SPIRIT OF BRANDTJEN FARM 20TH ADDITION FINAL PLAT
Proposed Action
Staff recommends adoption of the following motion: Move to approve: 1) a resolution approving the
Spirit of Brandtjen Farm 20th Addition final plat, and 2) a resolution establishing no parking areas.
Overview
Tradition Development (a/k/a SBF Development Corp.) representatives are requesting approval of the
Spirit of Brandtjen Farm (SBF) 20th Addition final plat of 62 single family lots located south of 162nd
Street and east of Eagleview Drive. This is the third phase of the SBF 18th Addition preliminary plat of
190 single family lots and 63 detached townhome lots approved by the City Council on May 15, 2017.
The SBF 18th Addition first phase final plat of 55 single family lots and 63 detached townhome lots was
approved by the City Council on July 24, 2017. The second phase final plat (SBF 19th Addition) of 44
single family lots was approved by the City Council on May 7, 2018. One phase of 29 single family lots
remains to be final platted.
The layout of the SBF 20th Addition final plat is consistent with the approved SBF 18th Addition
preliminary plat. In conjunction with the SBF 20th Addition final plat, a no parking resolution is
required consistent with the street designs approved with the SBF PUD.
Primary Issue to Consider
Why is an encroachment and maintenance agreement included with this final plat?
A publicly accessible, privately maintained trail and associated landscaping is proposed within Outlot B,
which is being deeded to the City because it contains a stormwater management basin. The encroachment
and maintenance agreement spells out the SBF homeowners association maintenance responsibilities for
this trail and landscaping.

RESOLUTION APPROVING THE FINAL PLAT OF
SPIRIT OF BRANDTJEN FARM 20TH ADDITION
WHEREAS, the owner of the plat described as Spirit of Brandtjen Farm 20th
Addition has requested final plat approval; and
WHEREAS, the preliminary plat was reviewed by the Planning Commission and
the Parks, Recreation and Natural Resources Committee and approved by the City
Council; and
WHEREAS, the final plat is consistent with the approved preliminary plat; and
WHEREAS, the final plat is acceptable to the City.
NOW, THEREFORE, BE IT RESOLVED by the Lakeville City Council:
1. The final plat of Spirit of Brandtjen Farm 20th Addition is hereby approved
subject to the development contract and planned unit development
agreement, the security requirements, and the terms and conditions of the
Spirit of Brandtjen Farm Master Planned Unit Development Stage Plan
Agreement dated October 17, 2005.
2. The Mayor and City Clerk are hereby directed to sign the final plat mylars, the
development contract and planned unit development agreement, and the
encroachment and maintenance agreement.
3. The City Clerk is directed to file a certified copy of this resolution with the
Dakota County Recorder.

RESOLUTION NO:
RESOLUTION DESIGNATING “NO PARKING” AREAS ON
DRAFT HORSE BOULEVARD, DRYDEN ROAD, AND DULUTH TRAIL
WHEREAS, the City Council for the City of Lakeville is authorized in accordance
with City Code to designate parking zones within the city, and
WHEREAS, the sections of Draft Horse Boulevard, Dryden Road, and Duluth
Trail will be constructed to allow a single traffic lane in each direction with parking on
one side only in Spirit of Brandtjen Farm 20th Addition, consistent with the approved
street sections in the Spirit of Brandtjen Farm planned unit development, and
WHEREAS, establishing “No Parking” areas on Draft Horse Boulevard, Dryden
Road, and Duluth Trail will discourage potential on-street parking, maintain sufficient
access to the traffic lanes, provide increased sight lines for drivers, and reduce the
interaction between vehicles and pedestrians.
NOW, THEREFORE, BE IT RESOLVED, that the west sides of Draft Horse
Boulevard and Duluth Trail, and the north side of Dryden Road shall be designated “No
Parking” anytime.

BACKGROUND
SBF Development Corporation has submitted application for final plat approval of Spirit of
Brandtjen Farm 20th Addition. The proposed final plat consists of 62 single family lots located
south of 162nd Street and west of future Diamond Path. The subject site is zoned PUD, Planned
Unit Development District as approved by the City Council on 20 June 2005. This is the third
phase of the SBF 18th Addition PUD Development Stage Plan and preliminary plat of 190 single
family lots and 63 detached townhome lots that was approved by the City Council on 15 May
2017. Twenty-nine (29) single family lots remain to be final platted.

