EXTENDING THE CONTRACT FOR THE KENRICK AVENUE IMPROVEMENT PROJECT, CITY PROJECT 18-03 Proposed Action Staff recommends adoption of the following motion: Move to approve a contract amendment with Valley Paving, Inc. extending the contract for the Kenrick Avenue Improvement Project, City Project 18-03, to October 31, 2018. Overview On April 16, 2018, the City contracted with Valley Paving, Inc. for the Kenrick Avenue Improvement Project, City Project 18-03. Rain days and, specifically, difficulties in relocating private utilities delayed the water main relocation during Phase 2 of the project. Part of the project was the replacement of approximately 500 feet of water main that had a history of breaks due to poor soil conditions. Along this section, the water main runs under the sidewalk rather than through the middle of the street. A retaining wall on the east side caused private utilities to be in close proximity to the water main. The private utilities had to be moved before work on the water main could start. The contractor did appropriately contact the private utility owner, but they did not respond in a timely manner and forced a delay in that portion of the project. That delay affected work on utilities in Phase 3 and will impact base and wear course paving for the remainder of the project. Staff recommends its approval. Primary Issues to Consider • What is the overall impact to the project? The contractor continues to work to complete the storm sewer and water valve improvements in Phase 3 of the project. The primary impact of the delay at this point if to the paving in the remaining portions of the project. Supporting Information • A copy of the proposed contract amendment is attached. Financial Impact: $0 Budgeted: Yes Source: Related Documents (CIP, ERP, etc.): City Project 18-03 Envision Lakeville Community Values: Good Value for Public Services Report Completed by: Neil Normandin, Interim Public Works Director AMENDMENT TO CONTRACT FOR CONSTRUCTION THIS AMENDMENT (this "Amendment") is made as of this 1st day of October 2018, by and between the CITY OF LAKEVILLE, a Minnesota municipal corporation ("Owner"), and VALLEY PAVING, INC., a Minnesota corporation, (“Contractor”). WHEREAS, the Owner and Contractor entered into a Contract for Construction Between Owner and Contractor on the Basis of a Stipulated Price, dated April 16, 2018 related to work on Kenrick Avenue Improvement Project, City of Lakeville Project 18-03 (“Agreement”); WHEREAS, the parties desire to extend the Contract Times identified in the Agreement; NOW THEREFORE, THE PARTIES HERETO AGREE AS FOLLOWS: 1. AMENDMENT TO PARAGRAPH 2. Paragraphs 2 and 3 of Division 1 of the Contract Documents identified in Paragraph 2 of the Agreement are amended to read as follows: A. All work shall be substantially completed on or before October 31, 2018. Substantial completion shall include all concrete work and paving, and striping work. B. Final completion shall be on or before October 31, 2018. Final completion shall include all remaining restoration and clean up. 2. EFFECT OF AGREEMENT. The Agreement shall remain in full force and effect except as specifically amended herein.
