Proposed Action
Staff recommends adoption of the following motion: Move to approve a resolution approving the
final plat of Summerlyn 8th Addition.
Overview
U. S. Home Corporation (DBA Lennar) has submitted an application and plans for the final plat
of 49 single family lots and two outlots to be known as Summerlyn 8th Addition. The Summerlyn
8th Addition final plat is located east of Dodd Boulevard (CSAH 9) and south of 190th Street.
The Summerlyn Northwest preliminary plat of 84 single family lots was approved by the City
Council on November 3, 2014 and extended by the City Council on November 6, 2017 until
November 6, 2019. The lot, block and street design of the Summerlyn 8th Addition final plat is
consistent with the approved Summerlyn Northwest preliminary plat.

RESOLUTION APPROVING THE FINAL PLAT
OF SUMMERLYN 8TH ADDITION
WHEREAS, the owner of the property described as SUMMERLYN 8TH
ADDITON has requested and final plat approval; and
WHEREAS, the final plat is consistent with the approved Summerlyn Northwest
preliminary plat; and
WHEREAS, the final plat is acceptable to the City.
NOW, THEREFORE, BE IT RESOLVED by the Lakeville City Council:
1. The SUMMELRYN 8TH ADDITION final plat is hereby approved subject to
the development contract and security requirements.
2. The Mayor and City Clerk are hereby authorized to sign the development contract
and the final plat mylars.
3. The City Clerk is directed to file a certified copy of this resolution with the
Dakota County Recorder.

INTRODUCTION
U.S. Home Corporation (d/b/a Lennar Corporation) has submitted an application and plans for
the final plat of Summerlyn 8th Addition, which includes 49 single family lots and two outlots.
The Summerlyn 8th Addition final plat is located east of Dodd Boulevard (CSAH 9) and south
of 190th Street. The Summerlyn Northwest preliminary plat of 84 single family lots was
approved by the City Council on November 3, 2014 and extended by the City Council on
November 6, 2017 until November 6, 2019. The lot, block and street design of the Summerlyn
8th Addition final plat is consistent with the approved Summerlyn Northwest preliminary plat.
The final plat plans have been reviewed by Engineering Division staff and Parks and
Recreation Department staff.

PLANNING ANALYSIS
Zoning. The zoning of the property is RM-1, Medium Density Residential District which allows
single family home lots under the requirements of the RS-4, Single Family Residential District.

Existing Conditions. The Summerlyn 8th Addition final plat area is 19.92 acres and the parent
parcel is Outlot B, Summerlyn 6th Addition. The property includes an area previously graded
for future lots and the extension of Impala Avenue and Indora Trail.
Lot Area. Single family lots within the RS-4 District are required to provide a minimum lot
area of 8,400 square feet for interior lots and 10,200 square feet for corner lots. The areas of
the lots within Summerlyn 8th Addition meet the minimum square footage required by the
Zoning Ordinance.
Lot Width. The minimum lot width for single-family lots within the RS-4 District is 70 feet for
interior lots and 85 feet for corner lots. All lots meet the minimum lot width requirement.
Lot Depth/Width. The 10 lots abutting arterial Dodd Boulevard and major collector 190th
Street are required to provide a buffer yard lot depth of 150 feet and side yard buffer width of
95 feet. All six lots meet the buffer yard lot depth and width requirements.

The proposed building pads meet the minimum setback requirements.
Outlots. There are two outlots proposed with the Summerlyn 8th Addition final plat.
• Outlot A is 3.37 acres in area and will be dedicated to the City for wetland
preservation, stormwater management and park/greenway corridor purposes.
• Outlot B is 0.60 acres and will be deeded to the City for greenway corridor access and
open space purposes.
Development Density. The Summerlyn 8th Addition final plat consists of 49 single family lots
on one block and one outlot totaling 19.92 acres. The gross density of Summerlyn 8th
Addition is 2.45 units per acre. The area excluding Outlot A (3.37 acres) and Outlot B (0.60
acres) results in a net density of 3.07 units per acre.
Streets & Right-of-Way. Summerlyn 8th Addition will include the construction of four streets
including:

