APPROVE BUILDING PERMIT FEE ORDINANCE AMENDMENT ELIMINATING REFERENCE
TO AND INCLUSION OF STATE OF MINNESOTA SURCHARGE FEES
Proposed Action
Staff recommends adoption of the following motion: Adopt an ordinance amending the City's
fee schedule for building permit fees to eliminate reference to and inclusion of State of
Minnesota surcharges for City issued building permits.
Adoption of this ordinance will result in the City only including City fees for building permits and
State surcharge amounts will not be included in the City's fee schedule that is approved by
ordinance each year.
Overview
In April of this year the State Legislature approved and the Governor signed a supplemental
budget bill that among other things increased the minimum State surcharge amount collected
on fixed fee building permits from $.50 to $5 effective July 1, 2010 to June 30th 2011. Examples
of the fixed fee building permits include permits for re -roofing, residing, window replacement,
and minor electrical or plumbing work among others.
State surcharge fees are collected by the City with the issuance of all building permit fees and
are forwarded to the State of MN Construction Codes and Licensing Division of the Department
of Labor and Industry. The increase was determined by the State to be necessary because of
a significant reduction in the surcharge amounts being collected as a result of the downturn in
the construction industry.
The City has previously included the State surcharge amount in the fixed fee building permits in
part because of the desire to have round number amounts for fixed fee permits such as $40.00
for a re -roofing permit rather than $39.50. However it is staff's recommendation that we
discontinue this practice and no longer include any reference to State surcharge amounts in our
fee schedule which has to be adopted by ordinance. This will eliminate the need to amend the
City's ordinance when State surcharge amounts are changed in the future.
Primary Issues to Consider
• Is the City increasing its portion of building permit fees as part of this ordinance
amendment? The City portion of building permit fees are remaining the same.

Surcharge fee increase background information
The economic downturn in the construction industry has significantly impacted the Construction
Codes fund. The downturn has greatly diminished the annual revenue the Department of Labor
and Industry's (DLI) Construction Codes and Licensing Division (CCLD) receives from plan
reviews, permits, licenses and surcharges.
CCLD's revenue is also hampered by the ongoing annual transfer of $1.515 million from its
Construction Codes fund. This fund is a State Government Special Revenue fund and not a
General fund account. Yet, during the 2007 session, the Legislature required DLI to transfer
$1,627,000 by June 30, 2008; $3,515,000 by June 30, 2009; and $1,515,000 each year thereafter
from the Construction Codes fund to the General fund (Chapter 135, Article 1, Section 16).
Since 2005, approximately $12 million of CCLD funds have been transferred to the General
Fund. In 2009, $3.515 million was transferred to the General fund, which forced CCLD to lay off
13 staff, cancel contractor education programs and spring and fall seminars, and reshuffle
programs to meet budgets.
During the 2010 session, CCLD attempted to eliminate this year's $1.515 million transfer.
Instead, the first legislative budget proposed an additional $1 million be transferred from the
Construction Codes fund to the General fund.
Minnesota's construction industry then stepped up and asked the legislature to reconsider its
budget proposal. In response, the Legislature removed the $1 million transfer, kept in the $1.515
million transfer in place and raised the minimum state building permit surcharge fees applicable
to fixed fee permits for one year from 50 cents to $5 (July 1, 2010, until June 30, 2011).
Next session, CCLD will again try to remove the annual $1.515 million transfer from the
Construction Codes fund to the General fund during its budget submittals.
CCLD's preference was to remove the yearly transfer and not raise the surcharge fee. The
decision to raise surcharge fees was made by legislative finance committees and was packaged
into a large finance and budget bill that was signed by the Governor.

This ordinance prescribes fees sufficient to defray the costs incurred by the City of
Lakeville in reviewing, investigating and administering applications for the amendment
to an official control established pursuant to Minnesota Statutes Sections 462.351 to
462.364 and applications for permits or approvals required under an official control
established pursuant to those sections. This ordinance also prescribes billboard license
fees and building permit and related fees.
A printed copy of the ordinance is available for inspection by any person during regular
office hours at the office of the City Clerk.

Permit to fill a wetland as allowed by the Wetland Conservation Act $75.00
Services performed by City Personnel in administering the Wetland Conservation Act will
be billed at 2.5 times the actual payroll hourly rate. A minimum escrow of $250.00 will be
required (if not collected through Planning and Zoning actions) for: Wetland
delineation/delineation review, replacement plan review, mailings and administration,
construction inspection and annual monitoring until successful establishment of mitigation
area.
In addition to the above fees, a deposit will be required to fund special studies such as
environmental assessment worksheets, transportation, drainage, noise impacts, indirect source
permits, etc. The amount of deposit to be based on the site, complexity, diversity and location of
the project.

Site, grading, drainage, utility and street plan and specifications review
Services performed by City Personnel will be hourly and billed at 2.5 times actual
hourly rate. A cash escrow may be required (if not collected through Planning and
Zoning).
C. Wetland Conservation Act Administration (platting or non -platting action)
Permit to fill a wetland as allowed by the Wetland Conservation Act $75.00
Services performed by City Personnel in administering the Wetland Conservation Act will
be billed at 2.5 times the actual payroll hourly rate. A minimum escrow of $250.00 will be
required (if not collected through Planning and Zoning actions) for: Wetland
delineation/delineation review, replacement plan review, mailings and administration,
construction inspection and annual monitoring until successful establishment of mitigation
area.
In addition to the above fees, a deposit will be required to fund special studies such as
environmental assessment worksheets, transportation, drainage, noise impacts, indirect source
permits, etc. The amount of deposit to be based on the site, complexity, diversity and location of
the project.
