HomeMy WebLinkAboutItem 06.g Date: Item No. 2040 COMPREHENSIVE PLAN EXTENSION Proposed Action Planning Department staff recommends adoption of the following motion: Move to approve a resolution requesting additional time to complete the City’s 2040 Comprehensive Plan. Overview State Statute requires local government units to complete the current decennial Comprehensive Plan review (update) by December 31, 2018. State Statute also authorizes the Metropolitan Council to grant extensions, if requested by the local government unit by May 31, 2018. The draft 2040 Land Use Plan was finalized following comments and direction from the Planning Commission at their April 19th work session, the City Council at their April 23rd work session, and the Economic Development Commission at their April 24th meeting. The City’s engineering consultants are now preparing updates to the Transportation Plan, Sanitary Sewer Plan, Water Plan, and Water Resources Plan. In addition, the Downtown Development Guide is also being finalized and is scheduled for review and discussion at the May 29th City Council work session. In order to allow adequate time to complete the engineering related Comprehensive Plan documents and to allow for the six-month adjacent jurisdiction review, the City may need additional time beyond December 31st to complete the 2040 Comprehensive Plan process. Staff will continue to strive for completion by December 31st, but by requesting a three-month extension from the Metropolitan Council, it gives the City some leeway if additional time is needed. Primary Issues to Consider None Supporting Information Resolution Financial Impact: $ Budgeted: Y☐ N☐ Source: Related Documents: (CIP, ERP, etc.): Envision Lakeville Community Values: Design that Connects the Community Report Completed by: Daryl Morey, Planning Director May 21, 2018 CITY OF LAKEVILLE DAKOTA COUNTY, MINNESOTA RESOLUTION NO. 18-___ RESOLUTION REQUESTING ADDITIONAL TIME WITHIN WHICH TO COMPLETE COMPREHENSIVE PLAN “DECENNIAL” REVIEW OBLIGATIONS WHEREAS, Minnesota Statutes section 473.864 requires local governmental units to review and, if necessary, amend their entire comprehensive plans and their fiscal devices and official controls at least once every ten years to ensure comprehensive plans conform with metropolitan system plans and ensure fiscal devices and official controls do not conflict with comprehensive plans or permit activities that conflict with metropolitan system plans; and WHEREAS, Minnesota Statutes sections 473.858 and 473.864 require local governmental units to complete their “decennial” reviews by December 31, 2018; and WHEREAS, Minnesota Statutes section 473.864 authorizes the Metropolitan Council to grant extensions to local governmental units to allow local governmental units additional time within which to complete the “decennial” review and amendments; and WHEREAS, any extensions granted by the Metropolitan Council must be submitted by May 31, 2018, and must include a timetable and plan for completing the review and amendment; and WHEREAS, the [City] may not be able to complete its “decennial” review by December 31, 2018, for the following reasons: additional time needed for completion of updates to the Transportation Plan, Sanitary Sewer Plan, Water Plan, Water Resources Plan, and Downtown Development Guide following completion of the draft 2040 Land Use Plan and MUSA Map. WHEREAS, the City Council finds it is appropriate to request from the Metropolitan Council an extension so the City can have additional time to complete and submit to the Metropolitan Council for review an updated comprehensive plan and amend its fiscal devices and official controls. 2 NOW, THERFORE, BE IT RESOLVED BY THE CITY COUNCIL OF LAKEVILLE, MINNESOTA, AS FOLLOWS: 1. The Planning Director is directed to submit to the Metropolitan Council no later than May 31, 2018, an application requesting an extension to March 31, 2019. 2. The Planning Director is directed to include with the request a reasonably detailed timetable and plan for completing: (a) the review and amendment by March 31, 2019; and (b) the review and amendment of the City’s fiscal devices and official controls.
