HomeMy WebLinkAboutItem 07L February 16, 2010 `— Item FEBRUARY 16, 2010 CITY COUNCIL AGENDA PUBLIC HEARING CITY ORDINANCE AND PUBLIC MAINTENANCE CODE VIOLATIONS 7439165th St. W, Proposed Action Staff recommends adoption of the following motion: Approve Resolution adopting Special Assessment No. 1269 for City Ordinance and Public Maintenance Code violations. Overview At its January 19, 2010 meeting, the City Council adopted a resolution calling a public hearing for City Ordinance and Public Maintenance Code violations. Staff authorized the contractual mowing of weeds/grass and incurred labor and equipment charges to remove rubbish from 7439 165th St. W. after the property owner failed to correct the violations. The Notice of Hearing on the proposed assessment was published in the Dakota County Tribune on January 21, 2010 and mailed on January 22, 2010 to the property owner who was in violation of City Ordinance 4-1-3 (Weed/Grass Ordinance) and 11-22-5 (Outdoor Storage), and Property Maintenance Codes 301.2 and 302.1 (Sanitation). The total amount proposed to be assessed to the parcel is $1,144.82. Staff has not received any written objections from the owner of the property being assessed. RESOLUTION ADOPTING ASSESSMENT FOR CITY ORDINANCE AND PUBLIC MAINTENANCE CODE VIOLATIONS WHEREAS, pursuant to proper notice duly given as required by law, the City Council has met, heard and passed upon all objections to the proposed special assessment for City Ordinance and Public Maintenance Code Violations. NOW, THEREFORE, BE IT RESOLVED by the City Council of Lakeville, Minnesota: 1. Such proposed assessment No. 1269 in the amount of $1,144.82, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the improvement in the amount of the assessment levied against it. 2. Such assessment shall be considered payable and collected with the taxes payable in 2011 and shall bear interest at the rate of 18% per annum from the date of the adoption of this assessment resolution to December 31, 2011. 3. The owner may at any time prior to certification of the assessment to the County Treasurer -Auditor, pay the entire assessment on such property, with interest accrued to the date of payment, to the City Finance Director. No interest shall be charged if the entire assessment is paid within thirty (30) days from the adoption of this assessment. An owner may at any time thereafter pay to the City the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. If an owner decides not to prepay the assessment before the date given above, the rate of interest that will apply is Eighteen (18%) percent per year. 4. The City Clerk shall forthwith transmit a certified duplicate of this assessment to the County Auditor to be extended on the property tax lists of the County, and such assessment shall be collected and paid over in the same manner as other municipal taxes.
