HomeMy WebLinkAboutItem 06.h1 March 15, 2010 Item No. REQUEST APPROVAL OF FIRST AMENDMENT TO THE ACTIVE LIVING SERVICES CONTRACT BETWEEN DAKOTA COUNTY AND THE CITY OF LAKEVILLE GRANT 1: Wayfinding Sign System — Valley Lake Park & East Community Park ($3,360.00) GRANT 2: Wayfinding Sign System — Downtown Lakeville ($12,400.00) Proposed Action Staff recommends adoption of the following motion: Move to approve first amendment to the Active Living Services Contract between Dakota County and the City of Lakeville. Overview Funding through Dakota County for a variety of projects associated with improving opportunities for area residents to engage in increased physical activities was made available in August, 2009. Staff submitted two grant requests; one for a wayfinding sign system from Antlers Park to Lakeville's north boundary (160th Street along Ipava Avenue), and one to fund development of conceptual master plans for a proposed future greenway corridor/regional trail on the Bury bluff. Both grants have been approved and Lakeville City Council previously approved an agreement for both projects. Since that approval, additional funding became available and staff applied for and received additional funding for wayfinding sign systems in Valley Lake Park, East Community Park and downtown Lakeville. First amendment to the agreement has been prepared by Dakota County and reviewed and recommended by staff for approval. Michaud Parks & Recreation Director Financial Impact: $ 15,760.00 Budgeted: Y/N N Source: Dakota County SHIP Grants Related Documents (CIP, ERP, etc.): Notes: DC Contract#: FIRST AMENDMENT TO THE ACTIVE LIVING SERVICES CONTRACT BETWEEN THE COUNTY OF DAKOTA AND CITY OF LAKEVILLE WHEREAS, the County of Dakota, by and through the Public Health Department, (hereinafter "County"), and City of Lakeville, 20195 Holyoke Avenue, Lakeville MN 55044, (hereinafter "Contractor"), entered into a Contract for the provision of Active Living services; and WHEREAS, the parties desire to amend the Contract so as to enable both parties to continue to enjoy the mutual benefits it provides; and WHEREAS, the Contract provides that any amendments shall be valid only when reduced to writing and signed by authorized representatives of the County and the Contractor. Now, THEREFORE, in consideration of the mutual covenants contained herein, the parties agree as follows: 1. Paragraph 4.1, "Total Cost," shall be changed to read: The total amount to be paid by the County pursuant to this Contract shall not exceed $31,160. 2. Paragraph 20, "Merger," Clause 20.2, shall be changed to add the following Exhibits and Attachments: Exhibit 6, "Blue Cross and Blue Shield of Minnesota (BCBS) Master Agreement Requirements, Attachment III, Funding AmAcation, and Attachment IV, Funding Application, all of which are attached and incorporated herein. 3. Exhibit 3, "Services and Payment," shall be amended to add reference to Attachment III, Funding Application, which references the purchase of eight (8) way -finding signs to be placed in two (2) parks around the City to increase use of the park for physical and recreational use at a total cost of $3,360. 4. Exhibit 3, "Services and Payment," shall be amended to add reference to Attachment IV, Funding AADDlication, which references the purchase of an informational kiosk, themed trail map, and way -finding signs to improve walk ability in the downtown area of Lakeville at a total cost of $12,400. All other terms of the Contract between the County and Contractor shall remain in full force and effect unless otherwise amended or terminated in accordance with law or the terms of the Contract. If any provision of this Amendment conflicts with the original Contract, or an earlier Amendment, this Amendment shall govern. Title Date of Signature City of Lakeville-11813.doc Page 1 Amend (Rev. 09-07).dot DC Contract#: Exhibit 6 Blue Cross and Blue Shield of Minnesota (BCBS) Master Agreement Requirements BCBS is the source of payment for this contract, and as such, has stipulated that the following requirements, (that are not already included in this contract) be met by the County and its subcontractors that are participating in the Healthy Eating Minnesota project: 1. Consultant shall comply with all applicable Federal, State, and local laws, rules, regulations, ordinances, and directives, regarding registration and reporting for lobbying activities, as defined in Minnesota Statute chapter 10A, and for Committees acting to promote or defeat a Ballot Question, as those terms are defined in Minnesota Statute section 211A.01. This includes, but is not limited to, compliance with Minnesota Statutes chapter 10A, 211 A, 211 B. 2. No state level or federal level lobbying will occur under the terms of this Agreement. As it relates to local level lobbying, Consultant shall comply with all applicable Federal, State, and local laws, rules, regulators, ordinances, and directives, regarding registration and reporting for lobbying activities, as defined in Minnesota Statute chapter 10A. Blue Cross is not a lobbyist principal for the purpose of this project. 