BACKGROUND
Valvoline, LLC has submitted plans for development of a 1,620 square foot minor automobile
repair use to be platted as Lot 1, Block 1, Spirit of Brandtjen Farm Commercial 6thth Addition
(SBFC 6th), located south of 160th Street (CSAH 46) and east of Pilot Knob Road (CSAH 31). The
subject site is zoned PUD, Planned Unit Development District as approved by the City Council
on 20 June 2005. The proposed development requires consideration of applications for
approval of a PUD Development Stage Plan, preliminary plat, final plat, and vacation of existing
drainage and utility easements dedicated with Outlot A, SBFC Addition. A public hearing to
consider the applications has been noticed for the Planning Commission meeting on 7 June
2018.

ANALYSIS
SBF Land Use Plan. The SBF Land Use Plan guides the subject site for mixed use development
based on the uses allowed in the O-R District and C-3 District. Development of a minor auto
repair use within this area is consistent with SBF Land Use Plan.
Use. Development of the minor auto repair use is subject to the same requirements as apply
within the C-3 District in accordance with an amendment to the SBF PUD District approved in
2010. Section 11-73-7.A of the Zoning Ordinance establishes performance standards for minor
auto repair uses:
1. The entire site other than that taken up by a building, structure or plantings shall be
surfaced with a material to control dust and drainage which is subject to the approval of
the City Engineer.
2. A minimum lot area of twenty thousand (20,000) square feet and minimum lot width of
one hundred fifty feet (150').
3. A curb not less than six inches (6") above grade shall separate the public sidewalk from
motor vehicle service areas.
4. Parking or car magazine storage space shall be screened from view of abutting
residential districts in compliance with section 11-21-9 of the Zoning Ordinance.
5. No outside storage except as allowed in compliance with the Zoning Ordinance.
6. Sale of products shall be subject to a conditional use permit and be in compliance with
the Zoning Ordinance.
7. All conditions pertaining to a specific site are subject to change when the City Council,
upon investigation in relation to a formal request, finds that the general welfare and
public betterment can be served as well or better by modifying the conditions.
Surrounding Uses. The table below summarizes the existing and planned land uses
surrounding the subject site. The proposed minor auto repair use will be compatible with
surrounding land uses.

Lot Requirements. The SBF PUD District does not require minimum area or width for lots being
platted. The subject site is 44,464 square feet in area and is 227 feet wide to 160th Street (CSAH
46), which exceeds the lot requirements specific to minor auto repair uses established by
Section 11-73-7.A.2 of the Zoning Ordinance. A 30 foot setback for buildings and a 15 foot
setback for parking from public rights-of-way is required at the perimeter of the PUD District.
The site plan also indicates a reserve area abutting 160th Street (CSAH 46) to allow for a future
interchange. The proposed building and parking area comply with the lot requirements and
setbacks of the SBF PUD District and do not encroach into the CSAH 46 reserve area.
Building Design. The proposed building is subject to the exterior finish requirements outlined
by Section 11-17-9.D.1 of the Zoning Ordinance. The exterior finish of the building must utilize
a minimum of three Grade A materials listed in Section 11-17-9.B of the Zoning Ordinance or
brick for a minimum of 65 percent of the area of the building elevation. The remaining building
materials may be Grade B or C as defined in Section 11-17-9.B of the Zoning Ordinance for up to
35 percent of the wall area, or Grade D materials for up to 10 percent of the wall area. The
proposed building finish consists of brick and EIFS. Brick is a Grade A material but EIFS is a
Grade C material. The submitted architectural plans must be revised to incorporate three
Grade A materials or brick for 65 percent of the exterior finish of the principal building.
Landscape Plan. The submitted plans include a landscape plan for proposed plantings to be
installed within the subject site. The landscape plan provides for a mix of shade and evergreen
trees in the yards to the east and west of the building and ornamental trees along the south lot
line. The landscape plan must be revised to provide for installation of shade trees in the yard
north of the proposed building along 160th Street (CSAH 46). There are also shrubs and
perennials to be planted at the building foundation and the parking islands to the front and
sides of the off-street parking stalls. The proposed plantings comply with the size
requirements specified by Section 11-21-9.C.1 of the Zoning Ordinance.
Access. The subject site is proposed to be accessed by a private drive that extends across
Outlot A, SBFC 1st Addition from the east-west private drive extending east to Elmhurst Drive.
Plans for the private drive include a 30 foot wide paved section with concrete curb. Provision
for a pedestrian connection must be provided on the east side of the proposed private
driveway within Lot 1, as well as the east side of the proposed private driveway south of Lot 1
and the north side of the east-west private drive along the south line of Outlot A at such time as
the lots abutting the private drives are final platted. The design and construction of the
proposed private drive is subject to review and approval of the City Engineer. The proposed
private drive must be overlaid by an ingress/egress easement.

