Overview KT Real Estate Holdings, LLC, representing the Kwik Trip gas and convenience store at 20187 Dodd Boulevard, has submitted an application for a Conditional Use Permit Amendment to allow an expansion of the existing convenience store for additional kitchen and food preparation area. Kwik Trip received conditional use permit approval for construction of the convenience store with motor fuel sales in 1995 (CUP No. 95-07). The Planning Commission held a public hearing on December 20, 2019 to consider the conditional use permit amendment request. The Planning Commission recommended unanimous approval subject to the seven stipulations listed in the December 14, 2018 planning report. There was no public comment. Stipulation No. 3 recommended by the Planning Commission was addressed with the submittal of the revised landscape plan. Primary Issues to Consider Does the proposed site plan and building elevation plan comply with Zoning Ordinance requirements? The site plan and building elevation plan meet the requirements of the Zoning Ordinance and the stipulations of CUP #96-16. Permit. Subject to the terms and conditions set forth herein, the City of Lakeville approves an amendment to Conditional Use Permit No. 95-07 to allow an expansion of the Kwik Trip convenience store building located in the C-3, General Commercial District. 2. Property. The permit is for the following described property located at 20187 Dodd Boulevard in the City of Lakeville, Dakota County, Minnesota: (See Exhibit A) 3. Conditions. The conditional use permit amendment is issued subject to the following conditions: a) The site and building improvements shall comply with the plans approved by the City Council. b) A building permit is required prior to commencing any building improvements. c) The new gate screening the trash/recycling storage area shall be constructed of durable, maintenance free material. d) A $5,000 financial security shall be submitted to guarantee installation of the landscaping. e) All parking spaces and drive aisles shall be paved with bituminous or concrete. f) Conditional Use Permit #95-07 shall remain in full force and effect. 4. Revocation. The City may revoke the conditional use permit amendment for cause upon determination that the conditional use permit amendment is not in conformance with the conditions of the permit or is in continued violation of the city code or other applicable regulations. 2 5. Expiration. This conditional use permit amendment shall expire unless the applicant commences the authorized use within one year of the date of this conditional use permit amendment, unless an extension is approved by the Zoning Administrator. The Planning Commission conducted a public hearing on the proposed conditional use permit amendment preceded by published and mailed notice. The applicant was present and the Planning Commission heard testimony from all interested persons wishing to speak. The City Council hereby adopts the following: FINDINGS OF FACT 1. The property is located in Planning District No. 5 of the 2008 Comprehensive Plan, which guides the property for commercial land uses. 2. The property is zoned C-3, General Commercial District. 3. The legal description of the property is: (See Exhibit A) 4. Section 11-4-3E of the City of Lakeville Zoning Ordinance provides that a conditional use permit may amendment not be issued unless certain criteria and satisfied. The criteria and our findings regarding them are: a. The proposed action has been considered in relation to the specific policies and provisions of and has been found to be consistent with the official City Comprehensive Plan. The proposed 444 square foot convenience store addition is consistent with the Comprehensive Plan’s designated commercial use of the property and the C-3, General Commercial District zoning of the property. b. The proposed use is or will be compatible with present and future land uses of the area. 2 The existing convenience store and motor fuel sales use and building addition is compatible with present and future land uses of the area. c. The proposed use conforms with all performance standards contained in the Zoning Ordinance. The proposed building addition will conform to all performance standards contained in the Zoning Ordinance. d. The proposed use can be accommodated with existing public services and will not overburden the City’s service capacity. The property is served with City sanitary sewer and water. The proposed building addition will not overburden the City’s service capacity. e. Traffic generation by the proposed use is within capabilities of streets serving the property. The traffic generated by the proposed building addition will not overburden the streets serving the property. 