Overview Duane Marek of Northland Collision requests approval of a conditional use permit amendment to allow an expansion to the existing auto body repair building located at 7430 160th Street. The proposed addition will include a 3,420 square foot expansion for additional repair bays. The building expansion requires an amendment to Conditional Use Permit No. 99-01, which established the automobile repair use. The subject property is zoned C-3, General Commercial District. Section 11-73-7B of the Zoning Ordinance allows major automobile repair on properties in the C-3 District by conditional use permit. The Planning Commission held a public hearing on August 16, 2018 to consider the conditional use permit amendment request. The Planning Commission recommended unanimous approval subject to the one stipulation listed in the August 10, 2018 planning report. There was no public comment at the public hearing. Primary Issues to Consider Does the proposed site plan and building elevation plan comply with Zoning Ordinance requirements? Permit. Subject to the terms and conditions set forth herein, the City of Lakeville approves a conditional use permit amendment for Northland Collision to a building expansion in the C-3, General Commercial District. 2. Property. The permit is for the following described property located at 9430 – 160th Street West in the City of Lakeville, Dakota County, Minnesota: Lot 2, Block 1, Dakota Plaza 3. Conditions. The conditional use permit amendment is issued subject to the following conditions: a) The stipulations of the conditional use permit dated March 1, 1999 (CUP 99-01) shall remain in full force and effect. 4. Revocation. The City may revoke the conditional use permit amendment for cause upon determination that the conditional use permit amendment is not in conformance with the conditions of the permit or is in continued violation of the city code or other applicable regulations. Expiration. This conditional use permit amendment shall expire unless the applicant commences the authorized use within one year of the date of this conditional use permit amendment, unless an extension is approved by the Zoning Administrator. The Planning Commission conducted a public hearing on the proposed conditional use permit amendment preceded by published and mailed notice. The applicant was present and the Planning Commission heard testimony from all interested persons wishing to speak. The City Council hereby adopts the following: FINDINGS OF FACT 1. The property is located in Planning District No. 3 of the 2008 Comprehensive Plan, which guides the property for commercial uses. 2. The property is currently zoned C-3, General Commercial District. 3. The legal description of the property is: Lot 2, Block 1, Dakota Plaza 4. Section 11-4-3E of the City of Lakeville Zoning Ordinance provides that a conditional use permit may not be issued unless certain criteria are satisfied. The criteria and our findings regarding them are: a. The proposed action has been considered in relation to the specific policies and provisions of and has been found to be consistent with the official City Comprehensive Plan. Finding: The proposed use is a commercial use consistent with the policies and provisions of Planning District 8 of the 2008 Comprehensive Land Use Plan. b. The proposed use is or will be compatible with present and future land uses of the area. Finding: The proposed expansion will be compatible with existing and future land uses in the area. 2 c. The proposed use conforms with all performance standards contained in the Zoning Ordinance. Finding: The proposed expansion will conform with all performance standards contained in the Zoning Ordinance and the City Code. d. The proposed use can be accommodated with existing public services and will not overburden the City’s service capacity. Finding: The subject property is served with existing public services and will not overburden the City’s service capacity. e. Traffic generation by the proposed use is within capabilities of streets serving the property. Finding: Traffic generation will not significantly increase due to the proposed expansion to the major auto repair use. 5. The proposed addition will include a 3,420 square foot expansion to the south side of the existing building. The proposed building expansion requires an amendment to Conditional Use Permit No. 99- 01, which established the automobile repair use and allowed an expansion to the building that was previously a car wash. The subject property is zoned C-3, General Commercial District. Section 11-73-7B of the Zoning Ordinance allows major automobile repair on properties in the C-3 District by conditional use permit. The building expansion will be used for major auto repair including auto body repair. The proposed expansion was reviewed for conformance with the Zoning Ordinance performance standards as follows: Building Setbacks. The existing building meets the additional setback requirements for major auto repair in the C-3 District of: Front – 30 feet Side – 20 feet Side abutting street – 30 feet Rear – 30 feet The proposed building addition will have the following setbacks: Front – 55 feet Side – 21 feet Side abutting street – 91 feet Rear – 70 feet Building Height. The new addition will match the height of the existing building as a 21 foot single story building and will not exceed the maximum building height of 35 feet allowed in the C-3 District. Floor Plan. The floor plan for the addition will include a 3,420 square foot auto body shop. Access and Circulation. The property access will remain unaffected by the proposed addition. The site is accessed via one driveway from Glacier Avenue. Parking. The site currently has 19 parking spaces on the east side of the property. The proposed site plan shows proof of parking for an additional 18 spaces on the south side of the property. The Zoning Ordinance requires 1 parking space per 200 square feet of floor area for auto repair uses established after March 17, 2003. Since this use was established in 1999, it would follow the old requirement of 8 spaces plus one space per 800 square feet of building area in excess of 1,000 square feet. The total building size with the addition is 8,366 square feet. The required parking is calculated as follows: 8,366 – 10% = 7,529.4 – 1000 = 6,529.4 / 800 = 8 + 8 = 16 parking spaces required There are 19 spaces on the property with space for up to 18 additional spaces for a total of 37 parking spaces, which is in compliance with Zoning Ordinance requirements. If the new requirements were to be applied, the required parking calculations would be as follows: 8,366 – 10% = 7,529.4 / 200 = 38 parking spaces required 3 Building Elevations and Exterior Building Materials. The existing building consists of painted concrete block and masonry. The proposed addition will consist of matching concrete block and accents in compliance with Zoning Ordinance requirements. Signs. The Zoning Ordinance allows one wall sign on two separate elevations for a property with two street frontages. Northland Collision currently has one wall sign on the north elevation, one wall sign on the west elevation, and one freestanding sign. All signs are in compliance with Zoning Ordinance requirements and no additional signage is being proposed. Lighting. The lighting shown on the building elevation plan is downcast design only, as required by the Zoning Ordinance, and will require the approval of an electrical permit prior to installation. Landscaping. Section 11-73-7B.2 requires that at least 25% of the property remain as landscaped green area. Approximately 50% of the property will remain landscaped in compliance with Zoning Ordinance requirements. There are numerous trees and shrubs on the property that will not be impacted by the expansion. RECOMMENDATION Planning Department staff recommends approval of the Northland Collision conditional use permit amendment subject to the following stipulations: 1. The stipulations of the conditional use permit dated March 1, 1999 (CUP 99-01) shall remain in full force and effect. Findings of fact are attached.