Service Bays. The proposed building has two service bays for performing oil changes and other
minor auto repairs. Vehicles enter the building from the south and exit to the north, then turn
left to exit the site via a one-way drive aisle to the west of the building. There is space for
stacking three cars behind each service bay. Additional off-street parking is located to the east
of the principal building.
Off-Street Parking. The table below provides the calculation of off-street parking
requirements of Section 11-19-13 of the Zoning Ordinance for the minor auto repair use:

The site plan provides for 10 off-street parking stalls including one disability accessible stall.
The proposed parking stalls are dimensioned as 9 feet wide and 20 feet deep accessed by a 24
foot wide drive aisle. The parking area is surfaced with asphalt and surrounded by concrete
curb and interior islands. The proposed off-street parking provided on the site plan complies
with the provisions of Section 11-19-7.I of the Zoning Ordinance, as well as Section 11-73-7.A.3
of the Zoning Ordinance specific to minor auto repair uses.
Signs. The proposed use is subject to the sign allowances applicable within the C-3 District
established by Section 11-23-19.E of the Zoning Ordinance. A sign permit issued by the Zoning
Administrator is required prior to placement of any sign upon the lot.
Wall signs. The subject site is allowed wall signs up to 100 square feet on two
elevations. The submitted plans indicate that there is a 45 square foot sign affixed to
the north and west elevations and a 31 square foot sign affixed to the south elevation.
There are also two directional signs above the service bays that are 14 square feet in
area that due to the incorporation of a logo constitute additional wall signs. The area of
the proposed signs comply with the allowances established by the Zoning Ordinance,
but three of the five proposed wall signs must be removed from the building.
Freestanding Sign. The submitted plans indicate a freestanding sign to be located
northeast of the principal building. The sign is specified to be a monument type sign
with a 44 square foot display affixed to it. The area of the proposed sign complies with
the limits established for the C-3 District. Details regarding the height and construction
of the proposed monument sign must be submitted with application for a sign permit.
The proposed freestanding sign is setback more than the 15 feet from a property line
required by Section 11-23-21 of the Zoning Ordinance and is outside of the CSAH 46
reserve area.
Exterior Lighting. The submitted plans include an exterior lighting plan indicating the location
and illumination pattern of proposed exterior lighting. Proposed fixtures have a 90 degree
horizontal cut-off and the intensity of the proposed exterior lighting complies with the
requirements of Section 11-16-17 of the Zoning Ordinance.