5. The planning report, dated December 14, 2018, prepared by Associate Planner Frank Dempsey is incorporated herein. Ms. Jenson stated that in conjunction with the Airlake Development 4th Addition final plat, a CUP was approved to allow certain lots to exceed Shoreland Overlay District requirements. Staff encourages developers to proceed in this manner as part of the platting process for the original proposed development of the property. • Project Engineer Joe Powers explained the infiltration basins on the site. • Commissioner Swenson expressed appreciation for the multiple uses in the same building having different hours of operation to help with parking demand. He also expressed appreciation for the planning consultant’s input on parking. • Commissioner Witte asked if there would be any on-site concessions? Ms. Guenther stated there would be no on-site concessions, but there may be vending machines. The recommendations listed in the December 12, 2018 engineering report. 2. The site plans and building construction shall be developed in accordance with the plans approved by the City council. 3. Kwik Trip (Dodd Boulevard) Chair Kaluza opened the public hearing to consider the application of KT Real Estate Holdings, LLC for a conditional use permit to allow an expansion of the Kwik Trip convenience store building located at 20187 Dodd Boulevard. Bjorn Berg from Kwik Trip presented a brief overview of their request. He indicated they have not done many improvements over the past 23 years to this site. They want to add a more functional and efficient layout for the kitchen. He indicated there are constraints on this property. They plan to relocate the dumpster enclosure to the Planning Commission Meeting Minutes, December 20, 2018 Page 5 southeast side of the building. They plan to add parking to the south side of the property to meet parking requirements, and they will comply with the landscaping from the original CUP by replacing the dead landscaping along Dodd Boulevard. Associate Planner Frank Dempsey presented the planning report. Mr. Dempsey stated that Kwik Trip has applied for a conditional use permit (CUP) amendment to allow an expansion of the existing convenience store (CUP 95-07) for an additional kitchen and food preparation area. Kwik Trip is in compliance with the stipulations of CUP 95-07 with the exception of Stipulation No. 3 (landscaping). The landscaping in place along Dodd Boulevard was removed because some of the plants had died. Mr. Dempsey stated that Kwik Trip has agreed to replace the dead landscaping along Dodd Boulevard and provide new landscaping adjacent to the new parking spaces in compliance with Zoning Ordinance requirements. Mr. Dempsey stated that 16 parking spaces will be required with the proposed addition. Kwik Trip is proposing 18 spaces. Eight new parking spaces will be constructed south of the fuel canopy. To accommodate the 444 square foot addition onto the west side of the building, the existing trash enclosure will be relocated to the southeast side of the building. Mr. Dempsey stated that staff recommends approval of the Kwik Trip conditional use permit amendment, subject to the seven stipulations listed in the December 14, 2018 planning report, and adoption of the Findings of Fact dated December 20, 2018. The property is located in Planning District No. 5 and is guided for commercial use consistent with the existing Kwik Trip convenience store with motor vehicle fuel sales. Zoning. The Kwik Trip property is zoned C-3, General Commercial District. The property includes three combined metes and bounds described parent parcels. Kwik Trip developed the site for a convenience store with motor fuel sales simultaneously with the development of the McDonald’s site in 1995. Each site was developed following approval of separate Planned Unit Development/Conditional Use Permits (PUD/CUPs). The Kwik Trip site is in compliance with the stipulations of CUP #95-07 with the exception of stipulation No. 3 (landscaping). The landscaping in place along Dodd Boulevard was removed since some of the plants had died. Landscaping. Kwik Trip has agreed to replace the dead landscaping along Dodd Boulevard and to provide new landscaping adjacent to the new parking spaces in compliance with Zoning Ordinance requirements. The list of proposed new shrubs must be revised on the landscape plan to comply with minimum size requirements and mature height requirements to provide the required screening of the parking area. The proposed Broadmoor Juniper is a ground level shrub not suitable for parking lot screening. The Broadmoor Juniper must be replaced with Maney Juniper or similar species in compliance with minimum planting and mature height size requirements. The existing convenience store building is 3,145 square feet in area. The addition is 444 square feet for a total building square footage of 3,589 square feet. The Zoning Ordinance requires one parking space per each 200 square feet of building area and allows a ten percent floor area credit from the gross building square footage.
