Overview Representatives of Verizon Wireless have submitted applications for amendments to Conditional Use Permit No. 08-12 and Interim Use Permit No. 08-15 to allow the construction of a new personal wireless service tower and antennas to replace the existing 110-foot tall tower and antennas in approximately the same location on the City of Lakeville Fire Station No. 4 property located at 9465 – 185th Street, east of Ipava Avenue and north of 185th Street (CSAH 60). The Verizon Wireless proposal is intended to improve the service coverage in their service area by constructing a taller tower which will also accommodate an existing (AT&T) and at least one additional future wireless service provider at this location. The Planning Commission held a public hearing on October 18, 2018 to consider the conditional use permit and interim use permit amendment requests. The Planning Commission recommended unanimous approval subject to the seven stipulations listed in the October 12, 2018 planning report. There was no public comment at the public hearing. Primary Issues to Consider When will the interim use permit terminate? Stipulation #6 of the planning report requires that the interim use permit terminate when the antenna and tower is no longer used for the purpose of personal wireless services. Revocation. The City may revoke the Conditional Use Permit Amendment for cause upon determination that the use is not in conformance with the conditions of the Conditional Use Permit Amendment or is in continued violation of the city code or other applicable regulations. 5. Expiration. This Conditional Use Permit Amendment shall expire unless the applicant commences the authorized use within two years of the date of this Conditional Use Permit Amendment unless an extension is approved by the Zoning Administrator. The Planning Commission conducted a public hearing on the proposed conditional use permit amendment and interim use permit amendment preceded by published and mailed notice. The applicant was present and the Planning Commission heard testimony from all interested persons wishing to speak. The City Council hereby adopts the following: FINDINGS OF FACT 1. The property is located in Planning District No. 5 and is classified as Public/Semi-Public in the Comprehensive Land Use Plan. 2. The property is currently zoned P/OS, Public Open Space District. 3. The legal description of the property is: Lot 2, Block 1, King Creek Greenway Addition 4. Section 11-4-3E of the City of Lakeville Zoning Ordinance provides that a conditional use permit may not be issued unless certain criteria are satisfied. Section 11-5-3 states that an interim use permit shall be processed according to the standards and procedures for a conditional use permit. The criteria and our findings regarding them are: a) The proposed action has been considered in relation to the specific policies and provisions of and has been found to be consistent with the Official City Comprehensive Plan. The proposed personal wireless service antenna on the subject property is consistent with the policies and provisions of Planning District 5 of the Comprehensive Land Use Plan. The personal wireless service antenna tower will not alter the residential character of the area. b) The proposed use is or will be compatible with future land uses of the area. The proposed personal wireless service antenna will be compatible with existing and future land uses in the area given conformance with the stipulations outlined in the conditional use permit and interim use permit amendments. c) The proposed use conforms with all performance standards contained in this Code. The proposed personal wireless service antenna meets all performance standards set forth in the Zoning Ordinance given conformance to the approved Conditional Use Permit and Interim Use Permit. d) The proposed use can be accommodated with existing public services and will not overburden the City’s service capacity. The proposed personal wireless service antenna and related equipment will not impact existing public services. e) Traffic generation by the proposed use is within capabilities of streets serving the property. Access to the site will be from 185th Street and Ipava Avenue. The proposed antenna will not impact the capacity of the streets serving the property. 5. A conditional use permit is required to allow a personal wireless service antenna that not located on a public or quasi-public structure. An interim use permit to allow the tower and antenna structure to exceed 75 feet in height. Verizon Wireless proposes to improve the service coverage in this service area by constructing a taller tower to also accommodate existing and future wireless service providers at this location. A CUP and IUP for the existing tower and antenna were approved in 2008. The Federal Communications Commission (FCC) requires that local units of government provide reasonable accommodations for personal wireless service antenna companies. The Zoning Ordinance may include requirements to protect the public health, safety and general welfare. Co-location requirements are also permitted and are, in fact, required by the Zoning Ordinance. 2 Verizon Wireless will construct the new tower, remove the existing tower and antennas and install the new Verizon Wireless antenna on the new tower. Verizon will then turn ownership of the tower over to the City. As owner, the City will then be responsible for managing the leases for the wireless service providers on the tower. The subject property is located in Planning District No. 5, Central Area/Heritage Commons. The Comprehensive Land Use Guide Plan map classifies the property for Public and Semi-Public use, which is consistent with the public fire station use of the property. Zoning. The Fire Station No. 4 property is five acres in area and is zoned P/OS, Public Open Space District which allows personal wireless service antennas. Access. Access to the site will not change with the propose new antenna. Access is from 185th Street (CSAH 60) or Ipava Avenue through the Water Treatment Facility property. Monopole Color. The Zoning Ordinance requires the new tower and antennas to be painted light sky (Tnemec blue or equivalent) to match the color of existing City water towers and other similar antennas of this height. 