CITY COUNCIL MEETING MINUTES
December 3, 2018
Mayor Anderson called the meeting to order at 7:00 p.m. in the Council Chambers at City
Hall. After a moment of silence, the Pledge of Allegiance to the flag was given.

6. Consent Agenda
Motion was made by Hellier, seconded by Wheeler, to approve the following:
a. Check register review
b. Minutes of the November 19, 2018 City Council meeting
c. Resolution No. 18-145 setting dates of regular City Council meetings and work
sessions in 2019
d. Resolution No. 18-146 accepting donations from Lakeville Liquors customers
e. Resolution No. 18-147 electing non-waiver of statutory municipal tort liability limits
and declining excess liability insurance coverage
f. Resolution No. 18-148 approving Kenwood Hills 3rd Addition final plat
g. Findings of fact and conditional use permit to allow the construction of a detached

7. Lakeville Burger LLC
Mayor Anderson opened the public hearing on the application of Lakeville Burger LLC for
an on-sale and Sunday liquor license at B-52 Burgers & Brew, 20751 Holyoke Avenue.
Business partner Ryan Wentz provided a brief overview of the proposed restaurant/bar,
which will include an outdoor patio. There were no questions from the public.
Motion was made by Davis, seconded by Wheeler, to close the public hearing.
Voice vote was taken on the motion. Ayes – unanimous
Motion was made by Wheeler, seconded by Davis, to grant an on-sale and Sunday liquor
license to Lakeville Burger LLC doing business as B-52 Burgers & Brew, 20751 Holyoke
Avenue.

8. Meadowlawn Restaurants, LLC
Mayor Anderson opened the public hearing on the application of Meadowlawn
Restaurants, LLC for an on-sale and Sunday liquor license at Northern Tap House, 18404
Kenrick Avenue. Owner Matt Letnes stated he and his brothers plan to open Northern
Tap House in the former Applebee’s restaurant. His family currently operates 11
restaurants. There were no questions from the public.

Motion was made by LaBeau, seconded by Davis, to close the public hearing.
Voice vote was taken on the motion. Ayes – unanimous
Motion was made by Hellier, seconded by LaBeau, to grant an on-sale and Sunday liquor
license to Meadowlawn Restaurants, LLC doing business as Northern Tap House, 18404
Kenrick Avenue.
Roll call was taken on the motion. Ayes – Anderson, Wheeler, Hellier, LaBeau, Davis
9. The Bonus Room LLC
Mayor Anderson opened the public hearing on the application of The Bonus Room LLC
for a consumption and display (set-up) permit at The Bonus Room Lakeville, 20908
Holyoke Avenue. Owners Joseph and Caarin Pannkuk stated The Bonus Room is a rental
venue that can accommodate many types of meetings, events and parties. A
consumption and display permit will allow patrons to bring in their own alcoholic
beverages. There were no questions from the public.
Motion was made by Wheeler, seconded by Hellier, to close the public hearing.

consumption and display (set-up) permit to The Bonus Room LLC doing business as The
Bonus Room Lakeville, 20908 Holyoke Avenue.

10. Adoption of Fees
Mayor Anderson opened the public hearing on an ordinance adopting fees. Finance
Director Jerilyn Erickson presented the proposed fee ordinance, which includes changes
in permit, planning and engineering fees, connection charges and other development
fees. She also presented a resolution adopting the 2019 schedule of fees. She explained
that fees are reviewed annually to ensure that rate structures accurately reflect cost of
services provided. The proposed fees are consistent with discussions held at the October
22nd City Council work session and have been incorporated into the proposed 2019
budget. There were no questions from the public.
Motion was made by Hellier, seconded by Wheeler, to close the public hearing.

Motion was made by Davis, seconded by Hellier, to approve Ordinance No. 1005
adopting fees, Summary Ordinance No. 1005 for publication and Resolution No. 18-155
adopting the fee schedule effective January 1, 2019.

11. Property Tax Levy and 2019 Budget
Mayor Anderson opened the public hearing to consider the 2019 property tax levy and
2019 budget. Finance Director Jerilyn Erickson presented the proposed tax levy and
budget. The total tax levy is $29,948,890 and represents a 6.95% increase over 2018.
Ms. Erickson provided information regarding the impacts of new residential construction
on market values. The estimated tax impact on the median valued home ($307,400) is an
increase of $75. This takes into account the market value increase as well as a reduction
in the tax capacity rate. Commercial property valued at approximately $1 million will see
a decrease of about $1,212 because of a decrease in market value.
Property taxes comprise about 73% of the revenue for the City’s general fund. Ms.
Erickson stated General Fund reserves are used for long term capital purchases such as
equipment, park improvements, ordinance updates and park maintenance projects.
Expenses total about $29 million, with public safety operations comprising about 47%.
The General Fund includes new positions or position changes in 2019 for police and the
arts center. Firefighter compensation will convert from pay-per-call to pay-per-hour
effective January 1.

adopting the 2019 property tax levy and Resolution No. 18-157 adopting the 2019
budget.

12. Southfork West PUD Rezoning
Michael Margulies of Valerian LLC requested Council approval of an ordinance rezoning
the west part of the Southfork 1st Addition from C-3 to Planned Unit Development (PUD).
The building was previously occupied by Schneiderman’s Furniture. The rezoning is
being requested to accommodate reuse of the building by multiple tenants, which has a
higher parking requirement than a furniture warehouse/showroom.
Planning Director Daryl Morey presented the staff report for Southfork West. He
explained that rezoning the property to PUD and restricting the permitted uses would
allow viable reuse of the building while still meeting on-site parking demand. The PUD
ordinance establishes the permitted uses and performance standards. Higher parking
demand uses, such as restaurants, would not be allowed. School District 194 is
proposing to occupy two of the tenant spaces for its district offices, meeting rooms and
community education. The ordinance requires approval of an administrative permit with

any change in occupancy of the building. It also requires a minimum of 215 off-street
parking spaces by June 30, 2019.
Mayor Anderson referenced the list of permitted uses in the ordinance and questioned
whether funeral homes and mortuaries are appropriate uses given their demand for
parking. It was suggested that funeral homes and mortuaries could be classified as
conditional uses, rather than permitted uses. Council Member Hellier suggested
pawnshops and sexually oriented uses should also be classified as conditional uses.
Council members discussed the list of permitted uses. Mr. Morey explained that the
administrative permit process ensures the availability of off-street parking to meet the
peak parking demands of the building tenants. If on-street parking becomes a safety
concern, the City Council can designate no parking on the street.
Motion was made by Wheeler, seconded by Davis, to adopt findings of fact and
Ordinance No. 1006 establishing a Planned Unit Development District for the west part of
Southfork 1st Addition.

1006 for publication.
