GRANT OF TEMPORARY EASEMENT
HERITAGE LIQUOR STORE FIBER CONNECTION
Proposed Action
Staff recommends adoption of the following motion: Move to approve the grant of a temporary
easement with EREP Heritage Commons I, LLC.
Overview
As part of the city’s efforts to interconnect their facilities with city owned fiber, an easement is
required for the installation of a conduit and fiber from the existing fiber line along Heritage Drive
through the Heritage Commons property to the Heritage Liquor store. The temporary easement
will allow the city to install the conduit and fiber within the common area on private property.
Primary Issues to Consider
Is there any cost associated with obtaining the temporary easement?
• Yes, the property owner has requested the city reimburse them $2,750 for their legal fees for
reviewing the easement request and documentation in exchange for the temporary easement.
