INTRODUCTION
KT Real Estate Holdings, LLC, representing Kwik Trip gas and convenience store at 20187
Dodd Boulevard, has submitted an application for a Conditional Use Permit Amendment to
allow an expansion of the existing convenience store for additional kitchen and food
preparation area. Kwik Trip received conditional use permit approval for the convenience
store with motor fuel sales in 1995 (CUP No. 95-07).

The Engineering Division has reviewed the plans and has prepared a memorandum dated
December 11, 2018, which is attached.
PLANNING ANALYSIS
Comprehensive Plan. The property is located in Planning District No. 5 and is guided for
commercial use consistent with the existing Kwik Trip convenience store with motor vehicle
fuel sales.
Zoning. The Kwik Trip property is zoned C-3, General Commercial District. The property
includes three combined metes and bounds described parent parcels. Kwik Trip developed
the site for a convenience store with motor fuel sales simultaneously with the development of
the McDonald’s site in 1995. Each site was developed following approval of separate Planned
Unit Development/Conditional Use Permits (PUD/CUPs). The Kwik Trip site is in compliance
with the stipulations of CUP #95-07 with the exception of stipulation No. 3 (landscaping). The
landscaping in place along Dodd Boulevard was removed since some of the plants had died.
Landscaping. Kwik Trip has agreed to replace the dead landscaping along Dodd Boulevard
and to provide new landscaping adjacent to the new parking spaces in compliance with
Zoning Ordinance requirements. The list of proposed new shrubs must be revised on the
landscape plan to comply with minimum size requirements and mature height requirements
to provide the required screening of the parking area. The proposed Broadmoor Juniper is a
ground level shrub not suitable for parking lot screening. The Broadmoor Juniper must be
replaced with Maney Juniper or similar species in compliance with minimum planting and
mature height size requirements.
Surrounding Land Uses and Zoning
North – Dakota Pet Hospital (C-3 District)
South – Kenwood Trail (CSAH 50)
East – Dodd Boulevard and Heritage Commons (PUD District)
West – McDonald’s Restaurant (C-3 District)
Building Height and Architectural Materials. The height of the building addition will match
the roof-line and building height of the existing single-story convenience store building. The
proposed exterior materials of the addition will match the materials of the existing building
which include brick, artificial stucco and asphalt shingle roof.
Parking. The existing convenience store building is 3,145 square feet in area. The addition is
444 square feet for a total building square footage of 3,589 square feet. The Zoning
Ordinance requires one parking space per each 200 square feet of building area and allows a
ten percent floor area credit from the gross building square footage. The required number of
parking spaces for this site is calculated as follows:

3,589 square feet of gross building floor area – 10% / 200 = 16 spaces required
Number of parking spaces proposed on site = 18 spaces
To accommodate the construction of the 444 square foot addition onto the west side of the
building, the existing trash enclosure and two parking spaces will be removed from that
location. The trash enclosure will be relocated to the southeast (near the front) of the
building. The proposed site plan includes removing the two parking spaces from the west
side of the building and two spaces in front of the building. Eight new parking spaces will be
constructed south of the fuel canopy. The total number of parking spaces and handicapped
accessible space are in compliance with Zoning Ordinance requirements. The eight new
spaces meet setback, size and width requirements.
Trash/Recycling Storage. Trash and recycling is presently stored in a walled and gated
enclosure adjacent to the west side of the building. The plans indicate a proposed new gate
to replace the non-conforming screening (chain link with plastic slats) with a new durable
maintenance free composite material.
CUP #95-07. The conditional use permit approved for the construction and operation of the
Kwik Trip convenience store with motor vehicle fuel sales will remain in full force and effect.
RECOMMENDATION
Planning Department staff recommends approval of the conditional use permit amendment
for the Kwik Trip convenience store located at 20187 Dodd Boulevard subject to the following
stipulations:
1. The site and building improvements shall comply with the plans approved by the City
Council.
2. A building permit is required prior to commencing any building improvements.
3. The species of shrubs must be revised on the landscape plan to comply with minimum
planting size and mature growth height requirements to provide the required
screening of the parking area.
4. The new gate screening the trash/recycling storage area shall be constructed of
durable, maintenance free material.
5. A $5,000 financial security shall be submitted to guarantee installation of the
landscaping.
6. All parking spaces and drive aisles shall be paved with bituminous or concrete.
7. Conditional Use Permit #95-07 shall remain in full force and effect.

KWIK TRIP CONDITIONAL USE PERMIT AMENDMENT
FINDINGS OF FACT AND RECOMMENDATION
On December 20, 2018 the Lakeville Planning Commission met at its regularly
scheduled meeting to consider the application of KT Real Estate Holdings, LLC (Kwik
Trip) for an amendment to conditional use permit No. 95-07 to allow an expansion to
the existing convenience store building located at 20187 Dodd Boulevard. The
Planning Commission conducted a public hearing on the proposed conditional use
permit amendment preceded by published and mailed notice. The applicant was
present and the Planning Commission heard testimony from all interested persons
wishing to speak.
FINDINGS OF FACT
1. The property is located in Planning District No. 5 of the 2008 Comprehensive Plan,
which guides the property for commercial land uses.
2. The property is zoned C-3, General Commercial District.
3. The legal description of the property is:

4. Section 11-4-3E of the City of Lakeville Zoning Ordinance provides that a conditional
use permit may not be issued unless certain criteria and satisfied. The criteria and our
findings regarding them are:
a. The proposed action has been considered in relation to the specific policies and
provisions of and has been found to be consistent with the official City
Comprehensive Plan.
The proposed 444 square foot convenience store addition is consistent with the
Comprehensive Plan’s designated commercial use of the property and the C-3, General
Commercial District zoning of the property.
b. The proposed use is or will be compatible with present and future land uses of the
area.

The existing convenience store and motor fuel sales use and the proposed building
addition is compatible with present and future land uses of the area.
c. The proposed use conforms with all performance standards contained in the
Zoning Ordinance.
The proposed building addition will conform to all performance standards contained in
the Zoning Ordinance.
d. The proposed use can be accommodated with existing public services and will not
overburden the City’s service capacity.
The property is served with City sanitary sewer and water. The proposed building
addition will not overburden the City’s service capacity.
e. Traffic generation by the proposed use is within capabilities of streets serving
the property.

RECOMMENDATION
The Planning Commission recommends that the City Council approve the conditional
use permit amendment.

KT Real Estate Holdings LLC has submitted a Conditional Use Permit Amendment application
to construct a building expansion and parking lot improvements with additional parking
stalls on PID 22-02900-32-031. The property is located at 20187 Dodd Boulevard, south of
Icenic Trail, north of and adjacent to 202nd Street (CSAH 50), and west of and adjacent to Dodd
Boulevard (CSAH 9). The parent parcel is zoned C-3, General Commercial District.

The parent parcel is currently an existing Kwik Trip convenience store and parking lot with the
access driveways on the east side of parcel and a shared driveway from the north off of Icenic
Trail.

The proposed improvements for the Kwik Trip site includes the expansion of the existing
convenience store building to the west, relocating the dumpster enclosure to the southeast
of the existing building, and adding eight parking stalls to the south of the site. There will be
no significant grading or utility work done on the site.
A temporary construction easement agreement will be required from the owner of
McDonalds’ property to the west for proposed improvements outside of the parcel.
The Applicant is responsible for maintaining the sediment and erosion control for the site
throughout the duration of the project.

The Applicant shall provide a Letter of Credit or cash as security for the Applicant-installed
improvements relating to the site plan. The Security will be required prior to issuance of a
building permit.