Impala Avenue is a 32-foot wide street within a 60-foot wide right-of-way and will be
extended north from its current terminus in Summerlyn 6th Addition to intersect with 190th
Street. A sidewalk will be constructed on the west side of Impala Avenue.
Iden Avenue is a 32-foot wide street within a 60-foot wide right-of-way and will be
constructed northwest from Impala Avenue to intersect with 190th Street. A sidewalk will
be constructed on the west side of Iden Avenue.
Indora Trail is a 32-foot wide street within a 60-foot wide right-of-way and will be
extended north from its current terminus in Summerlyn 6th Addition. A sidewalk will be
constructed on the west side of Indora Trail.
Iliad Circle is a 32-foot wide local cul-de-sac street within a 60-foot wide right-of-way and is
approximately 165 feet in length in compliance with Subdivision Ordinance requirements.
No sidewalk will be constructed on Iliad Circle.
Park Dedication and Trails. The Parks, Trail and Open Space Plan identifies a trail along the
south side of 190th Street between Dodd Boulevard (CSAH 9) and Holyoke Avenue. Park
dedication is required with the Summerlyn 8th Addition final plat by submittal of a cash fee
totaling $200,410 for 49 single family home lots at the park dedication fee of $4,090.00 per
unit.
Landscaping. Five buffer yard lots are located along Dodd Boulevard and six along190th
Street. The landscape plan proposes 30, eight-foot tall Black Hills Spruce, 20 Scotch Pine,
three Autumn Blaze Maple and six Red Oak trees within the buffer yards. A $50,000 escrow
shall be submitted by the developer to guarantee installation of the buffer yard landscaping.
Sod shall be installed to the trail along north and west property lines of Lots 1-4, Block 1; the
west property lines of Lots 11-13; Block 1; the north property line of Lot 1, Block 2; the north
property line of Lot 1, Block 4 and the north property line of Lot 1, Block 5. A $1,000 per lot
escrow shall be submitted as security to ensure installation of the sod to the trail.
Tree Preservation. There are no significant trees located within the Summerlyn 8th Addition
final plat.
Wetlands. A wetland delineation was completed for the preliminary plat of Summerlyn
Northwest, the underlying preliminary plat for Summerlyn 8th Addition. The Summerlyn 8th
Addition final plat incorporates the wetland management plan identified in the delineation
including restoration and establishment of wetlands and wetland buffers and the installation
of public signs identifying the natural area boundaries. Additional detailed narrative about
the wetlands is identified in the attached Engineering Division memo dated November 13,
2018.

Grading, Drainage and Erosion Control and Utilities. The final plat includes grading,
drainage and erosion control plans and utility plans. Grading, drainage and erosion control is
discussed in more detail in the November 13, 2018 engineering memorandum.
RECOMMENDATION
The Summerlyn 8th Addition final plat is consistent with the approved Summerlyn Northwest
preliminary plat and complies with the requirements of the Zoning and Subdivision
Ordinances. Planning Department staff recommends approval subject to the following
conditions:
1. Compliance with the recommendations listed in the November 13, 2018 engineering
report.
2. A $50,000 escrow shall be submitted by the developer to guarantee installation of the
buffer yard landscaping.
3. Sod shall be installed to the trail along north and west property lines of Lots 1-4, Block 1;
the west property lines of Lots 11-13; Block 1; the north property line of Lot 1, Block 2; the
north property line of Lot 1, Block 4 and the north property line of Lot 1, Block 5. Before a
building permit is issued, the developer shall submit an additional escrow of $1,000 per
lot for the 10 lots with buffer yards abutting Dodd Boulevard and 190th Street.
4. Park dedication is required with the Summerlyn 8th Addition final plat by submittal of a
cash fee for totaling $200,410 for 49 single family home lots at the park dedication fee of
$4,090.00 per unit.

