HomeMy WebLinkAboutItem 06.l Date: Item No. SPIRIT OF BRANDTJEN FARM 18TH ADDITION LANDSCAPE MAINTENANCE AGREEMENT Proposed Action Staff recommends adoption of the following motion: Move to approve a Landscape Maintenance Agreement for Spirit of Brandtjen Farm (SBF) 18th Addition. Overview The City Council approved the SBF 18th Addition final plat at a special meeting held on July 24, 2017. The final plat included 55 single family lots, 63 detached townhome lots, five HOA common area lots, one HOA community clubhouse lot, and 13 outlots. It was the first phase of the SBF 18th Addition preliminary plat of 190 single family lots and 63 detached townhome lots approved by the City Council on May 15, 2017. The SBF 18th Addition development contract/PUD agreement included language regarding the construction and maintenance of a greenway corridor trail and landscaping within Outlot D. The development contract/PUD agreement required the developer and City enter into a maintenance agreement for the greenway trail corridor landscaping once the design was completed. The greenway corridor trail and landscaping has now been finalized and the developer has signed the landscape maintenance agreement prepared by the City Attorney. Consistent with the agreement, the developer will maintain the landscaping within Outlot D, including: tree pruning, mulching, watering for the first three growing seasons, and mowing the grass turf adjacent to the trees and landscaping as shown on Exhibit A of the agreement. The City will maintain the grass turf between the trail and the landscape plantings. The landscape maintenance agreement has been reviewed by Engineering staff, the City Forester, and the Parks and Recreation Director.
