HomeMy WebLinkAbout12-06-18 CITY OF LAKEVILLE PLANNING COMMISSION MEETING MINUTES December 6, 2018 Chair Kaluza called the meeting to order at 6:00 p.m. in the Council Chambers at City Hall. The pledge of allegiance to the flag was given. Members Present: Chair Pat Kaluza, Vice Chair Jason Kelvie, Jeff Witte, Jason Swenson, Karl Drotning, Brooks Lillehei, Paul Jarvis, Ex-officio Mike Lamm Members Absent: Scott Einck Others Present: Daryl Morey, Planning Director; Frank Dempsey, Associate Planner; Penny Brevig, Recording Secretary 3. Approval of the Meeting Minutes The November 15, 2018 Planning Commission meeting minutes were approved as presented. 4. Announcements None 5. Scott and Debra Newman Chair Kaluza opened the public hearing to consider the application of Scott and Debra Newman for a conditional use permit to allow a combined accessory building square footage greater than 1,100 square feet and more than one detached accessory building on a lot in the RS-3, Single Family Residential District and Shoreland Overlay th District, located at 10055 – 205 Street. Joseph Robbins and Jennifer Otto from Gonyea Companies were at tonight’s meeting to represent their clients, Scott and Debra Newman. Mr. Robbins stated that the proposed total accessory building area is approximately 322 square feet over what is allowed by the Zoning Ordinance. The Newmans would like to re-build the detached garage and keep the small storage shed that is still on the property. Associate Planner Frank Dempsey presented the planning report. Mr. Dempsey explained that the project includes the removal of the existing home constructed in 1890 and removal of an old detached garage, both of which were recently demolished, and the construction of a new home and new detached garage. An existing garden shed is proposed to remain. Mr. Dempsey reviewed the history of the site. He indicated that the single family home and the accessory buildings all meet setback requirements per the Zoning Ordinance Shoreland Overlay District requirements. The total proposed accessory building area, including the attached garage, would be 1,422 square feet. Mr. Dempsey stated that the Zoning Ordinance allows the accessory building area requirement to be exceeded by conditional use permit. Mr. Dempsey stated that staff recommends approval of the Newman CUP, subject to the four stipulations listed in the November 30, 2018 planning report, and adoption of the Findings of Fact dated December 6, 2018. Chair Kaluza opened the hearing to the public for comment. th Rick Schumacher, 10025 205 Street Mr. Schumacher lives next door to the applicant. He has no issues with this proposal. Motion was made by Lillehei, seconded by Kelvie to close the public hearing at 6:07 p.m. Voice vote was taken on the motion. Ayes - unanimous Chair Kaluza asked for comments from the Planning Commission. Discussion points included:  Agreed that this lot is large enough for the existing and proposed accessory buildings.  Mr. Newman stated that the original garden shed was on the property when they bought it. In 2014 the garden shed had hail damage, so they replaced it not knowing that they could not have two detached accessory buildings on one single family property without approval of a conditional use permit. Motion was made by Lillehei, seconded by Drotning to recommend to City Council approval of the Scott and Debra Newman conditional use permit to allow a combined accessory building square footage greater than 1,100 square feet and more than one detached accessory building on a lot in the RS-3, Single Family Residential District th and Shoreland Overlay District, located at 10055 – 205 Street, subject to the following stipulations, and adoption of the Findings of Fact dated December 6, 2018: 1. The total accessory building area (combined attached and detached) on the property shall not exceed the dimensions shown on the plans approved by the City Council (approximately 1,422 square feet). 2. The accessory buildings shall not be used for the operation of any commercial business or for the storage of commercial materials or equipment. 3. The new detached accessory building shall be constructed of exterior materials to match the house. 4. All driveway and parking areas shall be paved with bituminous, concrete or paver brick in compliance with Zoning Ordinance requirements.