ANALYSIS
Land Use. The SBF Land Use Plan (Page 3.4 of the SBF PUD Booklet) guides the area of SBF 20th
Addition for a range of Low-Medium Density Residential (3-6du./ac.) and Medium Density
Residential (6-8 du./ac.) land uses. The approved PUD Development Stage Plan for the subject

site is lower in density than that guided by the SBF Master Site Plan, but maintains the
minimum of 3.0 dwelling units per acre of density required by the Metropolitan Council for the
City’s overall 2030 Land Use Plan. The 62 single family lots within the proposed SBF 20th
Addition are consistent with the approved PUD Development Stage Plan in terms of number
and subdivision design.
Lot Requirements. The proposed 62 single family lots are required to comply with the
minimum standards for the respective cottage, traditional, or estate lot designation consistent
with the Section 7 of the SBF PUD Booklet, shown in the table below. Each lot has adequate
area within required minimum setbacks, also shown in the table below, to allow for
construction of a single family dwelling.

Streets. The final plat includes right-of-way for Draft Horse Boulevard between 162nd Street
and 165th Street, Dryden Road from its terminus in SBF 18th Addition to Draft Horse Boulevard,
and Duluth Trail south of Dryden Road to access Lot 5, Block 3. The right-of-way for these
streets is consistent with the approved preliminary plat and requirements for 52 foot wide
right-of-way and Street SC.3 in the SBF PUD Booklet. The street plans include construction of
five foot wide concrete sidewalks along both sides of all streets within the public right-of-way
which is also consistent with the street section designs within the SBF PUD Booklet. All street
construction plans are subject to review and approval of the City Engineer.
Landscaping. A landscape plan was approved with the PUD Development Stage Plan and
preliminary plat for the interior street boulevards, the yards abutting 162nd Street, and future
Diamond Path providing for a landscape buffer for double frontage lots. The landscape plan is
subject to review and approval of the City Forester. The developer will be required to provide a
security for installation of the landscaping within the proposed final plat as part of the
development agreement.
Park Dedication. No public park land will be dedicated to the City with the SBF 20th Addition
final plat. Park dedication requirements for the proposed final plat will be satisfied as a cash
fee in lieu of land to be paid with execution of the development agreement. The calculation of
the cash fee in lieu of land for SBF 20th Addition is to be in accordance with the formula
established by the SBF Master PUD Development Agreement:

Outlots. The table below summarizes the proposed outlots within the final plat:

There is a trail that goes through Outlot B between 162nd Street and Dryden Road. The trail is
not identified as a public trail corridor on the 2015 Parks, Trails, and Open Space Plan and does
not provide a corridor between major destinations. The trail is to be designated as a privately
maintained/publicly accessible trail by easement to the HOA. A trail easement to the HOA
providing for the trail must be recorded with the final plat.
Easements. The final plat illustrates drainage and utility easements at the perimeter of all of
the lots as required by Section 10-4-4 of the Subdivision Ordinance. All drainage and utility
easements are subject to review and approval of the City Engineer.
Grading Plan. The developer has submitted grading, drainage, and erosion control plans, which
are subject to review and approval by the City Engineer.
Utilities. The subject site is located within the current MUSA. A utility plan has been submitted
for extension of sanitary sewer and water services to the proposed SBF 20th Addition final plat.
All utility plans are subject to review and approval of the City Engineer.
Homeowners Association. Documents incorporating the SBF 20th Addition final plat as part of
the SBF Master Homeowners Association are required to be submitted and are subject to
review and approval by the City Attorney.
Development Agreement. Section 10-5-1.A of the Subdivision Ordinance requires the
developer to provide construction and warranty securities for the public improvements within
the SBF 20th Addition final plat that are to be outlined within a development agreement. The
development agreement will be drafted by the City Attorney and is to be executed by the
applicant prior to City Council consideration of the final plat.
CONCLUSION
The SBF 20th Addition final plat is consistent with the requirements of the SBF PUD District,
Zoning Ordinance, Subdivision Ordinance, and the SBF 18th Addition PUD Development Stage
Plan and preliminary plat. Our office and City staff recommends approval of the proposed
development subject to the conditions outlined below:
1. SBF 20th Addition shall be developed consistent with the approved SBF Master Plan, the
PUD booklet dated 20 June 2005 and the SBF 18th Addition PUD Development Stage
Plan/Preliminary Plat approved 15 May 2017.