3. Consultant represents and warrants that it conducts criminal background checks on its employees at the time of hire. Consultant further represents and warrants that all persons assigned to perform Services under this Agreement have not, to the Consultant's knowledge, been convicted of a felony crime of dishonesty, and that no person with such felony conviction of which Consultant is aware shall be eligible to perform Services under this Agreement. 4. General Communications Guideline: Healthy Eating Minnesota is a community -led program that Blue Cross is proud to support. As such, the majority of public communications are at the discretion of the community organization. That is, your organization will decide whether, when, how and with whom to share information about your program. Blue Cross does require funded organizations to identify Blue Cross in certain situations, using specific language. Describe the policy, system and/or environmental change that will result from this project. The proposed wayfinding signs will provide information about the benefits of walking, calorie bum, loop routes, etc. This information will target trail users, with the intent of changing habits by participating more frequently in active, healthy exercise. What are the goals and objectives of this proposed project? Design, acquire and install wayfinding trail sign system at two existing lake loop trail facilities in Lakeville. Site one is Valley Lake Park (three loop options at .55, .89 and 1.27 miles); site two is East Community Park (1.3 miles). Each site will have a wayfinding informational sign showing available routes, distances, calories burned, health tips and contacts for additional information. Describe any assessment or study analysis that has been done, which supports the need for this proposed project. No specific study has been completed however community surveys completed by the City in past years consistently indicated a high use and support of the Lakeville trail system. The City believes citizens would gravitate to a planned wayfinding system and associated loop health walk systems. The City has received numerous trail user contact via phone calls and general conversations about the need for more onsite information, in particular trail distances between major destinations, "you are here" reassurance signs and park benches along trails for users to rest. Describe how the project contributes to advancing your agency's Comprehensive Plan, Livable Communities Plan, or Master Bike and/or Pedestrian Plan. The proposed project will enhance existing trail loop systems by providing information to trail users, educating them towards the benefits of regular exercise through walking, jogging and biking. The proposed signs would include caloric burn charts, trail master plan, location and distance reassurance signs. Describe the population segment (s) you will impact through this change. Valley Lake Park is located on the border between Lakeville and Apple Valley. The Lakeville side consists of a large, single-family residential area, consisting of families and children. The Apple Valley side consists of large, dense apartments with young adults and older residents. To summarize, users will consist of youth through seniors. As part of Lakeville's 2006 Downtown Development Guide, an important part of making a downtown successful is a well laid out wayfinding system — "...wayfinding refers to a coordinated system of informational signage that directs people to key community destinations." (Attachment A) Funding from the Dakota County Public Health Department (DCPHD) will be used to establish a wayfinding system in central Downtown Lakeville that will link to existing trails, parks and community recreation facilities throughout the City. The wayfinding system will provide residents and Downtown business owners with signage indicating key linkages to area amenities as well as strategic Downtown parking areas. This system will mesh with the long-term plan for a comprehensive parks and trails system throughout the City of Lakeville. (See attachment B for an area layout and wayfinding system design recommendations) What are the goals and objectives of this proposed project? - Active Living Goals (Lakeville's 2008 Comprehensive Land Use Plan p.29 —Attachment C): ■ Provide access to safe, convenient and affordable opportunities for a variety of physical activities for all persons through the built environment in Lakeville ■ Plan with other governmental jurisdictions to plan for ongoing interdisciplinary collaboration, promotion of facilities, behavioral supports, policies that institutionalize the vision of active living and routine