Overview Scott and Debra Newman have applied for a conditional use permit to allow a combined accessory building square footage greater than 1,100 square feet and more than one detached accessory building on a lot in the RS-3, Single Family Residential District and Shoreland Overlay District. The property is located at 10055 - 205th Street on the south shore of Lake Marion. The project includes the removal of the existing home constructed in 1890, removal of an old detached garage and the construction of a new home and new detached accessory building (garage). An existing 94 square foot, six-foot tall garden shed is proposed to remain. The Planning Commission held a public hearing on the conditional use permit application at their December 6, 2018 meeting and unanimously recommended approval subject to four stipulations. There was public comment from a neighbor in support of the project. Primary Issues to Consider Is the proposed amount of accessory building square footage compatible with properties in the neighborhood? The property is 1.46 acres and the total proposed accessory building area is only 2.2% of the lot area (up to 10% is typical in the RS-3 District). Revocation. The City may revoke the conditional use permit for cause upon determination that the conditional use permit is not in conformance with the conditions of the permit or is in continued violation of the city code or other applicable regulations. 5. Expiration. This conditional use permit shall expire unless the applicant commences the authorized use within one year of the date of this conditional use permit unless an extension is approved by the Zoning Administrator. The Planning Commission conducted a public hearing on the proposed conditional use permit preceded by published and mailed notice. The applicant was present and the Planning Commission heard testimony from all interested persons wishing to speak. The City Council hereby adopts the following: FINDINGS OF FACT 1. The property is located in Planning District No. 4 of the 2008 Comprehensive Plan, which guides the property for low density residential uses. 2. The property is zoned RS-3, Single Family Residential District. 3. The legal description of the property is: Lot 1, Block 1, Weichselbaum First Addition 4. Section 11-4-3E of the City of Lakeville Zoning Ordinance provides that a conditional use permit may not be issued unless certain criteria are satisfied. The criteria and our findings regarding them are: a. The proposed action has been considered in relation to the specific policies and provisions of and has been found to be consistent with the official City Comprehensive Plan. Finding: The proposed single family use of the property is consistent with the 2030 Land Use Plan and District 4 recommendations of the Comprehensive Plan. The property is 1.46 acres in area. The proposed attached and detached accessory buildings are consistent with single family lots of this size. b. The proposed use is or will be compatible with present and future land uses of the area. Finding: The attached and detached accessory buildings will be compatible with present and future land uses in the area. c. The proposed use conforms with all performance standards contained in the Zoning Ordinance. 2 Finding: Provided compliance with the conditional use permit, the two detached accessory buildings and the use of that space will conform with all performance standards contained in the Zoning Ordinance and the City Code. d. The proposed use can be accommodated with existing public services and will not overburden the City’s service capacity. Finding: The subject property lies within in the current MUSA. The property is served with City sanitary sewer and water. The accessory building square footage will have no impact on the City’s service capacity. e. Traffic generation by the proposed use is within capabilities of streets serving the property. Finding: The accessory buildings will not overburden the streets serving the property. 5. The planning report dated November 30, 2018 prepared by Associate Planner Frank Dempsey is incorporated herein. Scott and Debra Newman Chair Kaluza opened the public hearing to consider the application of Scott and Debra Newman for a conditional use permit to allow a combined accessory building square footage greater than 1,100 square feet and more than one detached accessory building on a lot in the RS-3, Single Family Residential District and Shoreland Overlay District, located at 10055 – 205th Street. Joseph Robbins and Jennifer Otto from Gonyea Companies were at tonight’s meeting to represent their clients, Scott and Debra Newman. Mr. Robbins stated that the proposed total accessory building area is approximately 322 square feet over what is allowed by the Zoning Ordinance. The Newmans would like to re-build the detached garage and keep the small storage shed that is still on the property. Associate Planner Frank Dempsey presented the planning report. Mr. Dempsey explained that the project includes the removal of the existing home constructed in 1890 and removal of an old detached garage, both of which were recently demolished, and the construction of a new home and new detached garage. An existing garden shed is proposed to remain. Mr. Dempsey reviewed the history of the site. He indicated that the single family home and the accessory buildings all meet setback requirements per the Zoning Ordinance Shoreland Overlay District requirements. The total proposed accessory building area, including the attached garage, would be 1,422 square feet. Mr. Dempsey stated that the Zoning Ordinance allows the accessory building area requirement to be exceeded by conditional use permit. Mr. Dempsey stated that staff recommends approval of the Newman CUP, subject to the four stipulations listed in the November 30, 2018 planning report, and adoption of the Findings of Fact dated December 6, 2018. Chair Kaluza opened the hearing to the public for comment. Rick Schumacher, 10025 205th Street