BACKGROUND
Lennar Corporation has submitted a final plat named Summerlyn 8th Addition. This is a
combination of the second and third phases of the Summerlyn Northwest Preliminary Plat
approved by the City Council on November 3, 2014. The subdivision is located west of Holyoke
Avenue, east of and adjacent to Dodd Boulevard (CSAH 9), north of 194th Street and south of and
adjacent to 190th Street. The parent parcel consists of Outlot B, Summerlyn 6th Addition, zoned
RM-1, Medium Density Residential District.
The final plat consists of forty nine (49) single-family lots within six (6) blocks and two (2) outlots
on 19.92 acres. The Developer is dedicating 3.55 acres for Iliad Circle, Indora Trail, Iden Avenue,
and Impala Avenue right-of-way. The outlots created with the final plat shall have the following
use:
Outlot A: Wetland preservation, stormwater management, and park/greenway corridor; to
be deeded to the City (3.37 acres).
Outlot B: Greenway corridor access and open space; to be deeded to the City (0.60 acres).

SITE CONDITIONS
The Summerlyn 8th Addition site was previously mass graded as part of the Summerlyn Northwest
preliminary plat. There is a delineated wetland that runs through the northeast portion of the plat.
The land generally slopes from the north to the south with moderate to steep slopes.
STREET AND SUBDIVISION LAYOUT
Dodd Boulevard (CSAH 9)
Summerlyn 8th Addition is east of and adjacent to Dodd Boulevard, a minor arterial County
Highway as identified in the City’s Transportation Plan. The Developer dedicated right-of-way as
part of Summerlyn 6th Addition which will satisfy the right-of-way requirement.
190th Street
Summerlyn 8th Addition is located south of and adjacent to 190th Street. 190th Street is identified
in the City of Lakeville Comprehensive Transportation Plan as a major collector roadway. 190th
Street was improved to a 44-foot wide paved urban roadway with the Chokecherry Hill Addition
improvements. The Developer dedicated the necessary right-of-way for 190th Street with the
Summerlyn 6th Addition final plat.
Impala Avenue
Development of Summerlyn 8th Addition includes the construction of Impala Avenue, a local
street. Impala Avenue is designed as a 32-foot wide, two-lane urban street with a 5-foot wide
concrete sidewalk along the west side. Adjacent to Outlot A, the concrete sidewalk will transition
to an 8-foot wide bituminous trail, which will extend from 190th Street through Outlots A and B
and connect to the bituminous trail constructed with Summerly 6th Addition. Impala Avenue will
provide a connection and access to 190th Street. The Developer is dedicating 60 feet of right-of-
way.
A temporary cul-de-sac was constructed at the end of Impala Avenue with Summerlyn 6th
Addition. The temporary cul-de-sac must be removed and the area restored to City standards with
Summerlyn 8th Addition. The Developer will receive a credit to the cash fees for the removal of the
temporary turn-around on Impala Avenue constructed with Summerlyn 6th Addition
improvements.
Iden Avenue
Development of Summerlyn 8th Addition includes the construction of Iden Avenue, a local street.
Iden Avenue is designed as a 32-foot wide, two-lane urban street with a 5-foot wide concrete

sidewalk along the south side. Iden Avenue will provide a connection and access to 190th Street.
The Developer is dedicating 60 feet of right-of-way.
Indora Trail
Development of Summerlyn 8th Addition includes the construction of Indora Trail, a local street.
Indora Trail is designed as a 32-foot wide, two-lane urban street with a 5-foot wide concrete
sidewalk along the west side. The Developer is dedicating 60 feet of right-of-way.
Iliad Circle
Development of Summerlyn 8th Addition includes the construction of Iliad Circle, a local street.
Iliad Circle is designed as a 32-foot wide, two-lane urban street terminating in a permanent cul-
de-sac west of Iden Avenue. The Developer is dedicating 60 feet of right-of-way.
CONSTRUCTION ACCESS
Construction access and egress for grading, public utility installation and street construction shall
be off of 190th Street at Iden Avenue.
PARKS AND TRAILS
The Park Dedication requirement has not been collected on the parent parcels and will be satisfied
through cash contributions that will be paid with the final plat. The Park Dedication Fee will be
based on the rate in effect at the time of final plat approval, calculated as follows:

The City’s Parks, Trails, and Open Space Plan identifies a bituminous trail along the south side of
190th Street from Dodd Boulevard to Huxley Avenue and a bituminous trail extending through
Summerlyn 8th Addition and connecting to a bituminous trail constructed with Summerlyn 6th
Addition. The Developer shall construct the bituminous trails with the Summerlyn 8th Addition
final plat improvements. The City will credit the Developer’s cash fees $37,701.00 for 3/8ths the cost
of the trail along 190th Street and 100% of the greenway corridor trail. The credit is based on an
estimate provided by the Developer’s Engineer.
Trail lighting for the greenway corridor trail from 190th Street to Hillcrest Avenue shall be installed
with the construction of Summerlyn 8th Addition. The cost for trail lighting will be reimbursed to
the developer by the City once the trail lighting has been installed and will be based on the actual
cost to construct by Dakota Electric. The estimated cost of the greenway corridor trail lighting is
$50,600.00, based on an estimate from Dakota Electric.

UTILITIES
SANITARY SEWER
Summerlyn 8th Addition is located within sub district ML-70160 of the Marion Lake sanitary sewer
district as identified in the City’s Comprehensive Sanitary Sewer Plan. Wastewater will be
conveyed via existing public sanitary sewer to the MCES Lakeville/Farmington Interceptor and
continue to the Empire Wastewater Treatment Facility. The existing City-owned downstream
facilities have sufficient capacity to serve the residential development.
Development of Summerlyn 8th Addition includes public sanitary sewer construction. 8-inch sanitary
sewer main will be extended within the subdivision from existing sanitary sewer stubs to provide
service to the lots.
The Sanitary Sewer Trunk Area Charge was previously assessed to the parent parcels and has been
paid; therefore there is no sewer availability charge required with this final plat.
WATERMAIN
Development of Summerlyn 8th Addition includes public watermain construction. 8-inch
watermain will be extended within the subdivision from existing watermain stubs to provide
service to the lots.
Final locations and sizes of all sanitary sewer and watermain facilities will be reviewed by City staff
with the final construction plans. In association with MnOPS requirements, utility connections for
buildings within Summerlyn 8th Addition will not be permitted until the as-built electronic files
have been submitted and approved by City staff.
DRAINAGE AND GRADING
The plat of Summerlyn 8th Addition lies within Subdistricts SC-63 and SC-67 of the South Creek
Drainage District, as identified in the City’s Water Resources Management Plan.
Summerlyn 8th Addition includes the construction of a public stormwater basin on Outlot A.
Stormwater from this basin will flow through the existing wetland in Outlot A, under Impala Avenue
via an 18-inch culvert, and through the existing wetland in Outlot B to a basin constructed with
Summerlyn 6th Addition.
The Developer will receive a credit to the Trunk Storm Sewer Area Charge for deeding Outlots A
and B to the City, consistent with City policy. The credit is based on the area of the outlots and is
calculated at the rate of $5,500.00 per acre, and will be applied to the Summerlyn 8th Addition final
plat cash fees. The credit is calculated as follows:
3.97 acres x $5,500/acre = $21,835.00