maintenance that ensures continued safety, quality and attractiveness of the physical environment. - Specific project objectives: ■ Increase walkability of Downtown Lakeville. • Increase awareness of available parking in the Downtown so people will be able to park once and walk to several destinations in Downtown Lakeville. ■ Make pedestrian, area identification, and parking wayfinding more efficient. Increase accessibility for the Downtown Farmers Market by encouraging health -conscious shoppers to park in a central location and walk via a safe pedestrian route to Market Plaza. Describe any assessment or study analysis that has been done, which supports the need for this proposed project. The Downtown Development Guide was developed in 2006 by a City Council appointed task force to lay out a plan for revitalizing Downtown Lakeville. As part of the Development Guide one of the components addressed was a central Downtown plaza area to be used for community activities and serve as a hub of pedestrian activity in the Downtown. In 2009 Market Plaza was completed in Downtown Lakeville by transforming an existing street and surrounding property into a pedestrian and environmentally friendly public parking and public event location. This serves as a permanent location for the St. Paul Farmer's Market during the summer as well as activities coordinated by the City of Lakeville and the Downtown Lakeville Business Association (DLBA) throughout the year. Two components of the vision created in the 2006 Downtown Development Guide include (attachment D): - A system of streets, sidewalks and parking lots allow safe and convenient access to Downtown. - Sidewalks, trails, and bike lanes provide interesting and safe ways to reach Downtown without a car. These components will be realized through the creation of a Downtown wayfinding system. Pioneer Plaza plans/wayfinding — Concept plans have been designed for recreating Pioneer Plaza in Downtown Lakeville as a compliment to the new Market Plaza. Attached is the work that has been done to date on this pedestrian center for Downtown as well as the creation of a Downtown wayfinding system. (Attachment E) Describe how the project contributes to advancing your agency's Comprehensive Plan, Livable Communities Plan, or Master Bike and/or Pedestrian Plan. Lakeville's 2008 Comprehensive Land Use Plan contains a section entitled Active Living (also described in project goals and objectives above). The proposed Downtown wayfinding system will contribute toward meeting Lakeville's Comprehensive Plan Active Living goals and policies by creating safe and convenient opportunities for pedestrians to park in Downtown Lakeville and walk to both business and community recreation facilities. (Comp Plan/Active living — attachment C) As described above, the Downtown wayfinding plan will also contribute towards the 2006 Downtown Development Guide's plan for a wayfinding system (Wayfinding p.45 — attachment A) The 2006 Lakeville Comprehensive Parks, Trails and Open Space Plan will be advanced with this project by meeting several trail development policies and trail facility purpose and design policies. (Attachment F) Specifically: - Provide supportive facilities (i.e., bike parking areas, restrooms, water, rest areas, benches, etc.) in conjunction with trail development. (p.97 #9) - Provide trail system connections between major community destinations areas (i.e., parks, schools, commercial/industrial centers, lakes, public buildings, and residential areas). (p.97 #13) - Develop a trail system that connects major residential areas with schools, parks, shopping areas, centers of employment, civic facilities and other recreational and commuter destinations. (p.98 #1) - Promote trail use as an alternative mode of transportation as well as for recreational purposes. (p.98 #3) - Maintain a system -wide signage plan. (p.99 #12) Describe the population segment (s) you will impact through this change. Downtown Lakeville is in close proximity to three senior living facilities comprising 139 living units for active seniors. A Downtown wayfinding system will encourage seniors to be more active and utilize existing trails and community recreation facilities in the Downtown area. Downtown Lakeville is also host to McGuire Middle School, John F. Kennedy Elementary School, Community Education offices, and a District 194 Alternative Learning Center. School children use the surrounding trail system in their daily travel to school as well as many of the surrounding community recreation facilities. (See attached map of Downtown area parks, trails and schools — attachment G) The proposed wayfinding signage will help increase pedestrian safety as well as directional guidance for this demographic. Additional impacted population segments include Downtown business customers, Farmers Market shoppers, and Downtown seasonal event attendees.
