HomeMy WebLinkAboutItem 06.l Date: March 14, 2019 Item No. FIRST AMENDMENT TO JOINT POWERS AGREEMENT WITH DAKOTA COUNTY FOR 2019 WASTE ABATEMENT COMMUNITY FUNDING Proposed Action Staff recommends adoption of the following motion: Move to approve First Amendment to Joint Powers Agreement with Dakota County for 2019 Waste Abatement Community Funding. Overview Dakota County annually budgets funds to promote and operate local Waste Abatement (Recycling) Programs. The Cities of Apple Valley, Burnsville, Eagan and Lakeville collectively share recycling efforts and responsibilities through a partnership named Dakota Valley Recycling (DVR). DVR was allocated $247,416 in funding for their 2019 Dakota County Community Funding Application (representing all four participating cities). The Joint Powers Agreement and funding application were approved by the City Council on November 5, 2018. Dakota County recently approved additional funding for the 2019 Waste Abatement Community Funding Program. As a result, additional funds were allocated to DVR, bringing their total 2019 allocation to $252,364.48. The new funding will be used to implement initiatives identified in DVR’s revised 2019 Work Plan. Primary Issues to Consider • The First Amendment to Joint Powers Agreement identifies the responsibilities and funding associated with administering DVR’s 2019 waste abatement program. • Funds are used to develop and implement waste abatement programs, educational programs and outreach activities for residents and businesses that meet waste management objectives and promote recycling awareness. NOW THEREFORE, in consideration of the mutual covenants contained herein the Parties agree as follows: 1. To amend Section 6.1 to provide the total 2019 allocation under the Agreement shall not exceed $252,364.48. 2. All other terms of the Agreement between the County and Municipality shall remain in full force and effect. 3. In any case where this Amendment conflicts with the Agreement, this Amendment shall prevail. This Agreement may be executed in one or more counterparts, each of which so executed and delivered counterpart is original, and such counterparts, together, shall constitute the same instrument. Materials Collection Events and Activities GOAL: Increase residential waste reuse and recycling through events and activities to collect reusable and/or recyclable materials, in keeping with the statutory 75% recycling goal for metropolitan counties (MN Stat. §115A.551) and the waste management hierarchy. 6 Task Activities County Funds Requested Report Expended (YTD) 1 Provide at least two municipality-wide events or opportunities for residential paper to be shredded and recycled as an addition to an existing event or as a stand-alone opportunity (M, L). PLAN: Will provide paper shredding at the Lakeville and Burnsville HHW collection events, as well as the Apple Valley clean-up day and one stand-alone event in Eagan. We will advertise for events in all four cities. REPORT: [report results – describe activities, locations, dates, estimated number of people served, and weights provided by vendor] $4,000 2 a. Provide at least one mattress collection event or opportunity to residents for recycling as an addition to an existing event or as a stand-alone opportunity (e.g., cleanup day, roll-off, curbside collection etc.), and b. Ensure that any mattresses, bicycles, and carpet in a municipality-coordinated collection are delivered for reuse or recycling, with preference given to reuse (M, L – Medium cities encouraged to pool funds with adjacent medium cities; small cities optional to add on to medium or large city collection events). PLAN: Will provide residents with the opportunity for at least one mattress collection event and will advertise in each city. We will also ensure that any mattresses, bicycles and carpet collected at municipality-coordinated events will be delivered for reuse or recycling. Municipality-Wide Organics Diversion GOAL: Implement and continue planning for community-wide organics diversion, increase awareness of organics recycling for residents, increase the organics recycling rate, and decrease the amount of food thrown away in households, in keeping with the statutory 75% recycling goal for metropolitan counties (MN Stat. §115A.551) and the waste management hierarchy. Coordinate a large event (e.g., Food Too Good To Waste Challenge) PLAN: We will provide direct outreach to residents about food waste prevention opportunities using County toolkits through presentations, booths at community gatherings, or by coordinating large events. PLAN: Will collaborate with Dakota County to implement Food Too Good to Waste/Save the Food by providing food waste prevention resources to residents through mailed newsletters, direct links to the Dakota County webpage for food waste prevention, and electronic media. Solid Waste Master Plan Support and Implementation A. Master Plan/Policy Plan Activities GOAL: Effective planning and implementation for municipality alignment with Dakota County Solid Waste Master Plan goals and strategies. Amendments being considered include: weekly recycling collection, recycling at events/festivals, multi-unit recycling, or increased volume-based pricing. (S, M, L, R).