Mr. Schumacher lives next door to the applicant. He has no issues with this proposal. Motion was made by Lillehei, seconded by Kelvie to close the public hearing at 6:07 p.m. Voice vote was taken on the motion. Ayes - unanimous Chair Kaluza asked for comments from the Planning Commission. Discussion points included: • Agreed that this lot is large enough for the existing and proposed accessory buildings. • Mr. Newman stated that the original garden shed was on the property when they bought it. In 2014 the garden shed had hail damage, so they replaced it not knowing that they could not have two detached accessory buildings on one single family property without approval of a conditional use permit. The property is located at 10055 - 205th Street on the south shore of Lake Marion. The subject property is 63,789 square feet (1.46 acres) in area. The property was platted in 1972 as one of 11 single family home lots along the south shore of Lake Marion known as Weichselbaums First Addition. The house constructed in 1890 remained on Lot 1. A number of additions were constructed on the home over the years. The entire area of the plat was previously operated as a vacation resort until the 1970’s. The property is served with city sewer and water. Adjacent Land Uses. The subject property is zoned RS-3, Single Family Residential District and Shoreland Overlay District. Adjacent land uses and zoning are as follows: North – Lake Marion East – Single Family Home (RS-3) South – 205th Street and Single Family Homes (RS-3) West – Single Family Home (RS-3) Setbacks. The minimum setbacks for the subject property are as follows: Front (south): 30 feet Lake (north): 75 feet from the Ordinary High Water Level (OHWL) Sides: 10 feet The new single family home will be set back 130 feet from the front property line, 225 feet from the OHWL and more than 20 feet to each side property line. The accessory buildings also meet setback requirements. Total Accessory Building Area. The applicant proposes to replace the previous detached garage with a new 528 square foot accessory building. The existing 94 square foot garden shed would remain. The total proposed area of accessory building space, including the attached garage, would be 1,422 square feet. The Zoning Ordinance allows 1,100 square feet of total accessory building area in the RS-3 District. Driveway. The existing driveway is paved with bituminous and will remain so following construction. Any part of the driveway disturbed by the new construction shall be paved prior to issuance of a Certificate of Occupancy for the new house. Building Height. A maximum allowable height for a detached accessory building in the RS-3 District is 15 feet. The proposed new detached accessory building will be 15 feet in height as defined by the Zoning Ordinance. The garden shed is approximately six feet in height. Existing Non-Conforming Conditions. There are no known non-conforming conditions on the property based on the survey submitted with the conditional use permit application. 3 CONDITIONAL USE PERMIT ANALYSIS The Zoning Ordinance allows the accessory building area requirement to be exceeded by conditional use permit subject to the following criteria as listed in Section 11-18-5 of the Zoning Ordinance: A. There is a demonstrated need and potential for continued use of the structure for the purpose stated. The new house will be constructed with an attached two car garage and will include a 172 square foot workshop area and will total 800 square feet. The Zoning Ordinance allows the attached accessory building space to be up to 1,250 square feet in area. The larger of the two detached accessory buildings will be used as a 528 square foot two-car garage with space for storage of personal and recreational/lake equipment. The total accessory building area is proposed to be 1,422 square feet. The use of the accessory buildings will be accessory to the principal use, a single-family home. B. No accessory building or private garage shall be utilized for all or a portion of a home occupation, for commercial activities or for commercial storage. This will be a stipulation of the conditional use permit. C. The accessory building has an evident reuse or function related to a single-family residential environment in urban service areas or hobby farm environment in nonurban service areas of the city. The proposed accessory building space is compatible and functional with a single family home use. Attached Exhibit F is a list of accessory building conditional use permits approved since 1981. The total proposed accessory building area will be approximately 2.2% of the area of the property, which is lower than a typical single family lot. D. Detached accessory buildings shall be maintained in a manner that is compatible with the adjacent residential uses and does not present a hazard to public health, safety and general welfare. The proposed detached garage building will be designed to match the exterior of the new house. The existing garden shed is constructed of finished metal. Both buildings will be compatible with the new home and other single family homes in the area. E. The performance standards and criteria of section 11-4-7 of this title shall be considered and a determination made that the proposed activity is in compliance with such criteria. The provisions of section 11-4-7 of the Zoning Ordinance (Conditional Use Permits) have been considered and satisfactorily met. Please refer to the attached findings of fact. 4 RECOMMENDATION Planning Department staff recommends approval of the Newman conditional use permit to allow a total accessory building area exceeding 1,100 square feet and two detached accessory buildings in the RS-3 District located at 10055 – 205th Street subject to the following stipulations: 1. The total accessory building area (combined attached and detached) on the property shall not exceed the dimensions shown on the plans approved by the City Council (approximately 1,422 square feet). 2.