Waste Storage. The submitted plans indicated there is an enclosure for exterior trash and
recycling container storage at the southwest corner of the subject site. Section 11-18-11.B of
the Zoning Ordinance requires an enclosure for exterior trash or recycling containers must be
constructed materials consistent with those used on the principal building. The exterior
elevation plans include the enclosure, which is constructed of brick and EIFS consistent with the
principal building. With the required changes to the principal building, the percentage of brick
is to be increased to 65 percent of the north, east, and south elevations of the enclosure. The
landscape plan includes planting Leatherleaf Viburnum shrubs around the north, east, and
south sides of the enclosure, which will provide year-round screening.
Park Dedication. Final platting the subject site requires satisfaction of park dedication
requirements. The park dedication requirements will be met as a cash fee in lieu of land at
$5,400 per acre for commercial uses in accordance with the SBF Master PUD Agreement. The
subject site is 1.02 acres in area, which calculates as a park dedication cash fee of $5,508.
Easements. Section 10-4-4 of the Subdivision Ordinance requires a 10 foot wide drainage and
utility easement at the perimeter of all lots. The preliminary plat and final plat dedicate a 10
foot wide drainage and utility easement along the north and south lot lines, five foot wide
easements along the east and west lot lines, and oversized easements at the southwest corner
for the shared access drive. Existing easements platted with SBFC 1st Addition will be vacated
concurrent with the approval of the final plat. All proposed easements are subject to review
and approval of the City Engineer.
Grading Plan. The submitted plans include a grading, drainage, and erosion control plan. All
grading, drainage, and erosion control issues are subject to review and approval of the City
Engineer.
Utility Plan. The subject site is within the MUSA. Sanitary sewer and water utilities will be
extended to the subject site with the final plat and construction of the shared access drive
across Outlot A. All utility issues are subject to review and approval of the City Engineer.
Development Contract. The developer is required to enter into a development contract with
the City for the public and private improvements, payment of applicable fees, and posting of
required securities. The development agreement will be drafted by the City Attorney and the
developer is required to execute the development agreement prior to City Council approval of
the final plat in accordance with Section 10-5-1 of the Subdivision Ordinance.

CONCLUSION
The proposed PUD Development Stage Plan for Valvoline Instant Oil Change and the
applications for preliminary and final plat approval of Spirit of Brandtjen Farm Commercial 6th
Addition is consistent with the SBF Land Use Plan and the requirements of the SBF PUD District,
Zoning Ordinance, and Subdivision Ordinance. City staff and our office recommend approval of
the applications subject to the following conditions:
1 No outside storage shall be allowed except as allowed in compliance with the Zoning
Ordinance.
2. Sale of products other than those related to minor auto repair shall be subject to a PUD
Development Stage Plan amendment.
3. The submitted architectural plans shall be revised to incorporate three Grade A
materials or brick for 65 percent of the exterior finish of the principal building as
required by Section 11-17-9.D.1 of the Zoning Ordinance.
4. The landscape plan shall be revised to provide for installation of shade trees and shrubs
in the yard north of the proposed building along 160th Street (CSAH 46) consistent with
approved uses to the west in SBFC.
5. The design and construction of the proposed private drive is subject to review and
approval of the City Engineer, and the following:
a. A five-foot concrete sidewalk shall be constructed on the east side of the private
drive within Lot 1.
b. An ingress/egress and sidewalk easement shall be recorded over the private
drive.
6. The site plan shall be revised to provide for a sidewalk connection from the principal
building to the sidewalk to be constructed on the east side of the private drive.
7. The plans for signs on the subject site shall be revised as follows:
a. Three of the five proposed wall signs shall be removed from the building.
b. Details regarding the construction of the proposed monument sign, including
height, shall be submitted.
c. All signs require issuance of a sign permit approved by the City.

8. The plan for the waste container enclosure shall be revised to increase the percentage
of brick to 65 percent of the area of the north, east, and south elevations.
9. The developer shall pay a park fee in lieu of land dedication of $5,508 in accordance
with the SBF Master Development Agreement.
10. All easements are subject to review and approval of the City Engineer.
11. All grading, drainage, and erosion control plans are subject to review and approval of
the City Engineer.
12. All utility plans are subject to review and approval of the City Engineer.
13. The developer shall execute a development agreement drafted by the City Attorney
prior to City Council approval of the final plat.

Cushman Wakefield, on behalf of Valvoline Instant Oil Change, has submitted a preliminary
and final plat named Spirit of Brandtjen Farm Commercial 6th Addition and site plans to
construct an instant oil change facility on Lot 1, Block 1. The proposed development is located
south of and adjacent to 160th Street (CSAH 46), north of 162nd Street, east of Pilot Knob Road
(CSAH 31), and west of Elmhurst Lane. The parent parcel consists of a portion of Outlot A,
Spirit of Brandtjen Farm Commercial 1st Addition. The development is zoned PUD, Planned
Unit Development.
The preliminary and final plats consist of one lot within one block on 1.02 acres.