The final grading plan must identify all fill lots in which the building footings will be placed on fill
material. The grading specifications must indicate that all embankments meet FHA/HUD 79G
specifications. The Developer shall certify to the City that all lots with building footings placed on
fill material are appropriately constructed. Building permits will not be issued until a soils
observation and testing report has been submitted to the Building Official and an as-built certified
grading plan, including the buffer yard berms along 190th Street and Dodd Boulevard have been
submitted and approved by City staff.
A National Pollution Discharge Elimination System General Stormwater Permit for construction
activity is required from the Minnesota Pollution Control Agency for areas exceeding one acre
being disturbed by grading. A copy of the Notice of Stormwater Permit Coverage must be
submitted to the City upon receipt from the MPCA.
RESIDENTIAL BUFFER YARD REQUIREMENTS
A buffer yard berm and landscaping screen consistent with the subdivision ordinance shall be
provided adjacent to 190th Street and Dodd Boulevard. A certified as-built grading plan of the
buffer yard berm must be submitted and approved by City staff prior to the installation of any
buffer yard plantings.
STORM SEWER
Development of Summerlyn 8th Addition includes public storm sewer construction. Storm sewer
will be installed within the subdivision to collect and convey stormwater runoff generated from
within the public right-of-way and lots to the public stormwater basin located in Outlot A,
Summerlyn 6th Addition.
Draintile construction is required in areas of non-granular soils within Summerlyn 8th Addition for
the street sub-cuts and lots. Any additional draintile construction, including perimeter draintile
required for building footings, which is deemed necessary during construction shall be the
Developer’s responsibility to install and finance.
The Trunk Storm Sewer Area Charge has not been collected on the parent parcels and will be paid
with the final plat at the current rate in effect at the time of final plat. The Trunk Storm Sewer Area
Charge is calculated as follows:

Final locations and sizes of all storm sewer facilities will be reviewed by City staff with the final
construction plans.
WETLANDS
There are no additional wetland impacts associated with the plat. A wetland delineation and
replacement plan meeting the WCA was completed and approved with the Summerlyn Northwest
preliminary plat. The Developer will be responsible for the installation of the required Natural Area
signs. Final sign locations will be determined in the field. The developer is responsible for the
restoration and establishment of the wetlands, buffers, and stormwater basins within Outlots A
and B. The developer shall submit a native seeding and management plan to the City for review
for Outlots A and B. A security will be collected for 39 Natural Area Signs and the
restoration/establishment of Outlots A and B. The security is calculated as $5,850.00 for Natural
Area Signs (39 natural areas signs at $150.00/sign) and $9,150.00 for restoration and establishment
of Outlots A and B, for a total of $15,000.00.
TREE PRESERVATION
There are no significant trees on the site.
EROSION CONTROL
The Developer is responsible for obtaining a MPCA Construction Permit for the site as well as
developing a SWPPP for the site prior to construction. The permit requires that all erosion and
sediment control BMPs be clearly outlined in a site’s SWPPP. Changes made throughout
construction should be documented in the SWPPP.
Additional erosion control measures may be required during construction as deemed necessary
by City staff. Additional measures shall be installed and maintained by the developer.
SECURITIES
The Developer shall provide a Letter of Credit as security for the Developer-installed
improvements relating to Summerlyn 8th Addition. Construction costs are based upon estimates
submitted by the Developer’s engineer on September 14, 2018.

The street light security totals $12,400.00 which consists of two mast arm street lights at $1,400.00
each and eight post-top street lights at $1,200.00 each.
The Developer shall post a security to ensure the final placement of iron monuments at property
corners with the final plat. The security is $100.00 per lot/outlot for a total of $5,100.00. The City
shall hold this security until the Developer’s land surveyor certifies that all irons have been placed
following site grading, utility and street construction.
CASH FEES
A cash fee for traffic control signs is due with the final plat. Street signing consists of five stop and
street blade combinations at $517.50 each and a mobilization fee of $172.50 for a total of
$2,760.00. If the street signs are installed during frost conditions, the developer shall pay an
additional $150.00 for each street sign location.
A cash fee for one-year of streetlight operating expenses will be paid with the final plat and is
calculated as follows:
49 units x $8.85/unit/qtr. x 4 qtrs. = $1,734.60

A cash fee for one-year of environmental resources expenses will be paid with the final plat and is
calculated as follows:
49 units x $10.42/unit/qtr. x 4 qtrs. = $2,042.32
Dwelling Units Surface Water Management Fee Total
A cash fee for the preparation of record construction drawings and for upgrading the City base
map will be paid with the final plat and is calculated as follows:

The Developer must submit the final plat and construction drawings in an electronic format. The
electronic format must be either a .dwg file (AutoCAD) or a .dxf file. The Developer must also pay
a cash fee for City Engineering Administration. The fee for City Engineering Administration will be
based on three percent (3.00%) of the estimated construction cost, or $32,844.11.