3 CONDITIONAL USE PERMIT A conditional use permit is required to allow a personal wireless service antenna tower not located on a public or quasi-public structure. In addition, a personal wireless service antenna tower larger than 75 feet tall requires an interim use permit. Verizon Wireless has indicated that the proposed improvements and height of the new tower and antenna equipment is the optimum location and elevation to provide the desired coverage for their customers. The height of the existing antenna and tower is 110 feet. The new tower with antennas will be 130 feet tall with a nine-foot tall lightening rod bringing the total structure height to 139 feet according to the plans submitted with the applications. Use of the Fire Station No. 4 property for the antenna and technical equipment will be in accordance with a lease agreement with the City. Co-Location Requirement. Section 11-30-7 requires that the tower be designed to allow co- location with other service providers. The co-location requirement aids in reducing the number of antenna towers in a given area of the City. The proposed tower is designed to allow co- location for three users (Verizon, AT&T, and one other possible future user). If an antenna co- location is proposed in the future that would create a height greater than 139 feet, an amended conditional use permit and interim use permit would be required at that time. Antenna equipment on the tower that does not increase the height above of the approved tower can be approved with an administrative permit. Performance Standards. Section 11-30-17.B.2 requires that personal wireless service antennas not located upon an existing structure shall require the processing of a conditional use permit and shall comply with the following standards: 2. Antennas Not Located Upon A Public Structure Or Existing Tower: Personal wireless service antenna not located upon a public or quasi-public structure or existing tower shall require the processing of a conditional use permit and shall comply with the following standards: a. The applicant shall demonstrate by providing a coverage/interference analysis and capacity analysis prepared by a qualified engineer that location of the antennas as proposed is necessary to meet the frequency reuse and spacing needs of the wireless system and to provide adequate portable coverage and capacity to areas which cannot be adequately served by locating the antennas in a less restrictive district. The applicant’s narrative (Exhibit C) and engineer’s structural narrative (Exhibit D) addresses location and project need as proposed. The RF engineer for Verizon has provided a narrative dated September 13, 2018 with maps representing the existing and proposed coverage area of the Fire Station No. 4 antenna. 4 b. If no existing structure which meets the height requirements for the antennas is available for mounting purposes, the antennas may be mounted on a single ground mounted pole provided that: (1) The pole does not exceed seventy-five feet (75') in height, except as may be allowed by approval of an interim use permit. The proposed Verizon tower will be 139 feet in height, including the lightening rod. According to Verizon Wireless, there are no existing structures in the search vicinity described by the application that meet the needs of the proposed antenna tower. The tower is proposed to be set back approximately 65 feet from the City owned property to the north, 350 feet to the east property line, 250 feet to the south property line (185th Street right-of-way), and 104 feet from the fire station building. (2) The setback of the pole from the nearest residential property line is not less than the height of the antenna. Exceptions to such setback may be granted if a qualified engineer specifies in writing that any collapse of the pole will occur within a lesser distance under all foreseeable circumstances. The water treatment facility and Fire Station No. 4 properties are zoned P-OS, Public-Open Space District consistent with the Comprehensive Plan. The nearest residential areas to the proposed antenna tower site are 1,050 feet to the west, 1,100 feet to the southwest and 1,300 feet to the north. The tower is designed to fold onto itself in the event of a catastrophic failure. Verizon Wireless will have a structural engineer in attendance at the meeting to answer any questions. c. Transmitting, receiving and switching equipment shall be housed within an existing structure whenever possible. If a new equipment building is necessary for transmitting, receiving and switching equipment, it shall be situated in the rear yard of the principal use and shall be screened from view by landscaping where appropriate. The utility equipment will be housed within two concrete exposed aggregate housing structures near the towers. Landscape screening was installed in 2008 and consisted of nine, six-foot tall spruce trees planted the area of the existing tower. No additional screening is necessary for the new tower. d. At the discretion of the city, a security fence not greater than eight feet (8') in height with a maximum opacity of fifty percent (50%) shall be provided around the support structure. No security fence is proposed with the antenna tower and utility building. e. The interim use permit provisions of chapter 5 of this title are considered and determined to be satisfied. 5 INTERIM USE PERMIT Section 11-5-5 provides general standards for interim use permits that must be addressed with any interim use permit request. These general standards and responses are addressed as follows: A. Meet the standards of a conditional use permit set forth in subsection 11-4-3E of this Title. The interim use permit meets the standards for a conditional use permit as outlined in this planning report and supported by the attached findings of fact. B. Conform to the applicable general performance standards of Section 11-4-7 of this Title. The interim use permit conforms to the general performance standards for a conditional use permit as outlined in this planning report and supported by the findings of fact. C. The use is allowed as an interim use in the respective zoning district. The proposed 139-foot tall personal wireless service tower and antenna are allowed in the P/OS Public and Open Space District. D. The date or event that will terminate the use can be identified with certainty. While there is no certainty as to the exact date when the personal wireless service antenna use may terminate, a stipulation will be in place stating that when the antenna tower is no longer used for the purpose of personal wireless services, the tower shall be removed within one year of the discontinuance of the use. E. The use will not impose additional unreasonable costs on the public. The personal wireless service antenna tower will not impose additional unreasonable costs on the public. F. The user agrees to any conditions that the City Council deems appropriate for permission of the use. The user must agree to the stipulations of the conditional use permit and interim use permit amendment listed in this report. Similar Tower Comparisons. For comparison purposes, similar personal wireless service antenna towers were approved by the City Council at the MnDOT Maintenance Facility (100 feet), and at Cedar Highlands Park (150 feet), and on the south side of JFK Elementary School (90 feet). 