The Spirit of Brandtjen Farm Commercial 6th Addition site consists of 1.02 acres of
undeveloped land. The property generally slopes west to east. There are no wetlands or trees
on the property.
EEAASSEEMMEENNTTSS
The parent parcel contains existing public Drainage and Utility Easements dedicated with the
Spirit of Brandtjen Farm Commercial 1st Addition plat, which will be vacated with the final
plat. The Drainage and Utility Easement will be re-dedicated with the final plat over the area
containing existing public utilities located on the parent parcel.
SSTTRREEEETT AANNDD SSUUBBDDIIVVIISSIIOONN LLAAYYOOUUTT
160th Street (CSAH 46)
Spirit of Brandtjen Farm Commercial 5th Addition is located south of and adjacent to 160th
Street, a minor arterial County roadway. 160th Street is constructed as a four-lane divided
roadway. A ten-foot bituminous trail will be constructed on the south side of the roadway from
Pilot Knob Road to Eagleview Drive with the development of Outlots K and L, Spirit of Brandtjen
Farm Commercial 2nd Addition. The current Dakota County Plat Review Needs Map dated April 16,
2013 designated 160th Street as a future six-lane divided roadway with a half right-of-way
requirement of 100-feet adjacent to the plat. The final plat identifies a reserve area adjacent to
160th Street required by Dakota County for a future interchange. The Dakota County Plat
Commission reviewed the plat at its May 14, 2018 meeting and recommended the development
for approval.
SSIITTEE PPLLAANN RREEVVIIEEWW
Spirit of Brandtjen Farm Commercial 6th Addition includes the construction of a 1,620 square-
foot office building with attached oil change facility on Lot 1, Block 1. The site plan includes
an interior drive-thru aisle providing access to the facility with adequate stacking to maintain
proper site circulation.
Access to the site will be provided from a private roadway south of the parent parcel, which
has not yet been constructed. This private roadway is proposed to be constructed by Hy-Vee,
through a Site Improvement Performance Agreement (SIPA). The SIPA must be approved by
the City Council prior to consideration of the Spirit of Brandtjen Farm Commercial 6th Addition
final plat. An access driveway is proposed to connect to the north extent of the private

roadway. A private cross access easement and maintenance agreement is memorialized on
the parent parcel in the location of the proposed shared roadway and utilities along the west
side of Lot 1, Block 1. The parking lot is adequately sized to allow truck circulation into and
out of the site and will provide capacity to meet the requirements of the City’s Zoning
Ordinance.
The landscaping plan provides for several types of trees and shrubs in landscaped areas
around the building and parking lot. Landscaping areas around the building will be sodded.
CCOONNSSTTRRUUCCTTIIOONN AACCCCEESSSS
Construction traffic access and egress for grading, utility and site construction shall be from
the private access drive in the location of the private roadway extension.
PPAARRKKSS,, TTRRAAIILLSS AANNDD SSIIDDEEWWAALLKKSS
Development of Spirit of Brandtjen Farm Commercial 6th Addition includes the construction
of private sidewalks. Private sidewalks will be constructed to provide access from the site to
other uses in the Spirit of Brandtjen Farm Commercial development.
The Park Dedication fee has not been collected on the parent parcel and will be satisfied
through a cash contribution with the final plat. The Park Dedication fee for commercial areas
in Spirit of Brandtjen Farm is $5,400.00 per acre, consistent with the Spirit of Brandtjen Farm
Master PUD Agreement.

Spirit of Brandtjen Farm Commercial 6th Addition is located within subdistrict NC-20060 of the
North Creek sanitary sewer district, as identified in the City’s Comprehensive Sewer Plan.
Wastewater will be conveyed to the MCES Farmington Interceptor and continue to the
Empire Wastewater Treatment Facility. The downstream facilities have sufficient capacity to
serve the proposed commercial development.
Sanitary sewer to serve the development will be conveyed downstream via sanitary sewer
located on Outlot A, Spirit of Brandtjen Farm Commercial 1st Addition, which has not yet been
constructed. This sanitary sewer is proposed to be constructed by Hy-Vee, through a Site
Improvement Performance Agreement (SIPA). The SIPA must be approved by the City Council
prior to consideration of the Spirit of Brandtjen Farm Commercial 6th Addition final plat. The
Developer shall connect to public sanitary sewer from a proposed stub along the proposed

