Subject: Request to Review Food Truck Ordinance Approved in 2017
The City Council adopted an ordinance on June 5, 2017 to regulate the use of food trucks in
the Downtown. A copy of that ordinance is attached. Since that time, the City has issued
permits for four different food trucks to come Downtown on six different occasions. Five of
the occasions occurred at Angry Inch Brewing and one occurred at the Dakota Curling Club.
The City has recently received a request from Jon Erickson, Owner of Angry Inch Brewing to
consider several changes to the current ordinance. The requested changes include:
• More flexibility on days food trucks are allowed in Downtown
(The current ordinance allows food trucks on Fridays and Saturdays between the hours of
7:00 a.m. to 10:00 p.m.)
• Offer the option for an annual permit to allow food trucks to come Downtown
multiple times each year
(The current ordinance requires a permit on each occasion a food truck comes to
Downtown. The current permit fee is $50 per occasion.)
• Re-open the discussion about location(s) allowed for food trucks
(The current ordinance only allows food trucks to be located on private or public parking
lots with the written consent of the property owners.)
Angry Inch is requesting that food trucks be allowed to park on Upper 208th Street
adjacent to their patio.
• Reconsideration of the $2 million insurance requirement
(This amount was originally recommended however the City Attorney has recently
indicated that $1 million would probably be sufficient and is consistent with what most
cities require.)

City staff recently met to discuss the administration of the current ordinance. One provision
of the current ordinance that staff is recommending, is to enhance the requirement for
inspection of food trucks by Fire Department staff. This process is done in conjunction with
the food trucks that come to Lakeville during Pan-O-Prog and should be extended to food
trucks that come into the City during other times of the year. The current ordinance indicates
that the food trucks “may” be inspected by the Fire Department prior to operation. Staff is
recommending that this be changed to “shall.” This is proposed to occur prior to or in
conjunction with the issuance of the permit for the food truck. It will be required only once a
year or season so if trucks come to Lakeville more than once a year, they will only need a Fire
Department inspection the first time.
Staff is also recommending that the same permitting process and permits be used for food
trucks requesting to locate in City parks. Fire Department approval would still be required
and any application for a food truck to operate in a City park will require Park Department
review and approval.
Action Requested:
Provide direction to City staff on requested ordinance and licensing/permitting revisions.