2. The single family lots within SBF 20th Addition shall be subject to the requirements
established by the PUD Booklet for the lot designations approved with the PUD
Development Stage Plan as follows:

SBF Development Corporation has submitted a final plat named Spirit of Brandtjen Farm (SBF)
20th Addition. This is the third phase of the SBF 18th Addition Preliminary Plat approved by the
City Council on May 15, 2017. The proposed development is located south of and adjacent to

Drive. The parent parcels consist of Outlot C, Spirit of Brandtjen Farm 17th Addition, and

The final plat consists of 62 single family lots and four (4) outlots within four (4) blocks.

The site was previously a gravel processing operation. The gravel processing on the parent
parcels has been completed and the site encroachments have been removed.
The site was mass graded with the Spirit of Brandtjen Farm 18th Addition improvements.

162nd Street
SBF 20th Addition is located south of and adjacent to 162nd Street, a minor collector roadway
as identified by the City’s Transportation Plan. 162nd Street is constructed as a 36-foot wide
two-lane urban roadway, within 80-feet of right-of-way. 5-foot wide concrete sidewalks are
located along the north and south sides of the street.
Diamond Path (Future CSAH 33)
SBF 20th Addition is located west of and adjacent to Diamond Path, a future major collector
roadway as identified in the City’s Transportation Plan. The current Dakota County Road Plat
Review Needs Map identifies Diamond Path as a future three-lane undivided urban roadway
with center turn lanes or a two-lane divided urban County State Aid Highway with a ½ right of
way requirement of 60 feet. The Developer dedicated the necessary right-of-way with
previous phases of Spirit of Brandtjen Farm. Diamond Path adjacent to the plat will not be
constructed with the plat improvements and is not identified to be constructed in the current
City or County Capital Improvement Plan (CIP).
Draft Horse Boulevard
Development of Spirit of Brandtjen Farm 20th Addition includes the construction of Draft
Horse Boulevard, a local roadway. Draft Horse Boulevard will be extended providing a
connection between 165th Street and 162nd Street. Draft Horse Boulevard is designed as a 28-
foot wide urban roadway with a 5-foot wide concrete sidewalk along both sides of the street.
The Developer is dedicating 60-feet of right-of-way. The street and landscaped boulevard
design is consistent with the Spirit of Brandtjen Farm Planned Unit Development Plan.

Dryden Road
Development of Spirit of Brandtjen Farm 20th Addition includes the construction of Dryden
Road, a local roadway. Dryden Road is designed as a 28-foot wide urban roadway with a 5-
foot wide concrete sidewalk along both sides of the street. The Developer is dedicating 52-
feet of right-of-way. The street and landscaped boulevard design is consistent with the Spirit
of Brandtjen Farm Planned Unit Development Plan.
Duluth Trail
Development of Spirit of Brandtjen Farm 20th Addition includes the construction of Duluth
Trail, a local roadway. Duluth Trail is designed as a 28-foot wide urban roadway with a 5-foot
wide concrete sidewalk along both sides of the street. The Developer is dedicating 52-feet of
right-of-way. The Developer shall install a future street extension sign and barricades until the
roadway is extended in the future. The street and landscaped boulevard design is consistent
with the Spirit of Brandtjen Farm Planned Unit Development Plan.

Construction traffic access and egress for grading, utility and street construction for SBF 20th
Addition shall be restricted to a single entrance at 162nd Street, via Diamond Path.
Construction traffic from local roadways (Dryden Road and Draft Horse Boulevard to the

PARKS, TRAILS AND SIDEWALKS
Development of SBF 20th Addition includes the construction of public sidewalks. 5-foot wide
concrete sidewalks will be constructed along both sides of all streets.
The Park Dedication Fee has not been collected on the parent parcels and will be required to
be collected with the final plat, calculated as follows:

water service to the development. The 8-inch watermain will connect to and extend from an
existing 12-inch watermain within 162nd Street as well as 8-inch watermain along the local
street network.

by City staff with the final construction plans.