provide sanitary sewer service to the development.
A sanitary sewer connection permit will not be issued until the downstream sanitary sewer
has been tested and accepted by the City.
The Sanitary Sewer Availability Charge has not been collected on the parent parcel and shall
be collected with the Building Permit Application. The Sanitary Sewer Availability Charge will
be calculated at the rate in effect at the time of approval of the Building Permit Application, as
determined by the City’s Building Official.
WWAATTEERRMMAAIINN
Development of Spirit of Brandtjen Farm Commercial 6th Addition includes the extension of
private watermain to provide water service to the development.
Watermain to serve the development will be provided via private watermain located on
Outlot A, Spirit of Brandtjen Farm Commercial 1st Addition, which has not yet been
constructed. This watermain is proposed to be constructed by Hy-Vee, through a Site
Improvement Performance Agreement (SIPA). The SIPA must be approved by the City Council
prior to consideration of the Spirit of Brandtjen Farm Commercial 6th Addition final plat. The
Developer shall extend the private watermain within the site to provide water service for the
proposed improvements.
Final locations and sizes of all sanitary sewer and watermain facilities will be reviewed by City
staff with the final construction plans submitted with the building permit application. A cross
access easement and maintenance agreement is memorialized on the parent parcel for the
private utilities extending across multiple properties.
OOVVEERRHHEEAADD LLIINNEESS
There are no overhead utilities located adjacent to or within the parent parcel.
DDRRAAIINNAAGGEE AANNDD GGRRAADDIINNGG
Spirit of Brandtjen Farm Commercial 6th Addition is located within subdistrict NC-9C of the
North Creek Stormwater District as identified in the City’s Water Resources Management Plan.
Stormwater runoff generated from the Spirit of Brandtjen Farm Commercial 6th Addition
development will be conveyed via a proposed private storm sewer system along the east side
of the property. The storm sewer will be constructed within a private utility easement by Hy-
Vee through a SIPA. The stormwater management requirements for the parent parcel were
satisfied through stormwater management basins constructed with Spirit of Brandtjen Farm
Commercial 2nd Addition.

The final grading plan must indicate any proposed borrow areas in which the building
footings will be placed on fill material. The grading specifications must indicate that all
embankments meet FHA/HUD 79G specifications. A final certificate of occupancy shall not be
issued until an as-built certified grading plan has been submitted and approved by the City
Engineer.
Spirit of Brandtjen Farm Commercial 6th Addition does not contain more than one acre of site
disturbance, however because the project is part of a common development a National
Pollution Discharge Elimination System General Stormwater Permit for construction activity is
required from the Minnesota Pollution Control Agency.
SSTTOORRMM SSEEWWEERR
The development of Spirit of Brandtjen Farm Commercial 6th Addition includes the
construction of a private storm sewer system. The privately-owned and maintained storm
sewer will be located within Lot 1, Block 1 and will collect and convey stormwater runoff
generated from within the development to the private storm sewer system located at the
southeast corner of the property. A private cross access and maintenance agreement shall be
established with the final plat on the parent parcel for the private utilities extending across
multiple properties.
The Trunk Storm Sewer Area Charge has not been collected on the parent parcel and must be
paid with the final plat. The Trunk Storm Sewer Area Charge for Lot 1, Block 1 is calculated as
follows:

The Developer is responsible for obtaining a MPCA Construction Permit for the site as well as
developing and maintaining the SWPPP throughout construction phase. The permit requires
that all erosion and sediment BMPS must be clearly outlined in a site’s SWPPP. Changes made
throughout construction should be documented in the SWPPP.
Additional erosion control measures may be required during construction as deemed
necessary by City staff or the Dakota County Soil and Water District. Any additional measures
required shall be installed and maintained by the Developer.

The Developer shall provide a Letter of Credit as security for the Developer-installed
improvements relating to Spirit of Brandtjen Farm Commercial 6th Addition.
