MOTOPRIMO INTERIM USE PERMIT
Proposed Action
Staff recommends adoption of the following motion: Move to approve the Motoprimo interim use
permit and adopt the findings of fact.
Overview
Lakeville Motoprimo representatives are requesting approval of an interim use permit for outdoor
sales and display of motorcycles and ATVs in conjunction with a building expansion at 16640
Kenrick Avenue. The expansion plans include a two level (main floor and basement) 30,000
square foot addition onto the north side of the existing 27,000 square foot building. The proposed
building expansion was identified on Lakeville Motoprimo’s original approved site plan. The
existing Motoprimo building was constructed in 2004.
The Planning Commission held a public hearing on August 2, 2018 to consider the interim use
permit request. The Planning Commission recommended unanimous approval subject to the six
stipulations listed in the July 27, 2018 planning report. There were no public comments at the
public hearing.
Primary Issues to Consider
Is the expansion and site plan consistent with the original 2003 plans? The site plan approved in
2003 identified the future expansion in the proposed location.

INTERIM USE PERMIT NO. 18-____
1. Permit. Subject to the terms and conditions set forth herein, the City of Lakeville
approves an interim use permit for Lakeville Motoprimo to allow outdoor sales and display
in the C-3, General Commercial District located at 16640 Kenrick Avenue.
2. Property. The permit is for the following described property located in the City of
Lakeville, Dakota County, Minnesota:
Lot 1, Block 1, Lakeville Motoprimo
3. Termination. The interim use permit allowing outdoor display and sales shall
terminate upon a change in occupancy of the building that does not include motorcycle or
ATV sales.
4. Conditions. The permit is issued subject to the following conditions:
a) Outdoor sales and display shall be restricted to the areas in front of the building
as identified on the approved site plan and shall occur only during business
hours.
b) Outdoor storage is not permitted.
c) A sign permit is required prior to the installation of any wall or freestanding
signs.
d) The total impervious surface area of the property shall not exceed 70%.
e) A $5,000 landscape escrow shall be submitted to guarantee completion of the
approved landscaping.

4. Expiration. This interim use permit shall expire unless the applicant commences
the authorized use within one year of the date this interim use permit, unless an extension
is approved by the Zoning Administrator.

MOTOPRIMO INTERIM USE PERMIT
FINDINGS OF FACT AND DECISION
On August 2, 2018 the Lakeville Planning Commission met at its regularly
scheduled meeting to consider the request of Motoprimo for an interim use permit to
allow outdoor sales and display in the C-3, General Commercial District located at
16640 Kenrick Avenue. The Planning Commission held a public hearing on the
proposed interim use permit preceded by published and mailed notice. The applicant
was present and the Planning Commission heard testimony from all interested
persons wishing to speak. The City Council hereby adopts the following:
FINDINGS OF FACT
1. The property is located in Planning District No. 1, Interstate 35/CR 50/Orchard
Lake and is classified as Commercial on the Comprehensive Land Use Plan.
2. The property is zoned C-3, General Commercial District.
3. The legal description of the property is:
Lot 1, Block 1, Lakeville Motoprimo
4. Section 11-5-3 of the City of Lakeville Zoning Ordinance states that an interim
use permit shall be processed according to the standards and procedures for a
conditional use permit. The criteria and our findings regarding them are:
a) The proposed action has been considered in relation to the specific
policies and provisions of and has been found to be consistent with
the Official City Comprehensive Plan.
The proposed motorcycle and ATV sales use with outdoor sales and display is
consistent with the policies and provisions of Planning District 1 of the
Comprehensive Land Use Plan.
b) The proposed use is or will be compatible with present and future land
uses of the area.
The property is adjacent to Interstate 35. The outdoor sales and display of
motorcycles and ATVs is compatible with existing and future land uses of
the area.

c) The proposed use conforms with all performance standards
contained in the Zoning Ordinance and the City Code.
The outdoor sales and display conforms with the requirements of the Zoning
Ordinance including the standards required for an interim use permit.
d) The proposed use can be accommodated with existing public
services and will not overburden the City’s service capacity.
The proposed outdoor sales and display use and building addition can be served
with and will not overburden existing public services.
e) Traffic generation by the proposed use is within capabilities of
streets serving the property.
Traffic generation will not significantly increase due to the proposed outdoor sales
and display use.
5. The planning report dated July 27, 2018 prepared by Associate Planner Frank
Dempsey is incorporated herein.
DECISION
The City Council approves the interim use permit in the form attached hereto.

BACKGROUND
Lakeville Motoprimo representatives have submitted an application and plans for the
construction of a proposed two level (main floor and basement) 30,000 square foot addition
onto the north side of the existing 27,000 square foot building at 16640 Kenrick Avenue.
Lakeville Motoprimo proposes to introduce sales of Indian brand motorcycles at this location.
The addition is proposed to include an outdoor sales and display area consistent with that in
front of the existing building. The future building expansion was identified on Lakeville
Motoprimo’s 2003 approved site plan. The existing Motoprimo building was constructed in
2004 subject to a conditional use permit allowing outdoor sales and display. The Zoning
Ordinance now allows outdoor sales display subject to an interim use permit. The 2004
conditional use permit and stipulations will remain in effect unless amended by the proposed
interim use permit.

Zoning and Surrounding Uses. The subject property is zoned C-3, General Commercial
District and is also within the Freeway Corridor District. The property is adjacent to following
existing land uses:

STAFF ANALYSIS
Interim Use Permit (Outdoor Sales and Display)
Section 11-73-9(A) of the Zoning Ordinance allows accessory outdoor sales in the C-3 District
provided that:
1. Outdoor services, sales and equipment rental is connected with the principal use and
limited to 30% of the gross floor area of the principal use.
Outdoor sales and display will be located at the front of the building on the deck areas near
the building entrances. 12,800 square feet of display area is allowed. The percentage of
display area in relation to the gross floor area of the building will be 24% in compliance
with Zoning Ordinance requirements.
2. Outdoor sales areas are fenced or screened from view of neighboring residential uses
or an abutting residential district.
The outdoor sales and display area will be located at the front of the building, not visible
from any neighboring residential properties.
3. Sales area is surfaced with asphalt, concrete or pavers to control dust.

The outdoor sales area will be surfaced with concrete.
4. The use does not take up parking spaces as required for compliance with parking
requirements.
The outdoor display and sales will not use required parking spaces.
5. The interim use permit shall terminate upon a change of occupancy or other date as
determined by the City Council.
The interim use permit allowing outdoor display and sales shall terminate upon a change
in occupancy of the building that does not include motorcycle or ATV sales.
Building. The building addition will include integral colored concrete block and glass and
aluminum panels to match the existing building. The top of the building panel in front will be
25 feet, four inches in height. The maximum allowed building height in the C-3 District is
three stories or 35 feet. A parapet wall will screen rooftop mechanical units from view of the
street.
Parking. The existing site provides 100 parking spaces which was required at the time the
building was constructed in 2005. The Zoning Ordinance requires a total of 105 parking spaces for
the office, indoor display area, outdoor sales area, and storage area in the existing building and the
proposed addition. The applicant proposes to defer construction of five parking spaces. A parking
deferment requires staff approval of a parking deferment contract which staff can approve
following City Council approval of the interim use permit. Parking requirements are based on the
following formula:

Total Proposed Building Area is 62,448 square feet
Office: 2,591 sf – 10% / 200 = 12 spaces
Indoor Sales: 22,500 sf -10% / 500 = 41 spaces
Storage: 26,945 sf – 10% / 500 = 49 spaces
Outdoor Sales: 10,412 – 10% / 3,000 = 3 spaces
Parking Required 105 spaces
Parking Existing 100 spaces
Parking Deferred 5 spaces
Total Parking Spaces Available at Maximum Development = 126 spaces
Maximum Allowed Impervious Surface Area. The Lakeville Motoprimo property is located
within the Crystal Lake Drainage Area of the Crystal Lake Drainage District and under special
restrictions for maximum allowable impervious surface area. The property is subject to a

maximum impervious surface area of 70% (minimum greenspace of 30%). The total
impervious surface area if the five deferred parking spaces are constructed is 67.5%.
Interim Use Permit General Standards. Section 11-5-5 of the Zoning Ordinance requires
that an interim use comply with the following:
A. Meet the standards of a conditional use permit set forth in subsection 11-4-3E of
this title.
The interim use meets the standards of a conditional use permit as outlined in Section
11-4-3E of the Zoning Ordinance and the findings of fact.
B. Conform to the applicable general performance standards of section 11-4-7 of this
title.
The interim use permit conforms to the performance standards outlined in Section 11-
4-7 of the Zoning Ordinance and the planning report.
C. The use is allowed as an interim use in the respective zoning district.
Outdoor sales and display are allowed by interim use permit.
D. The date or event that will terminate the use can be identified with certainty.
The interim use permit shall terminate upon a change in use occupancy of the building
that does not include motorcycle or ATV sales.
E. The use will not impose additional unreasonable costs on the public.
The interim use permit allowing outdoor sales and display will not impose additional
unreasonable costs on the public.
F. The user agrees to any conditions that the city council deems appropriate for
permission of the use.
RECOMMENDATION
Planning Department staff recommends approval of the Motoprimo interim use permit to
allow outdoor sales and display subject to the following stipulations:
1. Outdoor sales and display shall be restricted to the areas in front of the building as
identified on the approved site plan and shall occur only during business hours.

2. Outdoor storage is not permitted.
3. A sign permit is required prior to the installation of any wall or freestanding signs.
4. The total impervious surface area of the property shall not exceed 70%.
5. A $5,000 landscape escrow shall be submitted to guarantee completion of the
approved landscaping.
6. The interim use permit allowing outdoor display and sales shall terminate upon a
change in occupancy of the building that does not include motorcycle or ATV sales.
