TOBACCO LICENSE VIOLATIONS
Proposed Action
Staff recommends adoption of the following motion: Move to approve Stipulation of Facts and
Civil Sanction with Hy-Vee, Inc., Badger Tire Groupe (Holiday 504) and SuperValu, Inc. (Cub
Foods) for tobacco license violations.
Overview
Hy-Vee, Inc., Badger Tire Groupe and SuperValu, Inc. were notified, in writing, of the alleged
tobacco license violations that occurred on March 1, 2018. Tobacco products were sold to a
person under the age of 18 at Hy-Vee Gas, Holiday 504 and Cub Foods. To avoid a public
evidentiary hearing before the City Council, the license holder may enter into a Stipulation of
Facts and Civil Sanction. All three license holders submitted a signed Stipulation of Facts and
paid the $300 civil sanction.
Primary Issues to Consider
• Is the presumptive penalty reasonable?
This violation constitutes the first violation for all three license holders pursuant to
Lakeville City Code 3-6-7.
