The Applicant will be required to dedicate additional drainage and utility easement over the vacated area of the right-of-way prior to issuance of a building permit. SSTTRREEEETT AANNDD SSUUBBDDIIVVIISSIIOONN LLAAYYOOUUTT Kenyon Avenue Lot 1, Block 2, Kenwood Place is located southeast of and adjacent to Kenyon Avenue, a major collector as identified in the City’s Transportation Plan. The right-of-way for Kenyon Avenue was dedicated with the Kenwood Place final plat. A single full-access driveway will be constructed to provide access to the development from Kenyon Avenue. Kenwood Trail (CSAH 5) Lot 1, Block 2, Kenwood Place is located west of and adjacent to Kenwood Trail (CSAH 5), a minor expander as identified in the City’s Transportation Plan. The right-of-way for Kenwood Trail was dedicated with the Kenwood Place final plat. As part of the site plan review, the City required the Applicant to submit a traffic signal warrant analysis for the intersection of Kenwood Trail and Kenyon Avenue using anticipated post-development traffic volumes. The results of this analysis suggest that one or more signal warrants are likely to be met upon completion of the development. Due to the traffic generated from the proposed improvements warranting the installation of a traffic signal, the City will assess the Applicant $45,000.00 for the cost of a new signal installation. The Applicant shall waive their procedural rights to appeal the assessment. Terms of the assessment shall be finalized prior to City Council approval of the Conditional Use Permit. CCOONNSSTTRRUUCCTTIIOONN AACCCCEESSSS Construction traffic access and egress shall be restricted to a single entrance from Kenyon Avenue. PPAARRKKSS,, TTRRAAIILLSS AANNDD SSIIDDEEWWAALLKKSS The Park Dedication requirement for Lot 1, Block 2, Kenwood Place was satisfied through an easement agreement for right-of-way for City Project No. 13-07. CCAASSEEYY’’SS CCOONNVVEENNIIEENNCCEE SSTTOORREE MMAARRCCHH 2277,, 22001199 PPAAGGEE 33 OOFF 55 The site plan includes the construction of private sidewalks on the site and private sidewalk connections to the existing public sidewalks on Kenyon Avenue and Kenwood Trail (CSAH 5). The Applicant shall be required to maintain all private sidewalks, including the private sidewalk connections located within the public right-of-way. A permit will be required from Dakota County prior to construction of the private sidewalk located within CSAH 5 right-of- way. UUTTIILLIITTIIEESS SSAANNIITTAARRYY SSEEWWEERR An existing sanitary sewer service is provided to Lot 1, Block 2, Kenwood Place. The Applicant will connect to the existing sanitary sewer service to serve the proposed building. The Sanitary Sewer Availability Charge has been collected on the parent parcel and will not be required with the building permit. WWAATTEERRMMAAIINN An existing watermain service is provided to Lot 1, Block 2, Kenwood Place. The Applicant will connect to the existing watermain service to serve the proposed building. DDRRAAIINNAAGGEE AANNDD GGRRAADDIINNGG Lot 1, Block 2, Kenwood Place is located within subdistrict OL-24 of the Orchard Lake drainage district as identified in the City’s Water Resources Management Plan. Stormwater from the site will be collected and routed through private and public storm sewer to a regional filtration basin located in Outlot C, Kenwood Place. The regional basin will provide water quality treatment and rate control of the stormwater runoff generated from the proposed site improvements. Prior to the issuance of a building permit the Applicant shall sign a private maintenance agreement for the private storm sewer. Lot 1, Block 2, Kenwood Place contains more than one acre of site disturbance, therefore a National Pollution Discharge Elimination System General Stormwater Permit for construction activity is required from the Minnesota Pollution Control Agency. A copy of the Notice of Stormwater Permit Coverage must be submitted to the City upon receipt from the MPCA. RREETTAAIINNIINNGG WWAALLLLSS Development of Casey’s Convenience Store includes the construction of one privately owned and maintained retaining wall. An encroachment agreement shall be executed prior to the issuance of a building permit for the retaining wall to be located within a public drainage and utility easement. SSTTOORRMM SSEEWWEERR Development of Casey’s Convenience Store includes the construction of a private storm sewer system. Stormwater from the site will be collected and routed through privately owned and maintained storm sewer to public storm sewer located in Kenyon Avenue. Prior to connecting to the public storm sewer, stormwater will flow through a privately owned and maintained oil and grit separator. After entering the public storm sewer, stormwater will be routed through an existing stormwater treatment structure and to a regional filtration basin located in Outlot C, Kenwood Place. The Trunk Storm Sewer Area Charge was satisfied through an easement agreement for the stormwater management basin for City Project 13-07. Final locations and sizes of all storm sewer facilities will be reviewed by City staff with the final construction plans. FEMA FLOODPLAIN ANALYSIS Lot 1, Block 2, Kenwood Place is shown on the Flood Insurance Rate Map (FIRM) as Zone X by the Federal Emergency Management Agency (FEMA). Based on this designation, there are no areas on the site located within a Special Flood Hazard Area (SFHA), as determined by FEMA. WWEETTLLAANNDDSS There are no wetlands on the site. TTRREEEE PPRREESSEERRVVAATTIIOONN There are no significant trees on the site. EERROOSSIIOONN CCOONNTTRROOLL The Applicant is responsible for obtaining an MPCA Construction Permit for the site as well as developing a SWPPP for the site prior to issuance of a building permit. The permit requires that all erosion and sediment BMPs be clearly outlined in a SWPPP. Changes made throughout construction must be documented in the SWPPP. All basin slopes and slopes adjacent to wetlands must have erosion control blanket installed. Any additional measures required shall be installed and maintained by the Applicant. SSEECCUURRIITTIIEESS The Applicant shall provide a Letter of Credit as security for the Applicant-installed improvements relating to the site plan. The Security amount will be determined prior to City Council approval of the Conditional Use Permit and must be submitted to the City prior to issuance of a building permit. CCAASSHH FFEEEESS The cash fees for the project will be determined prior to City Council approval of the Conditional Use Permit and must be submitted to the City prior to issuance of a building permit. RREECCOOMMMMEENNDDAATTIIOONN Engineering recommends approval of the site plan, grading plan, and utility plan for Casey’s Convenience Store, subject to the requirements within this report including: 1. The Applicant shall submit as-built record drawings following the completion of this project. 2. The Applicant shall revise the site plans in accordance with review comments provided to the Applicant’s Engineer by the City on March 27, 2019. 3. The Applicant shall submit a SWPPP for review and approval prior to City Council approval. 4. The Applicant shall dedicate additional drainage and utility easement over the vacated area of the right-of-way along Kenyon Avenue.
