RESOLUTION AUTHORIZING THE PURCHASE OF REAL PROPERTY LOCATED AT
16715 FLAGSTAFF AVENUE
Proposed Action
Staff recommends adoption of the following motion: Move to adopt a Resolution Approving
Acquisition of Certain Real Property and payment of eligible relocation expenses.
Adoption of this resolution will result in the acquisition of the property located at 16715 Flagstaff
Avenue.
Overview
The City Council has approved a Joint Powers Agreement with Dakota County on March 19, 2018 for
the construction of a roundabout at the intersection of Dodd Boulevard and Flagstaff Avenue. The
agreement calls for the required property acquisition be completed by the City with the County
reimbursing the City with their 55% cost share.
The owner occupied single-family home located at 16715 Flagstaff Avenue has been identified to be
acquired for the Dodd/Flagstaff Intersection Project. The City had an appraisal of the property
completed in December of 2017. The appraised value of the property was $257,000. However, under
the Minnesota Statutes for City initiated acquisitions, the owners are entitled to compensation
sufficient to purchase a comparable property. The Minimum Compensation Value Report completed
by Wilson Development Services determined as the minimum compensation for a comparable
property to be $280,000.
Timothy and Sandra Pope have signed a purchase agreement for the minimum compensation value
amount of $280,000 with a September 27, 2018 closing date. The City has also agreed to rent the
house back to the Pope’s for ten days after closing at no cost to allow time to complete their move.
The Popes are also entitled to business relocation and re-establishment expenses for their home-
based business, actual moving costs, as well as closing costs on their new home under the Uniform
Relocation Act. City and County staff recommend approval of this purchase agreement.
Primary Issues to Consider
• What is the proposed funding source for this acquisition? The project as identified in the
adopted 2018-2022 Capital Improvement Plan is proposed to be financed from the
Municipal State Aid Street funds.

RESOLUTION APPROVING THE ACQUISITION OF REAL PROPERTY
AND DISPENSING WITH STATUTORY REQUIREMENTS FOR
REVIEW BY PLANNING COMMISSION OF DISPOSAL OF PROPERTY
WHEREAS, the City is proposing to acquire certain property ("Property") legally described
in and under the terms of the proposed purchase agreement attached as Exhibit "A" (“Purchase
Agreement”) between the City of Lakeville (“Buyer”) and Timothy R. Pope and Sandra B. Pope
(“Sellers”);
WHEREAS, Minn. Stat. § 462.356, subd. 2 requires that the Planning Commission review
the City's proposed acquisitions and dispositions of property, and;
WHEREAS, Minn. Stat. § 462.356, subd. 2 provides for an exception from the Planning
Commission review requirement upon 2/3 vote of the City Council dispensing with the requirement
and finding that the acquisition or disposal of the property has no relationship to the comprehensive
municipal plan.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lakeville:
1. The City Council finds that the acquisition of the Property under the Purchase Agreement
has no relationship to the comprehensive municipal plan and approves the Purchase Agreement;
2. Review by the Planning Commission of the acquisition of the Property is hereby dispensed
with; and
3. The Mayor, City Administrator, and City Clerk are authorized and directed to execute all
documents, and take all appropriate measures to convey the Property under the terms of the Purchase
Agreement.
ADOPTED this _______ day of _____________, 2018, by a 2/3 vote of the City Council of
the City of Lakeville.
