THE EDISON AT SPIRIT
AMENDED AND RESTATED PARKING DEFERMENT AGREEMENT
Proposed Action
Staff recommends adoption of the following motion: Move to approve an amended and restated
parking deferment agreement for The Edison at Spirit.
Overview
The Edison at Spirit preliminary and final plat of one lot for a 150-unit apartment building and
10 carriage house units was approved on October 15, 2018. A parking deferment agreement was
approved administratively and recorded in conjunction with the preliminary and final plat. The
developer of Edison recently made some architectural changes to the apartment building that
results in the loss of two underground parking spaces and one on-site parking space. The revised
site plan, which is attached as Exbibit A to the amended and restated parking deferment
agreement, includes two additional proof-of-parking spaces to meet Zoning Ordinance
requirements (the original site plan had two parking spaces more than required by ordinance).
Because the original parking deferment agreement was recorded against the property, the City
Attorney determined that the City Council must approve an amended and restated parking
deferment agreement. The amended and restated parking deferment agreement includes the
parking numbers from the revised Edison site plan.
