APPOINTMENT OF DEPUTY CITY CLERKS FOR
ELECTION ADMINISTRATION
Staff recommends adoption of the following motion: Move to approve a resolution
appointing deputy city clerks for election administration.
Passage of this motion will allow the City Hall receptionists to witness absentee ballots
as election officials.
Overview
Minnesota Statute requires that the absentee ballot return envelope must contain a
statement signed by a person who is registered to vote in Minnesota or by a notary
public or other individual authorized to administer oaths.
Many residents vote by absentee ballot in person at City Hall. The City Hall
receptionists are asked to assist with the absentee voting process. However, neither
one is a notary public. A deputy city clerk is authorized by state statute to administer
oaths. Therefore, at the recommendation of the Secretary of State's office, the City
Clerk is requesting that the City Hall receptionists be appointed as deputy city clerks for
the administration of elections.
Primary Issues to Consider
Is this action necessary to assure that absentee ballots are processed according to
State Statue?
Allowing the receptionists to complete the witness statement as an election official helps
assure that the witness is eligible under State Statue and the ballot will be accepted by
the Absentee Ballot Board.

RESOLUTION APPOINTING DEPUTY CITY CLERKS FOR
ELECTION ADMINISTRA TION
WHEREAS, the Dakota County Auditor has designated the Lakeville City
Clerk to administer absentee voting for the City of Lakeville; and
WHEREAS, the City Clerk deems it necessary for City Hall Receptionists to
assist with the absentee voting process; and
WHEREAS, Minnesota Statute 2036.07 requires that the absentee ballot
return envelope must contain a statement signed by a person who is registered to
vote in Minnesota or by a notary public or other individual authorized to administer
oaths; and
WHEREAS, a deputy city clerk is authorized by State Statute to administer
oaths.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Lakeville, Minnesota that each of the City Hall Receptionists shall be appointed
Deputy City Clerk for the purpose of administering elections.