Spirit of Brandtjen Farm (SBF) is a planned unit development of which development began in
2005. The proposed development encompasses nearly all of the north half of Section 1,
Township 114, Range 20 and a substantial portion of the south half of said section. The initial
stormwater modeling and drainage plan for SBF, located on the south half of Section 1, was
prepared by Westwood Professional Services. The original design consisted of a main basin,
Spirit, surrounded by six National Urban Runoff Program (NURP) basins.
The Spirit basin design did not include a gravity outlet other than infiltration. A system of
pumps was incorporated into the design to serve three functions: 1) Irrigation supply, 2)
Recirculation for water features, and 3) Drawdown, if needed. During 2008, a decision was
made to not construct the recirculation features. As a result, the proposed pumping station
was not constructed, however, the pump station draw intake line was.
As development has continued, Spirit basin appears to have adequately infiltrated all runoff
from the development without the presence of the pumping system.
A gravel processing area had been in operation on the north half of Section 1 in excess of
forty years. As part of gravel operations years ago, a series of basins was constructed as wash
basins for sand processing. The operational need for these basins ended approximately in

2013 and a reclamation plan was prepared for the gravel processing area. As part of the
reclamation plan, the largest basin was measured and quantified, and incorporated into the
reclamation plan with intended use as a stormwater management basin. The basin is referred
to as Nordeast Basin.

SBF 20th Addition is located within the North Creek drainage district as identified in the City’s
Water Resources Management Plan. The plat is located within sub-districts NC-11A, NC-11B,
NC-11C and NC-13.
The proposed stormwater management plan is a regional plan that connects the 96 acres
within the Nordeast Basin drainage area. The proposed system utilizes the existing Nordeast
Basin for flood storage and infiltration, having peripheral National Urban Runoff Protection
(NURP) and stormwater collection systems. The pretreatment NURP basins are multi-celled.
The stormwater management system to serve SBF 20th Addition was constructed with
development of SBF 18th Addition.
A National Pollution Discharge Elimination System General Stormwater Permit for
construction activity is required by the Minnesota Pollution Control Agency for areas
exceeding one acre being disturbed by grading. A copy of the Notice of Stormwater Permit
Coverage must be submitted to the City upon receipt from the MPCA.
SSTTOORRMM SSEEWWEERR
Development of SBF 20th Addition includes the construction of a public storm sewer system.
Storm sewer will be installed to collect and convey stormwater runoff generated from the
streets and open space within the development. The storm sewer will convey the runoff to
the stormwater management basins within SBF. The constructed public storm sewer shall be
located within public right-of-way and/or public drainage and utility easements.
The Trunk Storm Sewer Area Charge has not been collected on the parent parcels and must
be paid at the time of final plat approval. The Trunk Storm Sewer Area Charge will not be
collected for the portions of SBF 20th Addition that drain directly to Nordeast.
The Trunk Storm Sewer Area Charge for the portion of SBF 20th Addition that does not drain to
Nordeast shall be paid with the final plat, calculated as follows:

The Developer will receive a credit to the Trunk Storm Sewer Area Charge for deeding Outlot
B to the City, consistent with City policy. The credit is based on the area of Outlot B at the rate
of $5,500 per acre. The credit will be applied to the final plat cash fees, calculated as follows:

EERROOSSIIOONN CCOONNTTRROOLL
The Developer is responsible for obtaining a MPCA Construction Permit for the site as well as
developing and maintaining the SWPPP throughout construction phase. The permit requires
that all erosion and sediment BMPS be clearly outlined in a site’s SWPPP. Changes made
throughout construction should be documented in the SWPPP.
Additional erosion control measures may be required during construction as deemed
necessary by City staff or the Dakota County Soil and Water District. Any additional measures
required shall be installed and maintained by the developer.
SECURITIES
The Developer shall provide a Letter of Credit as security for the Developer-installed
improvements relating to Spirit of Brandtjen Farm 19th Addition. Construction costs are based
upon estimates submitted by the Developer’s engineer on March 5, 2018.

The Developer shall post a security to ensure the final placement of iron monuments at

irons have been placed following site grading, street and utility construction.
CASH FEES
An $1,800 cash fee for traffic control signs is due with Spirit of Brandtjen Farm 20th Addition. If
the street signs are installed during frost conditions, the developer shall pay an additional
$150.00 for each street sign location.
A cash fee for one-year of streetlight operating expenses shall be paid at the time of final plat
approval and is calculated as follows:
