LAKEVILLE COMMERCE CENTER FOURTH ADDITION FINAL PLAT AND EASEMENT VACATION
PROPOSED ACTION
Move to approve: 1) a resolution approving the final plat of Lakeville Commerce Center Fourth
Addition and, 2) a resolution vacating drainage and utility easements.
OVERVIEW
Aldi, Incorporated representatives have submitted applications for the final plat of two lots and
one outlot to be known as Lakeville Commerce Center Fourth Addition, and the vacation of
existing platted public drainage and utility easements. Aldi is an international grocery retailer
with several stores located in the Twin Cities area. Since the final plat requires City Council
action, the easement vacation public hearing has been scheduled concurrently for City Council
consideration. Prior to the scheduled July 16, 2018 City Council meeting, Aldi requested that
action on the easement vacation and final plat be delayed to allow them additional time to
review and sign the development agreement. The City Council tabled action on the public
hearing for the easement vacation to a future meeting.
PRIMARY ISSUES TO CONSIDER
Is the Lakeville Commerce Center Fourth Addition final plat consistent with the approved
preliminary plat? The final plat is consistent with the Lakeville Commerce Center preliminary plat
approved in 1987 which included two commercial lots for the subject property.

RESOLUTION APPROVING THE FINAL PLAT
OF LAKEVILLE COMMERCE CENTER FOURTH ADDITION
WHEREAS, the owner of the plat described as LAKEVILLE COMMERCE
CENTER FOURTH ADDITION has requested approval of a final plat; and
WHEREAS, the final plat is consistent with the approved preliminary plat, and
WHEREAS, the final plat is acceptable to the City.
NOW THEREFORE BE IT RESOLVED by the Lakeville City Council:
1. The LAKEVILLE COMMERCE CENTER FOURTH ADDITION final plat is
approved subject to the developer’s execution of the development
contract and security requirements.
2. The Mayor and City Clerk are hereby authorized to sign the development
contract, and the final plat mylars, and the stormwater management agreement.
3. The City Clerk is directed to file a certified copy of this resolution with the
Dakota County Recorder.

RESOLUTION VACATING PUBLIC DRAINAGE AND UTILITY EASEMENTS
WHEREAS, the City Council has conducted a public hearing preceded by two (2) weeks
published notice, to consider the vacation of the following described public drainage and
utility easements; and
WHEREAS, the City Council has determined that it is in the public interest to vacate said
public drainage and utility easements.
NOW, THEREFORE, BE IT RESOLVED by the Lakeville City Council:
1. The following public drainage and utility easements are hereby vacated:
All of the public drainage and utility easements, as dedicated on the recorded plat of
Lakeville Commerce Center, Dakota County, Minnesota, which lie within Outlot D of
said plat.
2. The City Clerk is directed to file a certified copy of this resolution with the Dakota
County Recorder.

INTRODUCTION
Aldi, Incorporated representatives have submitted applications for the final plat of two lots and
one block to be known as Lakeville Commerce Center Fourth Addition and the vacation of
existing platted public drainage and utility easements. Aldi is an international grocery retailer
with several stores located in the Twin Cities area. In conjunction with the proposed final plat,
the vacation of public drainage and utility easements is required. Vacating the existing platted
easements will ensure clear title and will allow the final plat to reflect all public easements on the
property. Since the final plat requires City Council action, the easement vacation public hearing
has been scheduled concurrently for City Council consideration. The site plan will be reviewed
and approved administratively by Planning Department staff.
The easement vacation and final plat plans have been reviewed by Planning Department,
Engineering Division and Parks and Recreation Department staff.

PLANNING ANALYSIS
Existing Conditions. The area of the final plat totals 6.34 acres, is moderately sloped from west
to east and includes areas of wetland. The Lakeville Commerce Center preliminary plat
approved in 1987 included two lots for the subject property. The final plat of Lakeville
Commerce Center was approved in 1990. The proposed Lakeville Commerce Center Fourth
Addition final plat includes two lots and a 1.32 acre outlot which will be deeded to the City for
wetland preservation purposes.
Consistency with the Preliminary Plat. The two lots proposed with the Lakeville Commerce
Center Fourth Addition final plat are consistent with the approved 1987 preliminary plat.
Easement Vacation. The public drainage and utility easements created with the final plat of
Lakeville Commerce Center in 1990 were created to allow preservation of the known wetland
boundaries at that time. All existing boundary easements will be vacated and re-established with
the Lakeville Commerce Center Fourth Addition final plat. All parties with a real or potential
interest in the easement vacation were notified, including utility companies. No utility
companies or other have responded with opposition to the easement vacation.
Zoning. The zoning of the property is C-3, General Commercial District which allows retail
commercial, such as Aldi, as a permitted use.
Lot Area. The proposed Lots 1 and 2, Block 1, Lakeville Commerce Center Fourth Addition are
108,812 square feet (2.49 acres) and 109, 684 square feet (2.5 acres) respectively which meets the
minimum lot area requirement of 30,000 square feet for lots in the C-3 District.
Lot Width. The proposed width of each lot exceeds the minimum lot width of 100-feet required
in the C-3 District.

Outlots. One outlot (Outlot A) totaling 1.32 acres will be deeded to the City for wetland
preservation purposes.
Access. Lots 1 and 2 will be accessed from driveways on 207th Street. 207th Street is classified as a
minor collector street that will eventually connect to 215th Street (CSAH 70) and Keokuk Avenue.
207th Street will be extended when the remaining Lakeville Commerce Center property to the
west is developed. The driveway accesses meet Zoning Ordinance spacing requirements.
Streets & Right-of-Way. All streets adjacent to Lakeville Commerce Center Fourth Addition are
constructed. No additional right-of-way dedication or street construction is required.
Park Dedication/Trails/Sidewalks. The City’s Parks, Trails and Open Space Plan does not
identify any park land or trail development in the vicinity of the Lakeville Commerce Center
Fourth Addition final plat. The developer must pay a cash fee in lieu of park land with the 5.02
acre final plat. The park dedication fee is $7,693 per acre of lot area for a total park dedication
cash fee of $38,618.66.
An eight foot wide concrete sidewalk shall be constructed along the south side of 207th Street and
the west side of Keokuk Avenue adjacent to the final plat. A financial security shall be required
to guarantee construction of the sidewalk.
Tree Preservation. The tree preservation plan inventoried significant trees on the property,
including within the wetland area and buffer area that will be dedicated to the City as Outlot A.
The 12 trees in the wetland buffer and wetland located in Outlot A identified to be removed can
be removed but will require a replacement of 1:1. The location and tree type of the replacement
trees will be reviewed by City Staff prior to planting. No additional trees or understory will be
disturbed with the removal of the 12 trees in the buffer and wetland area.
Wetlands. A wetland delineation was completed with the final plat application. The 1.32 acres of
wetland and wetland buffer area will be deeded to the City with the final plat as Outlot A.
Grading, Drainage and Erosion Control. The final plat plans include grading, drainage and
erosion control plans and utilities. Grading, drainage and erosion control is discussed in more
detail in the June 29, 2018 engineering memo.
Building. The Aldi grocery store building on Lot 1 is proposed to be 22,400 square feet in area
and 28 feet, 9 inches in height. The building will be constructed of brick, glass (Grade A

materials), opaque fiberglass and aluminum panels and fiber cement cladding (Grade C
materials). The materials of all wall facias comply with Zoning Ordinance requirements.
Setbacks. Setback requirements for a commercial building in the C-3 District are noted below:

The proposed Aldi retail building on Lot 1 meets the C-3 District setback requirements.
Unloading Area. The proposed delivery/unloading dock will be located on the west side of the
building approximately 245 feet from 207th Street. Landscape screening will include a row of tall
white cedar shrubs and ornamental deciduous trees.
Signs. The Zoning Ordinance allows up to 150 feet of freestanding (pole) signage, up to 30 feet in
height plus 100 feet of wall signage for commercial uses in the Freeway Corridor District. The
freestanding sign will be 30 feet in height and 120 square feet in area. The building will include
modest wall signage of 76 square feet. Wall signs will be on the north (207th Street) and east
(Keokuk Avenue) elevations since the Aldi building will be on a corner lot.
Cart Storage. Outdoor cart storage will be located under the building canopy, covered by the
roof and screened from view of the public streets.
Parking and Drive Aisles. The 22,400 square foot Aldi store will require 100 parking spaces.
The site plan shows that 100 parking spaces will be provided on site. All drive aisle and parking
space dimensions and setbacks comply with Zoning Ordinance requirements.
Waste/Recycling Container. The plans do not address the location of an outdoor gated
enclosure for waste and recycling as required by the Zoning Ordinance. The enclosure must be a
minimum of six feet in height, constructed of materials that match the principal building and
include a gate that is durable and maintenance free.
Site Lighting. Exterior light fixtures will include four parking lot poles with downcast LED
fixtures. Three exterior wall-pack lights will illuminate the building exterior near the door
openings. The wall packs are also downcast design fixtures. Light intensity at the property line
complies with Zoning Ordinance requirements.

RECOMMENDATION
Planning Department staff will review and is authorized to approve the site plan administratively.
The Lakeville Commerce Center Fourth Addition easement vacation and final plat are consistent
with the approved preliminary plat and comply with the requirements of the Zoning and
Subdivision Ordinances. Planning Department staff recommends approval subject to the
following stipulations:
1. The easement vacation is subject to the recording of the final plat of Lakeville Commerce
Center Fourth Addition.
2. The recommendations listed in the July 29, 2018 engineering report.
3. An outdoor trash enclosure is required in accordance with Zoning Ordinance requirements if
an outdoor waste enclosure is proposed.
4. Construction may not commence prior to building permit approval.
5. A sign permit is required prior to installation of any signage.

ALDI, Inc. has submitted a final plat named Lakeville Commerce Center 4th Addition. The
proposed development is located south of and adjacent to 207th Street, and west of and
adjacent to Keokuk Avenue. The parent parcel consists of Outlot D, Lakeville Commerce
Center (PID 224434000040). The parcel is zoned C-3, General Commercial District. The
preliminary plat was approved in 1987 and included two lots for Outlot D.
The final plat consists of two (2) commercial lots within one (1) block and one (1) outlot on
6.34 acres.
The outlot created with the final plat shall have the following use:
Outlot A: Wetland and buffer; to be deeded to the City (1.32 acres)

The Lakeville Commerce Center 4th Addition site contains undeveloped land. Existing wetlands
and trees are located along the southern and eastern portion of the parcel.
ALDI, Inc. proposes to construct a 22,399 square foot building on Lot 1, Block 1 with two
driveways off of 207th Street. A security of $2,210 will be required prior to the issuance of a
building permit for the construction of the driveway aprons to the public street. The west
entrance is a shared access for Lots 1 and 2, a cross access easement is required over the
driveway prior to the issuance of a building permit.
The site plan includes the construction of a parking lot, an underground stormwater chamber,
and construction of private utilities on Lot 1, Block 1. No improvements are proposed on Lot
2, Block 1.

There are existing boundary easements with the parent parcel, Lakeville Commerce Center,
which will be considered for vacation at the July 16, 2018 City Council meeting. The vacated
easements will be reestablished on the Lakeville Commerce Center 4th Addition final plat.

207th Street
Lakeville Commerce Center 4th Addition is located south of and adjacent to 207th Street, a
minor collector roadway as identified in the City’s Transportation Plan. The right-of-way for
207th Street was dedicated with the Lakeville Commerce Center final plat; no additional right-
of-way is required with the final plat.
207th Avenue is currently constructed as a forty-foot wide urban roadway consisting of one
lane in each direction.
Keokuk Avenue
The parent parcel is located west of and adjacent to Keokuk Avenue, a major collector
commercial roadway, as identified in the City’s Transportation Plan. 80-feet of right-of-way
way was dedicated for Keokuk Avenue with the Lakeville Commerce Center plat. No
additional right-of-way will need to be dedicated at this time.
Keokuk Avenue is currently constructed as a forty-four foot wide urban roadway consisting of
one lane in each direction and a continuous center to center left turn lane.

Wastewater will be conveyed to the MCES Farmington Interceptor and continue to the
Empire Wastewater Treatment Facility.
An existing 8-inch public sanitary sewer extends adjacent to the parent parcel along 207th
Street. A 6-inch private sanitary sewer service stub was constructed to the parcel with the
Lakeville Commerce Center improvements. An additional service was extended to Lot 2 for
future development. Development of Lakeville Commerce Center 4th Addition includes the
connection to the sanitary sewer service to provide service to Lot 1, Block 1, Lakeville
Commerce Center 4th Addition. A security of $1,000.00 will be collected for the proposed
sanitary sewer service connection prior to the issuance of a building permit.
The Sanitary Sewer Area Charge has been collected and will not be required with the building
permit application.
Final sewer service connection locations and sizes will be reviewed by City staff with the final
construction plans.

construction plans.
DDRRAAIINNAAGGEE AANNDD GGRRAADDIINNGG
The parent parcel is located within subdistrict ML-8 of the Marion Lake Stormwater District, as
identified in the City’s Water Resources Management Plan.
Development of Lakeville Commerce Center 4th Addition will include the construction of one
privately owned and maintained underground stormwater chamber. The private stormwater
chamber will be located within Lot 1, Block 1, Lakeville Commerce Center 4th Addition.
Additional stormwater best management practices will be required with the development of
Lot 2, Block 1, Lakeville Commerce Center 4th Addition.
The Developer shall sign a private maintenance agreement for the underground stormwater
chamber and dedicate a drainage and utility easement over the chamber. The chamber will
provide water quality treatment, volume reduction and rate control of the stormwater runoff
generated from the proposed site improvements. Stormwater chamber designs must be
reviewed by the City and be consistent with City requirements prior to approval of
construction plans.
The final grading plan must indicate any proposed borrow areas in which the building
footings will be placed on fill material. The grading specifications must indicate that all
embankments meet FHA/HUD 79G specifications. A final certificate of occupancy shall not be
issued until an as-built certified grading plan has been submitted and approved by the City
Engineer.
The proposed site plan and improvements contain more than one acre of site disturbance. A
National Pollution Discharge Elimination System General Stormwater Permit for construction
activity is required from the Minnesota Pollution Control Agency for areas exceeding one acre
being disturbed by grading. A copy of the Notice of Stormwater Permit Coverage must be
submitted to the City upon receipt from the MPCA and prior to the issuance of a building
permit.

Private storm sewer will be constructed with Lakeville Commerce Center 4th Addition. Private
storm sewer constructed within Lot 1, Block 1, Lakeville Commerce Center 4th Addition will
convey runoff to a privately owned and maintained underground stormwater chamber. The
privately owned and maintained underground stormwater chamber will outlet to an existing
wetland within Outlot A, Lakeville Commerce Center 4th Addition.

The Developer is responsible for obtaining a MPCA Construction Permit for the site as well as
developing a SWPPP for the site prior to construction. The permit requires that all erosion and
sediment BMPs be clearly outlined in a SWPPP. Changes made throughout construction must
be documented in the SWPPP. All slopes adjacent to wetlands must have erosion control
blanket installed and be seeded with a native seed mix.
Additional erosion control measures may be required during construction as deemed
necessary by City staff or the Dakota County Soil and Water District. Any additional measures