6 The proposed new Verizon tower at Fire Station No. 4 is consistent with other similar antenna towers in the City (see Exhibit G). Findings of Fact. Findings of Fact for the proposed conditional use permit amendment and interim use permit amendment are attached. RECOMMENDATION Planning Department staff recommends approval of the Verizon Wireless Conditional Use Permit Amendment and Interim Use Permit Amendment subject to the following stipulations: 1. The personal wireless service antenna shall comply with the requirements of Section 11- 30-3 of the Zoning Ordinance. 2. The personal wireless service antenna shall not exceed 139 feet in height and shall be constructed in the location shown on the plans approved by the City Council. 3. The personal wireless service tower and antennas shall be painted Tenemec blue or comparable color to match the existing tower. 4. A building permit shall be required prior to construction of the tower and antenna. All required Federal and State permits shall be submitted prior to the issuance of a building permit. 5. Project Need Overview: The primary objective for this project is to improve service quality for residences and businesses in the city of Lakeville, MN in the neighborhood along Dodd Blvd and 185th Street which includes residential areas, a fitness facility, various schools as well as new developments. High inter site distances and the combined effect of varying terrain elevation and vegetation in the area prevent effective propagation of a signal with newer technologies. Detail is provided on slides 7-8 supporting this issue. Our engineering data shows that the target area is also experiencing 4G data overloads. The existing MIN CHERRY site is located 2.5 miles North-East of the proposed project and its coverage area is shown in red on the map on page 9. The existing MIN LAKE MARION site is location 1.5 miles South-West of the proposed project and its coverage area is shown in green on page 9. These existing sites need to have some of the area they cover moved onto a new site to allow them to continue performing well. The proposed project would provide capacity offload to the existing sites by taking over their cell edge coverage in the targeted residential area. Introduction: Coverage and/or capacity deficiencies are the two main drivers that prompt the need for a new wireless communications facility (WCF). Most WCF provide a mixture of both capacity and coverage for the benefit of the end user. Coverage describes the existence or lack of wireless service in an area. The request for improved service often comes from our customers or emergency services personnel that have no service or poor service. Coverage used to refer to the ability to make or place a call in vehicles, however, as usage patterns have shifted, coverage is now determined based on whether or not sufficient WCF exist to provide a reliable signal inside of buildings and residential areas, as well. Historically, when wireless was still in its infancy, coverage was the primary means to measure the effectiveness of the network in a given area. Capacity is the metric used to determine if sufficient wireless resources exist and is now the primary means to measure how a community’s wireless needs are being addressed. “Five bars” no longer means guaranteed coverage and capacity because each WCF has a limited amount of resources to handle voice calls, data connections and data volume. When these limits are reached and the WCF becomes overloaded (meaning there is more demand than signal to service it), the user experience quickly degrades preventing customers from making/receiving calls or getting applications to run. A WCF short on capacity could also make internet connections time out or delay information to emergency response personnel. RF engineers use tools that take into account terrain, vegetation, building types, and WCF specifics to model the existing coverage and prediction what we expect to see with the addition of a proposed WCF. Coverage also changes depending on which frequencies are used. Most phones today use 3G at 800 MHZ or 4G at 700 MHz spectrum which are considered low frequencies. Low frequencies can travel further distances than then the higher 1900 MHz and 2100 MHz frequencies now being employed due to increased capacity demands. Operating at higher frequencies makes it necessary for carriers to install substantially more wireless facilities to achieve the same coverage as one tower operating on the lower frequencies. Capacity is the amount of resources that a WCF has to service customer demand. Because it takes an average of 2-3 years to complete a WCF, we have to start the process of adding a new WCF several years in advance of when the WCF will be needed. Location, Location, Location. A good capacity WCF needs to be in the center of a user population which insures that traffic is evenly distributed around the WCF. A typical WCF is configured into three sectors (like a pie cut into three pieces), with each slice (sector) having 33% of the WCF resources. If one sector is under- utilized, it’s resources can not necessarily be diverted to another sector. Therefore, optimal performance is only obtained when all three sectors have an even traffic distribution. Wireless Data Growth Each year Verizon sees large increases in how much data its customers need. As the resolution of the pictures we send increases, the quality of the video we watch improves and the complexity of the applications grow, we commonly see tremendous growth year-over-year.
